COUNCIL MEETING MINUTES
December 8, 1987
Minutes of a regular meeting held in the city municipal building,
December 8, 1987.
Present: Mayor John O. Cotant, Jr., Councilmembers Leroy S. Quick, Steven M.
England, Boyd L. Fullmer, Attorney B. Lynn Winmill, Engineer Steven M. Smart
a6d City Clerk Ron C. Conlin. Councilwoman Becky A. Hopkins was excused.
Meeting called to order at 7:36 p.m. by Mayor Cotant.
INVOCATZON was given by Bishop Thomas S. Nield, Chubbuck 4th Ward, The Church of
~es'us' Chri~"o~ L.atter-Day Saints.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections ahd additions to the
minutes of November 24, 1987 and Special Meeting minutes of December 7, 1987.
Councilman Fullmer moved to approve the minutes of November 24, 1987 as read.
Councilman England seconded. All councilmembers present voted in favor of
motion.
Councilman England moved to approve special meeting minutes of December 7, 1987
as read. Councilman Quick seconded. All councilmembers present voted in favor
of motion.
RENEWAL OF LIQUOR, WINE AND BEER LICENSES - for the year 1988. The Police
Department have approved the renewal of licenses to present holders of beer,
wine and liquor licenses.
Councilman Quick moved to approve the renewal of liquor, wine and beer licenses
for the year 1988, subject to the compliance of all requirements of
the ordinance and statutes as determined by the City Clerk. Councilman Fullmer
seconded. All councilmembers present at the meeting voted in favor of the
motion.
ANIMAL CONTROL INTERGOVERNMENT AGREEMENT - Animal Control Officer Dick Moldenhauer
sent a draft renewal/revision of the animal control agreement to Mayor Cotant
and Council.
Councilman England moved to authorize Mayor Cotant and City Clerk to execute
the animal control agreement,,,'§~.bject to the a~r~ement ~{'~6eing~re~roactive .
to October 1, 1987. Councilman Quack seconded. Ali councilmembers present votea
in favor of motion. Attorn:ey Winmill was asked to amend Ordinance #i72, to reflect
the $5.00 increase in the agreement.and present at the next council meeting.
ORDINANCE - Amending section 18.12.030 (A) of the Chubbuck Code to modify
restrictions on the placement of accessory structures. Attorney Winmill passed
to Mayor Cotant and Council copies of the draft for review.
Attorney Winmill stated he prepared an ordinance modifing the city's regulation
of an aceessory structure.
Fire Chief Cary Campbell stated his concern was not to be less restrictive than
the Building Code, which was considerably less restrictive than the prior

ordinance. Chief Campbell expressed concern'of fire safety if two neighbors
were allowed to build tWO.buildings side by side, without firewalls.
Attorney Winmill suggested deleting Paragraph 4 in Section 1 of the draft.
Councilman England stated he would like the City to be as unrestrictive as
we can, and stay within the safety guidelines.
After considerable discussion it was decided, Attorney Winmill would prepare
another draft of the ordinance ~th~%he f61to~i~g'chan~es;-1)~De]ete Paragraph
4, Section 1. 2) Change of wording in Paragraph 3, Section 1. Attorney Winmill
will also work on modifying the sizes of accessory structures allowed by the
Uniformed~]Building Code.
FUND TRANSFER - City Clerk Ron C. Conlin explained to Mayor Cotant and Council,
the following transfers are needed to balance the year end budget expenditures
with the budget.
Councilman England moved to transfer the following:

Councilman Fullmer seconded. All councilmembers present voted in favor of the
motion.
FINANCIAL STATEMENT for the month of November presented to Mayor Cotant and Council.
CLAIMS - Computer print-out claims presented to Mayor Cotant and Council.
After discussion Councilman Fullmer moved to approve the computer print-out
claims as read. Councilman England seconded. All councilmembers present voted
in favor of motion.
CHUBBUCK FIRE DEPARTMENT PERSONNEL POLICY - Fire Chief Campbell presented to
Mayor Cotant and Council a draft of the Chubbuck Fire Department Personnel
Policy for review. ,

The Chubbuck Fire Department Personnel Policy will be on the January 12, 1988
Council Meeting agenda for discussion.

GENERAL DISCUSSION -
1)
Councilman Fullmer stated the flagpole line at Cotant Park is sl.apping agains%
the pole,:maki'ng noise, which is a nuisance to neighors in the area. ~t
will be discussed in staff meeting and corrected.
2)
Discussion about the Police Exployer Post being created, with the return
of Officer Dick Webb. Councilman Quick stated he would talk to Officer Webb
and get the program going again.
3) City Clerk Ron Conlin stated the 1987-88 Audit is finished and will be
presented at a January, 1988 meeting.
At 9:14 p.m., Councilman England moved, Councilman Quick seconded, with full
council approval to adjourn the meeting.
