COUNCIL MEETING MINUTES
November 10, 2009
Minutes of a regular council meeting held at the Chubbuck City Council Chambers, November 10,
2009.
Present: Mayor Steven M. England, Council members Kent Kearns, Dennis Stoddard, Kermit G.
Morrison, Rebecca Ponkow, Attorney Thomas J. Holmes, Public Works Director Steven
M. Smart and City Treasurer Rich Morgan. City Clerk Ron C. Conlin was excused.
Meeting was called to order at 7:30 p.m. by Mayor England.
PLEDGE ALLEGIANCE TO THE FLAG was led by Bryan Grigg.

INVOCATION was given by Bishop Earl Phippen, Chubbuck 3 Ward, The Church of Jesus
Christ of Latter-Day Saints.
APPROVAL OF MINUTES - Mayor England asked for corrections or additions to the regular
meeting minutes of October 27, 2009.
Council member Kearns moved to approve the October 27, 2009 Council Meeting
Minutes with corrections discussed, Council member Morrison seconded. Roll Call Vote:
Morrison, yes; Ponkow, yes; Stoddard, yes; Kearns, yes.
PUBLIC HEARING - An application by The Church of Jesus Christ of Latter-Day Saints/Darris
Ellis, c/o RMES, 2043 E. Center, Pocatello, Idaho 83201 for annexation into the City and
Land Use designation change from Bannock County Agricultural to City of Chubbuck,
Single Family Residential, (R-1) for property located north of Homestead Estates
Subdivisions. The Land Use and Development Commission recommended approval of
the application. City Council reviewed City Staff Report.
Mitch Greer, Rocky Mountain Engineering & Surveying presented the annexation and
Land Use designation change from Bannock County Agricultural to City of Chubbuck
Single Family Residential, (R-1) for property located north of Homestead Estates
Subdivisions.
Mayor England declared the public hearing open, asking for comments in favor of, neutral
and opposed, there being no comment, Mayor England declared the public hearing closed.

Council member Stoddard moved to approve the application by The Church of Jesus
Christ of Latter-Day Saints/Darris Ellis for annexation into the City and a Land Use
designation change from Bannock County Agricultural to City of Chubbuck Single Family
Residential, (R-1) for property north of Homestead Estates Subdivisions, Council member
Morrison seconded. Roll Call Vote: Kearns, yes; Stoddard, yes; Ponkow, yes; Morrison,
yes.
ORDINANCE #679 - Annexing certain lands to be included within the boundaries and
jurisdictional limits of the City of Chubbuck, Idaho; specifying the zoning classification
which shall be applied to said lands newly annexed to the City of Chubbuck.
LDS Church - North of Homestead Estates Subdivision.
Mayor England read Ordinance #679 by title only for the first and final reading.
Council member Stoddard moved to dispense the rule of reading Ordinance #679 on three
separate days, one of which shall be in full, Council member Kearns seconded. Roll Call
Vote: Ponkow, yes; Stoddard, yes; Kearns, yes; Morrison, yes.
Council member Stoddard moved to adopt Ordinance #679 as read, Council member
Morrison seconded. Roll Call Vote: Kearns, yes; Stoddard, yes; Ponkow, yes; Morrison,
yes.
ORDINANCE - Amending Chapter 5.05 Pawnbrokers and Pawnshops to include secondhand
precious metals dealers and secondhand stores.
Attorney Holmes read ordinance by title only for the first reading.
Council members Ponkow and Kearns expressed concerns about the proposed ordinance.
Attorney Holmes stated this proposed ordinance comes to the Council at request of Police
Department, these concerns will be discussed with Police Chief Randy Severe be on
Council Agenda, November 24, 2009.

ORDINANCE - Amending certain Sections of Chapter 15.54, flood damage prevention to update
the provisions of the Chapter with recommendations from the Federal Emergency
Management Agency.
PWD Smart stated FEMA recommended these modifications to our flood damage
prevention ordinance. PWD Smart recommended the Council adopt the proposed
ordinance.
Attorney Holmes read the ordinance by title only for the first reading.
Council tabled the proposed ordinance until the November 24, 2009 Council Meeting.
RESOLUTION #10-2009 - The Chubbuck Impact Area Wastewater Collection Authority has
recommended increasing the connection fee to $5,490.
PWD Smart stated the Joint Powers Authority has recommended the Sewer Connection
Fee be increased to $5,490 from $5,227 after recommendation from the Joint Powers
Authority Consulting Engineer.
Council member Ponkow asked what caused the increase. PWD Smart stated in the
original plans there was not a line that went down Siphon Road and through Chubbuck
over to Hiline Road, it went down a corridor that was about half mile north of Siphon
Road, all the land it serves is different now. This is what necessitated the increase.
Council member Ponkow asked if developers were notified. PWD Smart stated the Home
Builders Association comes to the Joint Powers Authority Board meetings every month.
Council member Ponkow expressed concern about the rising fees.
Council member Kearns moved to adopt Resolution #10-2009 as read, Council member
Stoddard seconded. Roll Call Vote: Kearns, yes; Stoddard, yes; Ponkow, no; Morrison,
yes. Motion passes 3-1.
CLAIMS - Computer print-out claims presented to Mayor England and Council.
Council member Kearns moved to approve the computer print-out claims as presented,
Council member Ponkow seconded. Roll Call Vote: Morrison, yes; Ponkow, yes;
Stoddard, yes; Kearns, yes.

GENERAL DISCUSSION -
Darris Ellis, 4470 Wasatch asked if City has signed a contract to build the NW Sewer
Line Interceptor. Mayor England stated we have not, the bid opening is December 1,
2009. PWD Smart stated we could be under contract approx a month after December 1,
2009. Mr. Ellis expressed concern about sewer rates increasing to city residents if there
is no building in the City.
ANNOUNCEMENT - Mayor England invited all to a Flag Raising Ceremony at Chubbuck City
Hall, November 11, 2009 at 9:00 a.m.
At 8:20 p.m, Council member Stoddard moved, Council member Morrison seconded, with full
council approval.
