June 8, 1982
Minutes of the reqular council meetinq held in the city municipal
building, June 8, 1982.
Present: Mayor John O. Cotant, Jr. Councilmembers Becky A. Hopkins,
Dwain A. Kinghorn, Thomas S. Nield, LeRoy S. Quick, Attorney B.
Lynn Winmill, Public Works Director Steven M. Smart, and City
Clerk Vera C. Armstrong.
Meeting called to order at 7:30 p.m.
Mayor Cotant asked for corrections or additions to minutes of May ll
and May 18.
Councilwoman Hopkins reported an error on page 59, line 18, in
May 11 minutes, and asked that the word previous be changed to
the word subsequent.
Councilwoman Hopkins moved to approve council minutes of May ll
as written. Councilman Quick seconded motion. Vote was unanimous
in favor of moiton.
Councilman Kinghorn moved to approve minutes of May 18 as written.
Councilwoman Hopkins seconded motion. All councilmembers voted
in favor of motion.
PUBLIC HEARING - Proposed Revision of the City of Chubbuck's Land
Use Ordinance.
Mayor Cotant opened the hearing at 7:35 p.m. and asked for comments
concerning the Land Use Ordinance.
Sue Myers, 219 Hiway Avenue, questioned the regulations concerning
older antique cars. Mrs. Myers remarked she has five cars, one
is an antique she is restoring and she doesn't have the money
to build a garage to keep it in. (This provision is in another
ordinance of the city.)
John Harris, Jr., 5053 Elizabeth, asked if city was requiring
older cars be kept out of sight of the public. He was told yes,
the city does have an ordinance prohibiting junky and older cars
kept on property when they are not licensed, and if junky and
need repairs to be kept in a garage.
Frank Simmons, 814 Mark Drive, asked if city could provide a permit
to repair vehicles. Attorney Winmill informed those present that
there is a permit provision at present time in ordinance, can
be obtained for 30 days and person can obtain two permits per
year.
Mel Fairbanks, 309½ West Chubbuck Road, was present and told council
he hoped to be able to operate a recreational vehicle storage
area on his property. Mr. Fairbanks was told by Attorney Winmill
that the proposed ordinance will not all ow this type of operation.

After further discussion, Council considered the following:

Further discussion followed on (C) Section 3:4, Page 22. Mr. Simmons
objected to the provision that allows people to own only one travel
trailer, one boat and one detached camper and store in their side
or rear yard.
Attorney Winmill informed those present the ordinance will be
further considered in this matter.
Council and particularly Councilwoman Hopkins asked Mr. Simmons
to help them with ideas for control of junk cars. Mr. Simmons
said he would talk to his neighbors and be back on June 29 when
the hearing will be continued.
John Stoddard, 211 Hiway Avenue, asked about requirements on kennels
and dogs. Definition on page 2 was read and discussed. Council
agreed to the following changes:
Section 1-5: Definitions, page 2 (i)"Kennels" to strike word
animals and add in word dogs. Council also agreed to change wording
in definition to read four (4) or more dogs over four (4) months ......
Councilwoman Hopkins suggested council consider a phase-out period
on the ownership of four or more dogs.
Attorney Winmill asked Mrs. Stoddard if a three year phase-out
period would be something they could comply with. She said it
would be difficult to say.
Mr. Larsen, owner of a lot on Mingo Lane, asked if new ordinance
would allow him to rent his lot for placement of trailers. Attorney
Winmill said this question could be considered, but that at present
a conditional use permit would need be applied for and approved.
Mayor Cotant closed the public hearing and informed those present
a hearing would again be held on the proposed Land Use Ordinance
June 29.
GAS FURNACE AUTOMATIC FLUE DAMPER - J. O. Cotant, III, explained
the operation of the automatic flue damper which allows retention
of heat when damper automatically closes and explained a piece
of equipment called "Furnace Brain" which regulates the burning
settings for further savings on fuel use.
Mayor Cotant said city would need to budget such an item and that
the council should see the film to realize the value and saving
that could be had with this equipment.
Councilman Quick suggested Mr. Cotant submit a proposal on the
city's furnaces with the proposed costs of equipment and proposed
savings.

CHUBBUCK PRIDE COMMITTEE - Karen Jackson and Louise Willingham presented
a letter to council for approval. The letter is going to be sent
out to those residents that have clean-up needed on their lots.
Chief Stone asked that the committee correlate their letters with
his department so an ordinance enforcement the police department
are working on will not be duplicated.
The committee told council of the following plans:
1) Chubbuck Logo - Key with words Chubbuck City Pride.
2) Posters to be placed in places of business within city.
3) Bumper stickers with Chubbuck Logo.
4) Plans to make awards at Chubbuck Days Celebration.
5) Tree Planting Drive.
Mayor Cotant thanked Mrs. Jackson and Mrs. Willingham for their
work and plans and told them the city would support them.
FIREWORKS PERMITS - Two applications have been received by the city. 1) Jerry's 4-Wheeler, stand to be on vacant lot south of 5008
Yellowstone.
2) Lloyd F. Stubbs, stand to be at 4500 Yellowstone Avenue.
Councilman Kinghorn moved to approve the fireworks permit to Jerry's
4-Wheeler, to operate stand on vacant lot south of 5008 Yellowstone,
provided he submits copy of insurance showing that products liability
coverage has been added, and to approve the fireworks permit to
Lloyd F. Stubbs to operate a fireworks stand at 4500 Yellowstone
Avenue. Councilwoman Hopkins seconded motion. All councilmembers
voted in favor of motion.
DESIGN REVIEW - SIGN - Matkin Auto Part #2, 4805 Yellowstone Avenue,
has submitted a design review for three signs on their new business
store. The signs will be installled flush with building.
After reviewing, Councilman Quick moved to approve the design
review on the three signs as submitted for Matkin Auto Parts #2,
4805 Yellowstone. Councilman Nield seconded motion. All councilmembers
voted in favor of motion.
APPROVAL OF CLAIMS - After reviewing, Councilman Nield moved to approve
the computer print-out claims and the handcheck claims as presented.
Councilman Quick seconded motion. Vote was unanimous in favor
of motion.
RESOLUTION # 2-82 - Adopting the new edition of the Uniform Building
Code was read in full by Mayor Cotant.
Councilman Kinghorn moved to approve Resolution #2-82, adopting
the 1982 Edition of the Uniform Building Code. Councilman Nield
seconded motion. Roll call vote: Hopkins, yes; Kinghorn, yes;
Nield, yes; Quick, yes.
RESOLUTION #3 - 82 - adopting the new edition of the Uniform
Fire Code was read in full by Mayor Cotant.
Councilman Quick moved to adopt Resolution #3 -82, adopting the
1982 Edition of the Uniform Fire Code. Councilwoman Hopkins
seconded motion. Roll call vote: Hopkins, yes; Kinghorn, yes;
Nield, yes; Quick, yes.
RESOLUTION #4-82 - adopting the new edition of the Life Safety Code
was read in full by Mayor Cotant.
Councilwoman Hopkins moved to adopt Resolution $-82, adopting
the 1981 Edition of the Life Safety Code. Councilman Kinghorn
seconded motion. Roll call vote: Hopkins, yes; Kinghorn, yes;
Nield, yes; Quick, abstained.
At 11:50 p.m. Councilwoman Hopkins moved, Councilman Quick seconded,
with full council approval to adjourn meeting.
