Cotant, Jr., Councilmembers Becky A. Hopkins, Leroy S. Quick, Steven M. England, Attorney B. Lynn Winmill, Engineer Steven M. Smart and City Clerk Ron C. Conlin. Councilman Thomas S. Nield was excused. Meeting called to order at 7:40 p.m. by Mayor Cotant. INVOCATION was given by Bishop Gordon L. Wilkes, 25th Ward, Church of Jesus Christ of Latter Day Saints. APPOVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the minutes of Special Meeting of June 4 and special meeting of June 18, 1985. Councilman England moved to approve the minutes of a special meetinq held June 4, 1985 as written. Councilwoman Hopkins seconded. All councilmembers present voted in favor of the motion. Councilman England moved to approve the minutes of a special meeting held on June 18, i985 as written. Councilman Quick seconded. All councilmembers present at the June 18, 1985 special council meeting voted in favor of the motion. PUBLIC HEARING - Proposal by Price Development Co., 35 Century Parkway, Salt Lake City, Utah, for a change of zoning from Agricultural (A) to General Commercial (C-2) on a tract of land lying in Bannock County, Idaho, in the NW N of the SW ~ of Section 10, Township 6 South, Range 34 East of the Boise Meridian. Property located immediately south of I 86 and east of Hawthorne Road and west of the Pine Ridge Mall, Chubbuck, Idaho. Mayor Cotant declared the public hearing open. Mayor Cotant asked Michael C. Brown, Price Development, Salt Lake City, Utah if he had any comments. Mr. Brown proposed that the description of land above be zoned General Commerical (C-2) instead of Agricultural (A). Mayor Cotant asked for opposition to the zone change. There was no opposition. Mayor Cotant closed the public hearing. Councilman Quick moved to approve the request of rezone from Agricultural (A) to General Commercial (C-2) on a tract of land lying in Bannock County, Idaho, in the NW ¼ of the SW ~ of Section 10, Township 6 South, Range 34 East of the BM. Property located immediately south of 1-86 and east of Hawthorne Road and west of the Pine Ridge Mall, Chubbuck, Idaho. Councilman England seconded. Roll Call Vote: Hopkins, yes; Quick, yes; England, yes; Nield, absent. PRELIMINARY PLAT - Review of preliminary plat of Pine Ridge Mall 1st. Addition, to be developed by Price Development Co., located in the SW ~ of Section 10 Township 6 South, Range 34 East. Mayor Cotant declared the public hearing open. 85 PRELIMINARY PLAT - Pine Ridge Mall 1st. Addition (Cont.) Mayor Cotant and Council discussed the traffic problem at the Pine Ridge Mall. Mr. Brown stated that Price Development had a traffic study done as suggested by Engineer Smart. Mr. Brown stated the traffic study did not warrant another entry into the Pine Ridge Mall and that the Quinn Road entry did not require a traffic signal at this time. Mr. Brown said that when the Pine Ridge Mall was buil~ the Quinn Road entrance was not planned as a ma in entry to the mall. Mr. Brown stated the traffic study showed that 49% of the Pine Ridge Mall traffic went on the Quinn Road entry and 51% entered on the other two entries. Councilwoman Hopkins stated that the Quinn Road entry would have to be improved or there would have to be a street installed from Shopco Store to Hawthorne Road. Engineer Smart passed to Mayor Cotant and Council a traffic study of the Hawthorne Road and Quinn Road approach and departure patterns. Gary Radtke, Site Development Manager for Shopco Stores, Green Bay, Wisconsin was present and gave a presentation of the plans for the proposed Shopco Store. Mr. Radtke stated that construction of the proposed Shopco Store will start at the end of September, 1985. Mr. Radtke said that his company would like to have Price Development Co. bid out, design the road going to Hawthorne Road. Mr. Radtke said that when the bids come in and if the~bids are within Shopco's budget, Shopco would proceed with the road and if thebids are not within Shopco's budget, then Price' Development would be asked to help with the road or Shopco would'look at improving the Quinn Road approach. Councilman Quick moved to approve the preliminary plat of Pine Ridge Mall 1st Addition subject to the applicant constructing a roadway access, minimum 30' width, to Hawthorne Road, which the access would not be dedicated to the City of Chubbuck, but would be maintained as a private drive, also the developer make arrangements satisfactory to the Council and to the City Public !4orks Director for access on to Hawthorne Road including if neccessary a right turn lane for north bound traffic on Hawthorne Road and a left turn lane for the south bound traffic on Hawthorne Road and if the final plat is requested prior to the resolution to those issues, that the developer agree in writing to satisfy the requirements of the City and be required to post a bond to insure the re- quirements are met. Councilwoman Hopkins seconded. Roll Call Vote: Hopkins, yes; Quick, yes; England, yes; Nield, absent. PRELIMINARY PLAT - Review of preliminary plat of the Buffalo Park Subdivision, to be developed by S.K.S. Development, a subdivision located on the west side of Whitaker Road and south of Siphon Road, Chubbuck, Idaho. Mayor Cotant declared the public hearing opened. Mr. Ken Statterfield, S.K.S. Development was present and stated that S.K.S. Development is prepared to proceed with the preliminary plat stage. Discussion about where S.K.S. Development proposed to put the sidewalks in the subdivision. 87 PRELIMINARY PLAT - Buffalo Park Subdivision - (cont.) Mr. Satterfield asked if the City would require a road to be installed to Hiway Ave. Mayor Cotant stated the road should be installed sometime. Mr. Satterfield said he would prefer the City approach the railroad in regards to crossing the railroad tracks with the proposed road. It was decided the City would work with the railroad and would contact S.K.S. Development when it was worked out. Mayor Cotant closed the public hearing. Councilwoman Hopkins moved to approve the preliminary plat for the Buffalo Park Subdivision, to be developed by S.K.S. Development with the stipulation that there be sidewalks on all existinq streets throughout the subdivision; that parking area be provided for parking of horse trailors; in lieu of the culd-de-sac on George Street there will be a parking area at the end of that street; that the plat include ~ Whitaker and ½ Siphon Road to be dedicated to the City of Chubbuck~ developer will be required to construct a culd-de-sak at the end of Kunze Road if the City of ChubbucE is unable to negoiate a right of way from the Union Pacific Railroad; the Land Use Development Commission recommendation regarding the construction of sidewalks, but not curb and gutter on the interior streets also be imposed as a condition of approval of construction on Whitaker and Siphon Roads. Councilman England seconded. Rell Call Vote: Hopkins, yes; Quick, yes; England, yes; Nield, absent. REQUEST FOR WAVIER OF SANITATION CHARGES - JOHN VALENTY - Mr. John Valenty was present and presented a request from paying his monthly sanitation charges. Mr. Valenty stated that the sanitation charges on his shop was not justified. Mr. Valenty said that he does not generate any sanitatio~therefore the City of Chubbuck does not pick up any garbage. Mr. Valenty asked if it would be possible for the Chubbuck Police Department to ticket violators~ that park parallel in front of Dan~s Food, Chubbuck Auto and the ?ire Mile Inn~ Mayor Co'ant stated that it is private property and the City does not have the authority to ticket violators on private property. Mayor Cotant asked Attorney Winmill to research a way that Mr, Valenty would not have to call the City and report violators, but the Police Department would watch for violators and have the authority to ticket them. Mayor Cotant told Mr. Valenty that the City would take his request for wavier of monthly sanitation charges under advisement. BUSINESS LICENSE APPLICATION - Vicki Ward, 819 Harold, Chubbuck, Idaho has applied for a business license to sell "Reproductions" at the Green T Tack Shop, 221 West Chubbuck Road. Councilman England moved to approve a business license to Mrs~ ViCk~ Ward to sell "Reproduction~,at the Green T Tack Shop at 221 W. Chubbuck Road. Councilman Quick seconded. All Councilmembers present voted in favor of the motion. 89 BUSINESS LICENSE APPLICATION - Dean Jones, Jones Auction, !44 E 100 N., Blackfoot, Idaho applied for a business license to operate an auction at the former Chubbuck Lumber Co. on July 13, 1985 at 10:00 a.m. After discussion Councilman England moved to approve a business license to Jones Auction to hold an auction at the former Chubbuck Lumber Co. on July 13~ 1985 at 10:00 a.m. Councilman Quick seconded. All Councilmembers present Voted in favor of the motion. APPEAL OF CONDITIONAL USE PERMIT - Mr. Troy Knoblich, 5655 Eve, Chubbuck, Idaho was present and presented Mayor Cotant & Council with a petition statinQ they oppose the conditional use permit proposal by Stewart Nelson, to place 1~ 4-plex units on the west 550 feet of lot !8 block 1, Qranted by the Land Use and ~evelopment Commission. ~ ' Mr. Knoblich Stated there is restrictive Covenants for the Paradise Acre Sub- division stating that block 1 shall be zoned for neighborhood commercial develop- ment. Attorney Winmill stated the restrictive Covenants is not binding on the City of Chubbuck. Attorney Winmill stated there was an inadequate opportunity to give the applicant notice of the appeal, therefore there should not be a decision on the appeal at tonights meeting. After discussion Councilman Quick moved to direct the City Clerk to send a notice of appeal to Stewart Nelson by certified mail and send appeal notices to residents within 300' of the proposed 4-plexes to attend a hearinq on the appeal of the conditional use permit issued to Stewart Nelson. The hearing on the appeal will be on the regular Council Meeting of the 23rd. of July, 1985 at 7:30 p.m. Councilman England seconded. All councilmembers present voted in favor of motion. CLAIMS - Computer print-out and handcheck claims have been presented to Mayor Cotant and Council. ~ After discussion Councilman Quick moved to approve computer print-out and handcheck claims as presented. Councilman England seconded. All councilmembers present voted in favor of motion. ORDINANCE - An ordinance of the City of Chubbuck, Idaho, providinq for the licensina of security officers and private investiqators: establishine standards for the issuance of licenses; limitine the authority of licensed security officers and private investigators; establishing procedures for the revocatio'n of licenses granted pursuant to this ordinance. The ordinance was tabled until the July 9, 1985 council meetinq. GENERAL DISCUSSION - 1) Amending Comprehensive Plan - Valenty Road. 2) Little League Umpiring. 3) Sand at Cotant Park. 91 COTANT PARK TENNIS COURT FENCE BID - Engineer Smart gave to ~ayor Cotant and Council a recap of bids recieved. BIDDER Haddens Fencing American Fence Co. Cascade Fencing AMOUNT BID $1Q,235.26 10,964.08 11,405.28 After discussion Councilman Quick moved to accept the bid of Hadden Fencinq of $10,235.26. Councilman England seconded. All councilmembers present voted in favor of motion. WHITAKER ROAD LIFT STATION ELECTRICAL BID - Engineer Smart presented to ~ayor Cotant and Council a quote he recieved for the Whitaker Road Lift Station Electrical Hookup Bid from O'Connor Electric for $1,795.00. (Only Bid recieved). After discussion Councilman England moved to accept the quote from O'Connor Electric for $1,795.00. Councilwoman Hopkins seconded. All councilmembers present voted in favor of motion. FINANCIAL STATEMENT for May presented to Mayor Cotant and Council. ~ At 11:10 p.m., Councilwoman Hopkins moved, Councilman Enqland seconded, with full council approval to adjourn the meeting. Ron C.
