COUNCIL MEETING MINUTES
September 8, 2009
Minutes of a regular council meeting held at the Chubbuck City Council Chambers,
September 8, 2009.
Present: Mayor Steven M. England, Council members Kent Kearns, Dennis Stoddard, Kermit G.
Morrison, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart, City
Treasurer Richard Morgan and City Clerk Ron C. Conlin. Council member Rebecca
Ponkow was excused.
Meeting was called to order at 7:31 p.m. by Mayor England.
PLEDGE ALLEGIANCE TO THE FLAG was led by Candon Sudweeks, Troop #330.

INVOCATION was given by Bishop Garth Hall, Chubbuck Stake 2 Ward, The Church of Jesus
Christ of Latter-Day Saints.
APPROVAL OF MINUTES - Mayor England asked for corrections or additions to the August
25, 2009 Council Meeting Minutes.
Council member Kearns moved to approve the regular council meeting minutes of August
25, 2009, subject to a couple typo corrections and a grammatical correction, Council
member Morrison seconded. Roll Call Vote: Kearns, yes; Stoddard, yes; Ponkow, absent;
Morrison, yes.
“DAUGHTERS OF THE AMERICAN REVOLUTION” PROCLAMATION - Mayor England
read the Daughters of the American Revolution Proclamation. Myrna Crapo, 15503 W.
Siphon Road was present to explain the proclamation.
Council member Stoddard moved to approve the “Daughters of the American Revolution”
Proclamation and authorized Mayor England to proclaim the week of September 17, 2009
through September 23, 2009 as, “Constitution Week”, Council member Kearns seconded.
Roll Call Vote: Morrison, yes, Stoddard, yes; Ponkow, absent; Kearns, yes.
“NATIONAL ALCOHOL AND DRUG ADDICTION RECOVERY MONTH”
PROCLAMATION - Mayor England read the National Alcohol Drug Addiction Recovery
Month Proclamation in full. Kevin Wakeman, Recovery Fest, 562 Euclid Ave, Pocatello,
Idaho was present to explain the proclamation.

Council member Stoddard moved to approve the National Alcohol and Drug Addiction
Recovery Month Proclamation and authorized Mayor England to proclaim the month of
September, 2009 as National Alcohol and Drug Addiction Recovery Month, Council
member Morrison seconded. Roll Call Vote: Kearns, yes; Stoddard, yes; Ponkow, absent;
Morrison, yes.
BURLEY DRIVE STORAGE FINAL SHORT PLAT - PWD Smart stated Staff recommends
approval of the Burley Drive Storage Final Plat provided the irrigation certificate is affixed
to the plat and final approval of construction drawings.
Council member Kearns moved to approve the Burley Drive Storage Final Short Plat
subject to; 1) Attachment of irrigation certificate to the plat, 2) Staff approval of all
construction drawings, Council member Stoddard seconded. Roll Call Vote: Kearns, yes;
Stoddard, yes Ponkow, absent; Morrison, yes.
REQUEST FROM RESIDENTS OF KAYS KOVE SUBDIVISION - Eldon Quinn, President of
Homeowners Association, 4840 Reed Street presented a slide presentation on the
following issues.
1. What is the plan for the ditch bank on Hiline Road to Chubbuck Road.
2. Eldon Quinn stated six residents in Kays Kove continue to have flooding problems
every time we have a storm of any size. The runoff from Hiline Road to their fence
line and into their yards and patios has been a real problem since they moved in.
On average they get 6-10 inches of water and one to three inches of mud runoff with
each storm.
Mr. Quinn stated the storm drains on Hiline do not remove the water fast enough to
prevent runoff from entering their yards. The development’s building contractor used
large rocks as a retaining wall. The dirt around the rocks has been for the most part
washed away on to their property. One resident has had his basement flooded three
different times.
Mr. Quinn stated another request they have is the City construct a sidewalk on Hiline
Road from Chubbuck Road to the entrance of the Mormon Church parking lot. A number
of people from the trailer court and Kays Kove walk to church along Hiline on the road,
because the west side of the road is unsafe to walk on. Mr. Quinn also asked what is up
with the sidewalk to nowhere on the east side of Hiline Road.

REQUEST FROM KAYS KOVE RESIDENTS - (cont.)
Mayor England stated Staff discussed most of the items on the request at Staff Meeting
today, and recognize there are some corrections that need to be made before winter.
PWD Smart made comments on solutions to the concerns.
AMENDED RESOLUTION #6-2009 - to pay estimated expenses of said City.
City Treasurer Morgan explained the amended Resolution #6-2009.
Council member Kearns moved to adopt amended Resolution #6-2009 as explained,
Council member Morrison seconded. Roll Call Vote: Morrison, yes; Ponkow, absent;
Stoddard, yes; Kearns, yes.
RESOLUTION #7-2009 - Updates the Comprehensive Plan. The Comprehensive Plan adopted,
January 9, 2002 and November 9, 2004 is reaffirmed as the Comprehensive Plan of the
City of Chubbuck with the following changes. The Urban Service Boundary is extended to
include the property described on the attached Exhibit “A”, (attached).
PWD Smart gave a explanation of Resolution #7-2009.
Council member Stoddard moved to adopt Resolution #7-2009 as read, Council member
Morrison seconded. Roll Call Vote: Kearns, yes; Stoddard, yes; Ponkow, absent;
Morrison, yes.
RESOLUTION #8-2009 - Revising the boundaries for nine precincts, providing that the Bannock
County Courthouse Annex shall be the polling place for absentee balloting.
Mayor England read Resolution #8-2009 in full.
Council member Kearns moved to adopt Resolution #8-2009 as presented, Council
member Stoddard seconded. Roll Call Vote: Morrison, yes; Ponkow, absent; Stoddard,
yes; Kearns, yes.
CLAIMS - Computer print-out claims presented to Mayor England and Council.
Council member Kearns moved to approve computer print-out claims as presented,
Council member Stoddard seconded. Roll Call Vote: Kearns, yes; Stoddard, yes; Ponkow,
absent; Morrison, yes.

1. SECOND COUNCIL MEETING IN SEPTEMBER, 2009 WILL BE HELD ON
SEPTEMBER 29, 2009 INSTEAD OF SEPTEMBER 22, 2009.
At 8:10 p.m, Council member Stoddard moved, Council member Morrison seconded, with full
council approval to adjourn meeting.
