HomeMy WebLinkAbout01 28 1986 CM9 COUNCZL MEETING MINUTES January 28, 1986 Minutes of the regular council meeting held in the city municipal building, January 28, 1986. Present: Mayor John O. Cotant, Jr., Councilmembers Becky A. Hopkins, Leroy S. Quick, Steven M. England, Boyd L. Fullmer, Attorney B. Lynn Winmill, Engineer Steven M. Smart and City Clerk Ron C. Conlin. Meeting called to order at 7:30 by Mayor Cotant. APPROVAL OF MINDTES - Mayor Cotant asked for corrections and additions to the minutes of January !4~ 1986. Councilman England moved to approve the minutes of January 14, 1986 as read. Councilman Quick seconded. All councilmembers present voted in favor of motion. ORDINANCE - An ordinance adopting the 1985 Edition of the Uniform Mechanical Code published by the International Conference of Building Officials and International Association of Plumbing and Mechanical Officials. Fire Chief Cary Campbell was present and presented his views on the Uniform Mechanical Code. Mayor Cotant read the ordinance in full. After discussion it was decided to table the adopting of the 1985 Edition of the Uniform Mechanical Code until the February 11, 1986 Council Meeting. ORDINANCE #276 - An ordinance adopting the City-Code. Attorney Winmill stated that at least 3 years ago, the City had prepared a Municipal Code by Book Publishing Company, but there was numerous problems with the printing. Recently the City has received a quote from Sterling Codifiers, at a considerable less price than Book POblishi~g Company. Attorney Winmill stated the City has recieved the updated Municipal Code and is ready to adopt by'ordinance. Mayor Cotant read Ordinance #276 in full. Councilman Quick moved to dispense with the rule of reading Ordinance #276 on three separate occasions.-~Councilman England seconded. Roll Call Vote: Hopkins, yes; Quick, yes; England, yes; Fullmer, yes. Councilwoman Hopkins moved to adopt Ordinance #276 as read. Councilman Fullmer seconded. Roll Call Vote: Hopkins, yes; Quick, yes; England, yes; Fullmer, yes. RESOLUTION #1-86 - A resolution amending the monthly service charge to be imposed by the City for sewage disposal by residential structures through the municipal sewer system. Mayor Cotant read Resolution #1-86 in full. Councilman Fullmer moved to adopt Resolution #1-86 as read. Councilman England seconded. Roll Call Vote: Hopkins, yes; Quick, yes; England, yes; Fullmer, yes. 11 PUBLIC AUCTION - The City of Chubbuck is offering at a public auction, one parcel of real estate owned by the city. This property is located at 4545 Yellowstone Ave. The property is immediately north of and adjacent to the Parrish Warehouse Grocery and Freight Salvage. Rodney Parrish, Hugh Hadley, Jim Thilmont and Herb Freed was present at the public auction. Mayor Cotant asked if anyone present would like to make a offer on the property. There was no response. Mayor Cotant stated the parcel-was appraised at $168,00~.00 on November 21, 1985. It was further appraised at $107,000.00 for the front 250 foot portion and $69,000,00 for the remainder. Attorney Winmill stated at this time the City cannot accept an amount under the appraised value. Mayor Cotant asked if anyone present would like to make an offer on the property for the second ~ime~ There was no response. Mayor Cotant stated if there is any interest by an individual or a group, be~eafte~ the Council would take under advisement. No action can be taken to sell the p~ope~ty-without Cit~ Council approval. Mayor Cotant stated City Clerk Ron Conlin will' notify Rodney Parrish, Jim Thilmont Hugh Hadley and Herb Freed of any meeting that might be called inregards to a proposal the City Council might recieve on the sell of the property. Rodney Parrish Hugh Hadley, Jim Thilmont and Herb Freed were told if they want notice of such a meeting, they should leave their name and addresses with City Clerk Ron Hugh!Hadley, Jim Thilmont and Herb Freed did not leave their addresses with City Clerk Ron Conlin. ORDINANCE #277 - An ordinance adding a new section 13.04.095 to the municipal code of the City to impose turn-on fees for water service. Mayor Cotant read Ordinance #277 in full. After discussion it was decided to make the regular work week between 8:00 a.m. and 5:00 p.m. (Monday through Friday), instead 9:00 a.m. and 5:00 p.m. (Monday through Friday). After further discussion it was decided to make the turn on/off fee Twenty-Five Dollars ($25.00) instead of the suggested Forty Dollars ($40.00). Councilman Quiak moved to dispense with the rule of reading Ordinance #277 on three separate occasions. Councilman England seconded. Roll Call Vote: Hopkins, yes; Quick, yes; England, yes; Fullmer, yes. Councilman Fullmer moved to adopt Ordinance #277 with the above changes. Council- woman Hopkins seconded. Roll Call Vote: Hopkins, yes; Quick, yes; England, yes, Fullmer, yes. 13 COMPUTER PURCHASE - POLICE DEPARTMENT - At the January 14, 1986 Council Meeting the Council approved a lease agreement for a IBM ATC Computer through funds generated from the sale of the Ellis property forfeiture. Councilman Quick stated the computer was figured in the City's 1985-86 Budget. After discussion about what ir'would cost to lease the]computer it was decided- to purchase the computer rather than lease it. Councilman Quick stated the cost of the computer is $7,000.00, this is a savings of $3,000.00. INTERGOVERNMENTAL AGREEMENT-JOINT PROPERTY ADMINSITRATION - Attorney Winmill stated he had met with City of Pocatello to consider the trust fund and reached a tentative conclusiona liquidator, who could act as a trustee and could be bonded~ is what is needed. Attorney Winmill said there has been contact from 4 or 5 people~saying they would like to liquidate the property. They have been told to present proposals,and tell how they would liquidate the property. Attorney Winmill suggested there be a special council meeting to consider the proposals. After discussion it was decided to call a special council meetimg February 4. 1986, Tuesday, 5:00 p.m. to consider the proposals presented. PROCLAMATION - VOCATIONAL EDUCATION WEEK - Mayor Cotant read the ~roclamation in full. Councilman Quick moved to direct Mayor Cotant to proclaim February 9 through February 15th, 1986 as Vocational Education Week. Councilwoman Hopkins seconded. All ~ouncilmembers voted in favor of the motion. PROCLAMATION - SCOUT -WEEK - Discussion about Scout ~eek, 'Fe~n~a'~yr2-Zth!']l~g86. Councilman Fullmer moved to direct Mayor Cotant to proclaim February 2~7~$~'!986 Scout ~eE~]'~ Councilman England seconded. All councilmembers voted in favor of motion. HANDCHECK CLAIMS - Handcheck claims presented to Mayor Cotant and Council. After review Councilman Quick moved to approve the handcheck claims as read. Councilwoman Hopkins seconded. All councilmembers voted in favor of motion. GENERAL DISCUSSION: 1) Councilwoman Hopkins gave a report on Health Education Committee Meeting. 2) Mayor Cotant stated all ~ity employees should wear seatbelts while driving city vehicles. 3) Councilman England reported there is a Swimming Pool Committee Meeting, January 30, 1986 at 6:00 p.m. At 9:30, Councilwoman Hopkins moved, Councilman~Quick seconded, with full approval to adjourn the meeting. ~ohn O.
