Present: Mayor Steven M. England, Council members Kent Kearns, Dennis Stoddard, Kermit G. Morrison, Rebecca Ponkow, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting called to order at 7:30 p.m. by Mayor England. PLEDGE ALLEGIANCE OF THE FLAG was led by Logan Swenson, Troop #338. st INVOCATION was given by Bishop Mark Neider, Whitaker 1 Ward, The Church of Jesus Christ of Latter-Day Saints. APPROVAL OF MINUTES - Mayor England asked for corrections and addition to the regular meeting minutes of January 27, 2009. Council member Kearns moved to approve the regular meeting January 27, 2009 as read, Council member Stoddard seconded. Roll Call Vote: Kearns, yes; Stoddard, yes; Ponkow, yes; Morrison, yes. CITY OF CHUBBUCK WATER FACILITIES UPDATE AND EVALUATION - Mike R. Jaglowski, Keller Associates presented the City of Chubbuck Water Facilities Update and Evaluation, (attached). Mr. Jaglowski and PWD Smart answered questions the Council had. WATER RIGHTS AVAILABLE FOR PURCHASE - Mr. Jaglowski stated DEQ recommends a 20 year planning horizon and suggests the City try to have water rights that fit within the 20 year planning process. Dale Tillis, 1135 Valley Road South, Eden, Idaho Water Rights Broker stated he buys and sells water rights. Mr. Tillis stated a City can move water rights around to a permissible use. Mr. Tillis stated the rights for seale are very good rights. They are 1952. PWD Smart stated he had written the Council a memo last Council Meeting advising them of the water rights for sale. PWD Smart recommended the Council consider purchasing the additional water rights to supplement our existing water rights. Council tabled the Water Rights Available for Purchase discussion until the February 10, 2009 Council Meeting. 13 COUNCIL MEETING MINUTES - (cont.) January 27, 2009 ORDINANCE #663 - Amending Chubbuck Municipal Code Section 5.08.080 to conform it to the State Law change in 2008 that allows liquor by the drink to be served on the days of a General or Primary Election. Attorney Holmes read Ordinance #663 in full for the third and final reading. Council member Stoddard moved to adopt Ordinance #663 as read, Council member Kearns seconded. Roll Call Vote: Kearns, yes; Stoddard, yes; Ponkow, yes; Morrison, yes. ORDINANCE - Enacting a new Chapter 8.44, “construction site sediment and erosion control”, establishing regulations to control non-storm water discharges to the City’s Storm Drainage System; establishing methods to control and restrict the introduction of pollutants into the municipal storm sewer system; providing regulations in order to comply with requirements of the City’s National Pollutant Discharge Elimination System Permit; providing definitions; providing for erosion control permits and control plans; providing for erosion and sediment controls standards. Attorney Holmes read ordinance by title only for the second reading. Council tabled the ordinance until the February 10, 2009 Council Meeting. ORDINANCE - Enacting a New Chapter 8.48, “Illicit Discharge and Storm Water Connection Ordinance”, establishing regulations to control non-storm water discharges to the City’s Storm Drainage System establishing methods to control and restrict the introduction of pollutants into the Municipal Storm Sewer System; providing regulations in order to comply with requirements of the City’s National Pollutant Discharge Elimination System, (NPDES) Permit; providing definitions; prohibiting illicit connections and discharges to the Municipal Storm Sewer System; providing authority to conduct inspections, surveillance and monitoring for compliance with permit requirements. Attorney Holmes read ordinance by title only for the second reading. Council tabled the ordinance until the February 10, 2009 Council Meeting. ORDINANCE - Adopting Section 9.08.144 and 9.08.145 to provide for regulations to control the deposition of dust, dirt and other materials from non-public to public right-a-way within the City Limits, into the Storm Sewer System, and into the air shed in compliance with the requirements of the City’s National Pollutant Discharge Elimination System Permit; providing for regulations of loads of material being transported from place to place within the City Limits of the City of Chubbuck; providing for the control of the COUNCIL MEETING MINUTES - (cont.) January 27, 2009 ORDINANCE - (cont.) 15 introduction of pollutants into the Municipal separate Storm Sewer System or into the air shed from uncovered loads of material including but not limited to sand, dirt, fill material, landscaping material and landscaping debris in compliance with the requirements of the City's National Pollutant Discharge Elimination System Permit. Attorney Holmes read ordinance by title only for the second reading. Council tabled the ordinance until the February 10, 2009 Council Meeting. CLAIMS - Computer print -out claims presented to Mayor England and Council. Council member Morrison moved to approve the computer print -out claims as read, Council member Ponkow seconded. Roll Call Vote: Kearns, yes; Stoddard, yes; Ponkow, yes; Morrison, yes. GENERAL DISCUSSION - 1. Rich Marley, 5150 Stuart Street expressed concern about vehicles being allowed to stay on the street during snow removal. Rich Marley also complained about Stuart Street being icy. Rich Marley complained about receiving a letter from the Post Office about snow being pushed in front of his mailbox. 2. Boyd Bird, 5036 Kevin expressed concern about receiving a letter from the Post Office stating they will not deliver mail unless the snow is cleared away from around their mailbox, Mr. Bird also complained about his neighbors not moving their vehicles from in front of their house. Mr. Bird stated he hopes the City does not use the Judicial Confirmation process if we purchase the water rights talked about earlier. Mr. Bird suggested there be an election. At 9:15 p.m, Council member Stoddard moved, Council member Morrison seconded, with full council approval to adjourn meeting. Ron C. Conlin, City Clerk
