COUNCIL MEETING MINUTES
March 10, 2009
Minutes of a regular council meeting held at the Chubbuck City Council Chambers, March 10,
2009.
Present: Mayor Steven M. England, Council members Kent Kearns, Dennis Stoddard, Kermit
Morrison, Rebecca Ponkow, Attorney Thomas J. Holmes, Public Works Director Steven
M. Smart, City Treasurer Richard Morgan and City Clerk Ron C. Conlin.
Meeting was called to order at 7:30 p.m. by Mayor England.
PLEDGE ALLEGIANCE TO THE FLAG was led by Matthew Murphy, Troop #332.
INVOCATION was given by President William Pincock, North Pocatello Stake, The Church of
Jesus Christ of Latter-Day Saints.
APPROVAL OF MINUTES - Mayor England asked for corrections and additions to the regular
meeting minutes of February 24, 2009.
Council member Kearns moved to approve the February 24, 2009 Council Meeting
Minutes as read, Council member Morrison seconded. Roll Call Vote: Kearns, yes;
Stoddard, abstained; Ponkow, yes; Morrison, yes.
ALCOHOL CATERING PERMIT APPLICATION - Elaine Prokschi, Hooligans Bar, said they
are applying for an alcohol catering permit to sponsor a fund raising event for the Building
and Contractor’s Association at 240 Laurel Lane.
Police Chief Randy Severe recommended the Council approve the alcohol catering permit
application.
Council member Stoddard moved to grant Hooligans Bar an alcohol catering permit to
sponsor a fund raiser, March 12, 2009 from 4:00 p.m. to 11:00 p.m. at 240 Laurel Lane
for the Building and Contractor’s Association, Council member Kearns seconded. Roll
Call Vote: Morrison, yes; Ponkow, yes; Stoddard, yes; Kearns, yes.
FINAL PLAT - AFTON MEADOWS EAST - Cole Bebee, Dioptra, 4922 Yellowstone Ave,
Suite J presented the Afton Meadows East Final Plat. PWD Smart stated this is a short
plat.
Council member Morrison moved to approve the Afton Meadows East Final Plat as
presented, Council member Stoddard seconded. Roll Call Vote: Kearns, yes; Stoddard,
yes; Ponkow, yes; Morrison, yes.

ORDINANCE #667 - Correcting the legal description of certain property re-zoned by Ordinance
#450 to decrease the property re-zoned thereby to the property owned by the applicant
therein, amending the change of Land Use District with respect to certain lands within the
boundaries of the City of Chubbuck from Limited Residential, (R-2) to Industrial, (I).
Attorney Holmes read Ordinance #667 by title only for the first and final reading.
Council member Kearns moved to dispense with the rule of requiring Ordinance #667 be
read on three separate days, one which shall be a reading in full, Council member Ponkow
seconded. Roll Call Vote: Kearns, yes; Stoddard, yes; Ponkow, yes; Morrison, yes.
Council member Morrison moved to adopt Ordinance #667 as read, Council member
Ponkow seconded. Roll Call Vote: Morrison, yes; Ponkow, yes; Stoddard, yes; Kearns,
yes.
ORDINANCE #668 - Making technical corrections to Ordinance #659 which enacted a new
Chapter 13.20 providing for pretreatment regulations.
Attorney Holmes read Ordinance #668 read by title only for the first and final reading.
Council member Stoddard moved to dispense with the rule of requiring Ordinance #668
be read on three separate days, one which shall be a reading in full, Council members
Ponkow seconded. Roll Call Vote: Kearns, yes; Stoddard, yes; Ponkow, yes; Morrison,
yes.
Council member Kearns moved to adopt Ordinance #668 as read, Council member
Morrison seconded. Roll Call Vote: Morrison, yes; Ponkow, yes; Stoddard, yes; Kearns,
yes.
POSSIBLE PURCHASE OF WATER RIGHTS FOR FUTURE GROWTH - Discussion about
the possibility of the City purchasing water rights for future growth. Discussion about how
to fund the purchase.
CLAIMS - Computer print-out claims presented to Mayor England and Council.
Council member Kearns moved to approve computer print-out claims as presented,
Council member Stoddard seconded. Roll Call Vote: Kearns, yes; Stoddard, yes; Ponkow,
yes; Morrison, yes.

GENERAL DISCUSSION -
1. Council member Kearns stated he will not be in attendance at the March 24, 2009
Council Meeting.
At 7:47 p.m, Council member Morrison moved, Council member Stoddard seconded with full
council approval to adjourn meeting.
