Minutes of the public hearing as advertised concerning the proposed
revision of the City of Chubbuck's Land Use Ordinance and special
meeting held in the city municipal building June 29, 1982.
Present: Mayor John O. Cotant, Jr., Councilmembers Becky A. Hopkins,
Dwain A. Kinghorn, Tom Nield, LeRoy S. Quick, Attorney B. Lynn Winmill,
Public Works Director Steven M. Smart and City Clerk Vera C. Armstrong.
Councilwoman Hopkins attended meeting from 7:45 till adjournment.
Meeting called to order at 7:35 p.m. by Mayor Cotant.
Mayor Cotant asked for corrections or additions to minutes of June 8 and
June 22.
There being none, Councilman Quick moved to approve council meeting
minutes of June 8. Councilman Kinghorn seconded motion, vote was
unanimous in favor of motion.
Councilman Nield moved to approve council minutes of June 22 as
written. Councilman Quick seconded motion, vote was unanimous in
favor of motion.
PUBLIC HEARING - PROPOSED REVISION OF THE CITY OF CHUBBUCK'S LAND USE
ORDINANCE.
Mayor Cotant declared the public hearing open on the proposed revision
of the City of Chubbuck's Land Use Ordinance.
Maurice Guidinger, 501 Chickadee, asked how dogs would be limited
and the provisions for owning several dogs.
Don Andra, 711 Victor, asked about control of other animals such
as sheep and horses. Mr. Andra said he had four dogs and plans
to have seven dogs, voiced objection to proposed ordinance allowing
only two dogs in residential zones.
Jane Guidinger, 501 Chickadee, stated they have four dogs and breeds
them and feels it is communistic to tell one how many dogs an owner
can keep.
Ruth Ann Merrell, 204 Mingo, said she felt the proposed ordinance
will not solve the cities problem of barking dogs, that the provisions
will only hurt owners of three or more dogs.
Tom Cromwell, 166 Mingo, said he knows of a family with two dogs
that causes more problems than families with three and more dogs.
Maurice Guidinger asked that the parts of the ordinance concerning
dogs be read. Attorney Winmill read portions of ordinance with
regulations concerning dogs.

PUBLIC HEARING CONTINUED:
John Stoddard, 211 Hiway, stated he felt neighbors should handle
barking dogs problems themselves first and usually do, then call
city.
Bob Anderson, 5646 Sorrell Dr., asked about the total ordinance
adoption and purpose. Mayor Cotant told him the Local Land
Use Planning Act was mandated at state level in 1975.
John D. Larsen, 154 Mingo, said he would guess that only one-fourth
of the dogs in Chubbuck are licensed, that the honest people that
license their dogs are being penalized.
G. Darrell Larkin, 237 Mingo, asked about the three classes of
Production Dwellings and added that his mobile home is a Class
and he could not afford to upgrade to a Class II Production Dwelling.
Randy Anderson, 238 Mingo, stated he has a mobile home and would
like to be able to upgrade when possible.
"Skip" King, 204 Mingo Lane, said he has been harassed for six
years because of the many vehicles at his household. He has six
licensed drivers in his family and owns seven cars, he has six
snow machines and five motorcycles. He parks them off-street in
front of his mobile home as that is the only place he has to park
them. He feels he needs to have these vehicles and equipment for
his family to use, enjoy and they make repairs themselves and is
teaching his children to do the mechanical repairs.
Don Harmers, 4917 Easy concerned about Section 3-4: (c)"one (1)
boat, one (1) travel trailer and one (1) detached camper may be
stored in the side or rear yard" and also (h) "only one (1) motor
vehicle per household parked in public street adjoining the premises."
Mr. Hanners related that he owns more than one boat and that it
is necessary for them to park an additional car in front of his
property at times.
Mervin Smith, 316 Mingo, stated he would like to see a copy of
revised and proposed ordinance before adoption. Mayor said city
would give notice of meeting when ordinance will be considered
prior to adoption.
Mayor Cotant told all present he appreciated their presence and
comments.
Mayor Cotant closed the public hearing at 10:30 p.m.

GENERAL COMMENTS AND CONSIDERATIONS OF CITY:
1) Phase-out period for four or more dogs.
2) Attorney Winmill said council could make provisions for a
Production Dwelling in compliance with a pre-existing ordinance
such as a Class III Production Dwelling and presently a non-
conforming use, whereby owners could be allowed to replace dwelling
with another Production III dwelling, either with or without
a conditional use permit.
These and ~ther considerations will be given when ordinance is
drawn up for adoption.
CONTRACT WITH IDAHO DEPARTMENT OF HEALTH & WELFARE - Mayor Cotant
explained the new State of Idaho Community Work Experience Program
with the Idaho Department of Health and Welfare and administered
through the Idaho Department of Employment.
Councilwoman Hopkins moved to approve for Mayor Cotant to sign the
contract with the Idaho Department of Health and Welfare, on the
Community Work Experience Program. Councilman Nield seconded motion.
All councilmembers voted in favor of motion.
REAPPOINTMENT OF LAND USE COMMISSION MEMBERS FOR FOUR YEAR TERMS
Councilwoman Hopkins moved to approve reappointment of Richard Allen
and Janet Williams for four year terms starting June 1, 1982.
Councilman Nield seconded motion, with unanimous approval of council-
members.
CHUBBUCK DAYS - Mayor and Council agreed to set August 27 and 28 as
the dates for Chubbuck Days.
CLAIM APPROVAL - Councilman Kinghorn told Mayor and Council of the
opportunity to purchase a new light bar for the police department
at a good savings.
Councilman Nield moved to approve the purchase of an Areo-Dynamic
light bar with a Federal PA speaker, siren system by the Police
Department. Councilwoman Hopkins seconded motion. All council-
members voted in favor of motion.
Councilman Nield moved, Quick seconded, with full council approval
to adjourn meeting at 11:30 p.m.

CALL OF SPECIAL MEETING
CHUBBUCK CITY COUNCIL
Pursuant to Idaho Code Section 50-604 and 50-706, the
undersigned Mayor and members of the City Council of the City
of Chubbuck, Idaho, hereby call a special meeting of the City
Council to be held at the Chubbuck City Offices, 5160 Yellowstone
Avenue at the hour of 7:30 p.m., on this date, the 29th of June,
1982.
The object of the special meeting shall be to consider re-appoint
Land Use Commission members Richard Allen, Mike Metcalfe, and Janet
Williams for four year term, authorizing Mayor Cotant to sign contract
with Idaho Department ofx~k~alth & Welfare, on the Community work Experience

Pursuant to the call set forth above, notice is hereby given
of a special meeting of the Chubbuck City Council at the time and
place, and for the object, recited in the call.
