COUNCIL MEETING MINUTES
November 26, 1985
Minutes of regular council meeting held in the city municipal building,
November 26, 1985.
Present: Mayor John O. Cotant~ Jr., Councilmembers Becky A. Hopkins, Leroy S.
Quick, Thomas S. Nield, Steven M. England, Attorney B. Lynn Winmill, Engineer
Steven M. Smart and City Clerk Ron C. Conlin.
Meeting was called to order at 7:35 p.m. by Mayor Cotant.
INVOCATION was given by Bishop Roger C. Jones, 39th Ward, Church of Jesus Christ
of Latterday Saints.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the
minutes of November 12 and Special Meeting Minutes of November 19, 1985.
Councilman England moved to approve the minutes of November 12, 1985 as read.
Councilman Quick seconded. All councilmembers present at the November 12 meeting
voted in favor of motion.
Councilman Nield moved to approve the minutes of a special meeting held on
November 19, 1985 as read. Councilwoman Hopkins seconded. All councilmembers
voted in favor of the motion.
PETITION - HEIGHTS SUBDIVISION - A petition has been presented to the City stating;
The undersigned homeowners located in the Heights Subdivision of the City of
Chubbuck request a change in the zoning from R-2 to R-l. The existing multiple
household dwellings are not well-maintained, and tend to downdgrade the appearance
of our area.
Leah Potter, 750 Natalie was present and gave an explanation of the petition.
Mrs. :Potter stated there has been a Home Owners Association formed in the area
and they have hired an attorney, the attorney has assured the Home Owners
Association the restrictive convenants would protect the area from too many
duplexes, 3-plexes, 4-plexes and apartment complexes being built.
Mayor Cotant stated the council is consi~ering~anordinance amending Ordinance
#241 establishing additional residential land use districts and including density
restrictions for duplexes, 3-plexes, 4-plexes and apartment complexes and this
should help the problem.
CATERING PERMIT - Application has been made by Garfield's Bar for a liquor catering
permit to cater a Gem State Credit Union event on December 7, 1985, 6:30 p.m.
to 12:00 p.m. at the E1 Cielito.
Councilman Quick moved to approve the liquor catering permit application of
Garfield's Bar to cater the Gem State Credit Union event on December 7, 1985,
from 6:30 p.m. to 12:00 p.m. Councilman England seconded. All councilmembers
voted in favor of the motion.
CATERING PERMIT - Application has been made by The Pressbox for a liquor catering
permit to cater a Custom Topper event on December 14, 1985, 5:00 p.m. to
1:00 a.m. at the E1Cielito.
Councilman England moved to approve the liquor catering permit application of

The Pressbox to cater the Custom Topper event on December 14, 1985, from
5:00 p.m. to 1:00 a.m. at the E1 Cielito. All councilmembers voted in favor
of the motion.
HANDCHECK CLAIMS - Handcheck claims were presented to Mayor Cotant and Council.
After discussion Councilwoman Hopkins moved to approve the handcheck claims
as read. Councilman Quick seconded. All councilmembers voted in favor of
motion.
ORDINANCE - An ordinance adopting the 1985 Edition of the Uniform Mechanical
code published by the International Conference of Building Officials and
International Association of Plumbing and Mechanical Officials.
Mayor Cotant read the ordinance by title only for the first reading.
ORDINANCE - An ordinance providing for a temporary and short-term change in the
occupancy classifications of certain structures withim the!ciSy,~upon the
owner's showing that alternative steps have been taken to minimize any hazard
to the public; requiring the issuance of a conditional occupancy permit
by the City Council and the Mayor, establishing the maximum occupancy allowed
pursuant to this ordinance.
Attorney Winmill stated the ordinance is intended to allow the cityt~l~'~b]e to
allow more of an occupancy load in certain stuctures where the landowner has
taken steps which would minimize the potential for a fire risk.
Attorney Winmill stated he would complete the ordinance and have it ready for
the December lOth, 1985 Council Meeting.
At 9:10 p.m., Councilman Quick made motion pursuant to Idaho Code 67=2345 (a) the
Council go into executive session for the purpose of considering personnal
matters. Councilman England seconded. 100% of Councilmembers voted in favor of'
motion.
PQrpose of Exectutive Session Meeting is consideration of hiring a police officer.

Thomas S. Nield, Steven M. England, Attorney B. Lynn Winmill, City Clerk Ron C.
Conlin and Chief of Police Arnold Stone.
No action or final descision was made.
At 10:05 p.m., Councilman Quick moved to adjourn from the executive session
meeting to the regular council meeting. Councilman Nield seconded. All council-
members voted in favor of motion.
Following discussion Councilman Quick made motion to hire Mr. Brent L. Lusk
as a police officer. Councilwoman Hopkins seconded. All councilmembers voted
in favor of motion.
GENERAL DISCUSSION -
1) After discussion it was decided to step-up enforcement of Ordinance #255

regulating parking of vehicles Within the City on the resident's sanitation
day.
2) Mayor Cotant asked City Clerk Ron Conlin to make copies of the Fire Department
Procedures and deliver to the Councilmembers.
At 10:15 p.m., Councilwoman Hopkins moved, Councilman Quick seconded, with full
council approval to adjourn meeting.
