HomeMy WebLinkAbout04 08 1986 CM53 COUNCIL MEETING MINUTES April 8, 1986 Minutes of regular council meeting held in the city municipal building, April 8, 1986. Present: Mayor John O. Cotant, Jr., Councilmembers Leroy S. Quick, Steven M. England, Boyd L. Fullmer, Attorney B. Lynn Winmill, Engineer Steven M. Smart and City Clerk Ron C. Conlin. Councilwoman Becky A. Hopkins was excused. Meeting was called to order at 7:35 p.m. by Mayor Cotant. APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the minutes of March 25, 1986 and Special Meeting minutes of April 1, 1986. Councilman Quick moved to approve the minutes of March 25, 1986 as read. Councilman Fullmer seconded. All councilmembers present voted in favor of motion. Councilman Quick moved to approve the minutes of a Special Meeting on April 1986 as read. Councilman England seconded. All councilmembers present voted in favor of motion. PUBLIC HEARING - The public hearing is being held to comply with the requirements of Zdaho Code ~67-6509 and 67-6511 and will be conducted in accordance with the procedures outlined in ~7-2 of Chubbuck City Ordinance No. 241 and ~2 of Chubbuck City Ordinance No. 246, all as codified in ~ 18.28.020 of the Chubbuck Municipal Code. Mayor Cotant declared the public hearing open. Building Inspector/Fire Chief Cary Campbell was present and asked for some clarification on the amending of Ordinance #241. Chief Campbell asked if all duplexes and 3-plexes would be required to have an architects or engineering seal, also is the design review going to be okayed by the Design Review Committee or will it be required to go through the Land Use Committee. Chief Campbell felt these items should be clarified before the adoption of the amending of Ordinance of #241. Leah Potter, 750 Natalie, stated according to the plat, Mr.~Clank cannot build any duplexes in Phase ZI of the Heights Subdivision. Mrs. Potter stated Mr. Clark has already exceeded the limit of multiple dwellings he can build in Phase ~. Mrs. Potter is referring to Restrictive Covenants for Heights Sub- division. Don Horak, 829 Harold, stated he felt a conditional use permit should be required for multiple dwellings, regardless of what is required in R-3 and R-4 zones. Pete Anderson, 5000 Pleasant View, stated he felt it is important to have an architect or engineer's seal, because of the quality of some of the drawings that have been recieved in the past. Mr. Anderson felt this should be required in R-3 and R-4 zones only. Mayor Cotant closed the public hearing. 55 PUBLIC HEARING -(Cont.) After discussion it was decided Attorney Winmill would make corrections on the amending of Ordinance #241 and mail the corrected copy to Mayor Cotant and Council for study. City Clerk Ron Conlin was asked to publish notice of a public hearing to be held May 13, 1986, amending Ordinance #241 and amending the Comprehensive Plan of the City of Chubbuck. ORDINANCE #279 - An ordinance adding a new chapter 5.20 to the municipal code of the City of Chubbuck, providing for the regulation of auto wreckers; making a violation of said regulations a misdemeanor; prohibiting anyone from moving a vehicle at the scene of an accident until authorized to do so by police; prohibiting the solicitation of wrecker business at the scene of an accident; authorizing the establishment of a wrecker rotation list, establishing minimum standards for participation on the City's wrecker rotation list and revocation of the right to participate in the wrecker rotation list. The ordinance has been read 3 times by title and 1 time in full. Mayor Cotant read Ordinance #279 by title. Councilman Fullmer asked where in the ordinance the wrecker operator is required to provide the City of Chubbuck with a certificate of insurance. Councilman England moved to adopt Ordinance #279 adding the following clause to subparagraph f; requiring certificate of insurance in evidence of compliance with this section 5.20.04~ shall be kept on file with the Clerk or Chief of Police. Councilman Fullmer seconded. Roll Call Vote: Quick, yes; England, yes; Fullmer, yes; Hopkins, absent. RESOLUTION #2-86 - A resolution of the City of Chubbuck, Idaho, amending the monthly service charge to be imposed by the City for sewage disposal by non-residential stuctures through the municipal sewer system. Mayor Cotant read Resolution #2-86 in full. Councilman Fullmer moved to adopt Resolution #2-86 as read. Councilman England seconded. Roll Call Vote: Quick, yes; England, yes; Fullmer, yes; Hopkins, absent. ORDINANCE #280 - An ordinance providing for a change in the Land Use District with respect to certain lands located in the east 345 feet of lot 18, Paradise Acres Subdivision, from Agricultural (A) to General Commercial (C-2). Mayor Cotant read Ordinance #280 in full. After discussion Councilman Quick moved to dispense with the rule of reading Ordinance #280 on three separate occasions. Councilman Fullmer seconded. Roll Call Vote: Quick, yes; England, yes; Fullmer, yes; Hopkins, absent. Councilman England moved to adopt Ordinance #280 as read. Councilman Fullmer seconded. Roll Call Vote: Quick, yes; England, yes; Fullmer, yes; Hopkins, absent. 57 PROPOSED SWIMMING POOL - Discussion about potential locations for the proposed Chubbuck Swimming Pool. Engineer Smart said Price Development is willing to discuss the sell of land close to the Pine Ridge Mall. Engineer Smart said he thought Price Development would probably ask somewhere around $43,000.00 an acre. The land they would be talking about, would be a ways from the Pine Ridge Mall. The Pine Ridge Mall parking lot would not be close enough to use the parking lot for the proposed swimming pool. Also, the only access to the pool would be Hawthorne Road. Mayor Cotant reported, in staff meeting Officer Ray Sandusky was asked to do research on any safety aspects of the proposed swimming pool. Discussion about liability risks of operating a municipal swimming pool. Engineer Smart reported the Knudsen's have not presented a price on the land at Chubbuck Road and Hawthorne. Engineer Smart stated Shizowa has expressed an interest in donating a part of the subdivision that was recently approved on Whitaker Road. Engineer Smart was asked to get more information on what Mr. Shizowa might donate. CLAIMS - Computer print-out and handcheck claims have been presented to Mayor Cotant and Council. After discussion Councilman Fullmer moved to approve the computer print-out and- handcheck claims as presented. Councilman England seconded. All councilmembers present voted in favor of the motion. GENERAL DISCUSSION - 1) Mayor Cotant stated Margaret England, 11953 Hawthorne asked, that since they cooperated with the City in that they allowed an easement for the sewer to go through their property, they get charged the regular rate for water instead of the 1½ times required by out of city residents. After discussion it was decided the Englands would be required to pay the 1½ rate as required. It was suggested their meter be changed to 3/4" instead of the 1" they have. 2) Discussion about hiring a Building Inspector. Mayor Cotant stated the field had been narrowed to 3 or 4 individuals. After discussion it was decided Mayor Cotant, Engineer Smart and Chief Campbell would interview the finalist and bring a recommendation to the Council. 3) Engineer Steve Smart presented a draft of a City Personnal Policy to Mayor Cotant and Council. Mayor Cotant asked the Council to study the proposed policy and present comments. 4) City Recreation Director - Mayor Cotant stated Councilman England and the Mayor met with Dave Sherman about his duties as the City Recreation Director. It was decided Mr. Sherman would expand his duties as recreation director. It was decided Mr. Sherman's yearly wage would be $2,500.00. There will be a meeting held on August 18, 1986 to discuss how the programs progressed during the year. Councilman England presented to Mayor Cotant and Council a list of Mr. Sherman's duties. 5) Councilman Fullmer gave a report on a Postal Meeting he attended. 59 GENERAL DISCUSSION - (Cont.) 6) Chubbuck Days - Vete~of Foreign Wars, American Legion and Disabled Veterans have told Mayor Cotant they would like to participate in Chubbuck Days Celebration, July 4.
