HomeMy WebLinkAbout10 08 2002 CM193 COUNCIL MEETING MINUTES October 8 ', 2002 Minutes of a regular meeting held at the Chubbuck City Council Chambers, October 8`h, 2002. Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 7:30 p.m. by Mayor Cotant. PLEDGE OF ALLEGIANCE TO THE FLAG was lead by Kevin Bingley. APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the Regular Meeting Minutes of September 24`h, 2002. Councilman Kearns moved to approve the Regular Meeting Minutes of September 24`h, 2002 with the following corrections: 1) Identify as Council Meeting Minutes rather than Council Meeting Agenda. 2) Motion adjourning the regular meeting should have read, Councilman Kearns moved to adjourn from regular meeting, Councilman England seconded. Councilman England seconded. All council members voted in favor of motion. PUBLIC HEARING - An application by Rodney Burch, 375 Lisa, Chubbuck, Idaho 83202 for a change of Land Use District to General Residential, (R -3). Property is zoned Agricultural, (A). Property is located at 485 W. Chubbuck Road. Land Use & Development Commission recommended the Council approve the application. Mayor Cotant declared the public hearing open. Rodney Burch, 375 Lisa stated he purchased the property at 485 W. Chubbuck Road and is asking for a change of zoning to R -3 with the intent of building multi - family housing, (four - plexes) on a portion of the property. Mr. Burch stated he has been approached to consider that some time in the future there might be professional offices on the southeast corner of W. Chubbuck and Hawthorne Roads. Mayor Cotant asked for comments from the public. Richard Marley, 5150 Stuart asked if trees on the property are going to be removed. Mr. Burch stated the trees run in a north -south direction that cuts the parcel in half, east and west. Mr. Burch stated he plans on leaving the trees as they are. 195 COUNCIL MEETING MINUTES - (cont.) October 8th, 2002 PUBLIC HEARING - RODNEY BURCH - 485 W. CHUBBUCK ROAD - (cont.) Mayor Cotant declared the public hearing closed. Councilman England moved to approve the application by Rodney Burch, 375 Lisa for a change of Land Use District to General Residential, (R -3) for property at 485 W. Chubbuck Road. Councilman Kearns seconded. All council members voted in favor of motion. SCHOOL DISTRICT #25 - BART REED EXPRESSED WHITAKER ROAD SAFETY CONCERNS - Bart Reed, School District #25 discussed a letter Mayor Cotant and Council were given from Linda Powell, School District #25 Superintendent expressing concern about inadequate curb, gutter and sidewalk areas, specifically Whitaker Road as it fronts Ellis Elementary School due to increased traffic and housing development. Ellis Elementary School has approximately 550 students, plus patron and teachers. Mr. Reed said the School District requested the City of Chubbuck encourage the land developer of the Victorian Village Subdivision to complete the sidewalk, curb and gutter on the west side of Whitaker Road. As of the date of this letter, this project has not been completed even a full year since the request and the City's effort to motivate the developer. The District recently completed a new section of sidewalk, curb and gutter on the east side of Whitaker voluntarily in an effort to improve the safety of those students and patrons traveling northward. Of major concern are the hundreds of school age children who continue to have to walk through overgrown weeds, dirt, mud and drifted snow traveling to and from school. Many times, students ride bicycles and walk on Whitaker Road, creating a dangerous situation because of the inadequate infrastructure. Mr. Reed said the District asked Mayor Cotant and Council to again seriously address the curb, gutter and sidewalk improvements in this area. Jan Harwood, Lead Teacher at Ellis Elementary presented photos that showed safety concerns adjacent to Victorian Village Subdivision on Whitaker Road. Dee Ann Hegsted, Ellis PTA President voiced PTA concerns about these safety issues. PWD Smart stated the developer said sometime next week he will probably be preparing curb, gutter and sidewalk construction along the entire Victorian Village Whitaker Road frontage, by the end of the month the construction of the curb, gutter and sidewalk will be completed.. Mr. Reed stated that will be fine, the sooner it can be completed the better. 197 COUNCIL MEETING MINUTES - (cont.) October 8h, 2002 SCHOOL DISTRICT #25 - BART REED - SAFETY CONCERNS ON WHITAKER ROAD - (cont.) Mr. Reed asked if the developer will be required to keep the sidewalk clear so the students and patrons can travel safety after it is developed. Mayor Cotant stated the City will keep the sidewalk cleared of snow, etc. Mr. Reed stated the School District last year requested two walkways from Cambridge Estates to the south of Ellis School, one on the easterly end and one between the parent turn around area and the faculty parking. Mr. Reed said the School District was discouraged to hear the Council only required one walkway from Cambridge. Mr. Reed suggested the cities and the School District communicate with one another even more than we do. Mr. Reed asked if there is anyway the City can require the two walkways rather than the one, or is it too late. Darris Ellis, Ellis Construction asked what guarantee does the School District have that the curb, gutter and sidewalk requirement will be completed this year, they have been promising to have it finished, but have not completed. Mayor Cotant said the curb, gutter and sidewalk requirement will be completed as PWD Smart explained. PARK MEADOWS 1ST ADDITION FINAL PLAT - Darris Ellis, Ellis Construction presented the Park Meadows 1". Addition Final Plat. Councilman Kearns moved to approve Park Meadows Is'. Addition Final Plat as presented, Councilman Gunter seconded. All council members voted in favor of motion. ORDINANCE #564 - Amending Section 6.04.030 to change the definition of a daycare provider to anyone providing day care to one or more children. Attorney Holmes read Ordinance #564 in full for the third and final reading. Councilman Quick moved to adopt Ordinance #564 as read, Councilman Kearns seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes. 199 COUNCIL MEETING MINUTES - (cont.) October 8`'', 2002 ORDINANCE #565 - Annexing certain lands to be included within the boundaries and jurisdictional limits of the City of Chubbuck, Idaho; specifying the zoning classification which shall be applied to said lands newly annexed to the City of Chubbuck. Pheasant Ridge on Hiline Road. Attorney Holmes read Ordinance #565 in full for the first and final reading. Councilman England moved to dispense with the rule of reading Ordinance #565 on three separate days, Councilman Kearns seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes. Councilman Gunter moved to adopt Ordinance #565 as read, Councilman Quick seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes. ORDINANCE #566 - Adopting Section 9.04.020 definitions to provide that in all provisions of the Chubbuck Municipal Code, including all provisions of Title 9 relating to the General Criminal Code, title 6 relating to daycare, and title 8 relating to health and safety, where "Chief's Designee" is used to indicate a designee of the Chief of Police, in all instances that "designee" shall be a member of or employee of the City of Chubbuck in General. Mayor Cotant read Ordinance #566 in full for the first and final reading. Councilman Quick moved to dispense with the rule of reading Ordinance #566 on three separate days, Councilman England seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes. Councilman Quick moved to adopt Ordinance #566 as read, Councilman Kearns seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes. DESTRUCTION OF SCANNED POLICE DEPARTMENT DOCUMENTS - Police Department presented a list of scanned Police Department documents to be destroyed, (attached). Councilman Quick moved to approve destruction of scanned Police Department documents, Councilman Gunter seconded. All council members voted in favor of motion. CLAIMS - Computer print -out claims presented to Mayor Cotant and Council. Councilman Gunter moved to approve computer print -out claims as presented, Councilman Kearns seconded.
