COUNCIL MEETING MINUTES
September 13, 1988
Minutes of a regular meeting held in the city municipal building,
September 13, 1988.
Present: Mayor John O. Cotant, Jr., Councilmember Leroy S. Quick,
steven M. England, David A. Landon, Dwain A. Kinghorn, Public
Works Director Steven M. Smart and City Clerk Ron C. Conlin.
Meeting was called to order at 7:30 p.m. by Mayor Cotant.
APPROVAL OF MINUTES - Mayor Cotant asked for additions or corrections
to the minutes of August 23, 1988 and Special Meeting Minutes of
August 25, 1988.
Councilman England moved to approve the minutes of August 23, 1988
as read. Councilman Landon seconded. All councilmembers present
at the meeting voted in favor of motion.
Councilman Landon moved to approve the minutes of a Special Meeting
held August 25, 1988 as read. Councilman Quick seconded. All council-
members present, voted in favor of the minutes.
ADMINISTRATION OF OATH OF OFFICE - City Clerk Ron C. Conlin administered
the oath of office to Dwain A. Kinghorn.
ORDINANCE #310 - An ordinance of the City of Chubbuck, Idaho, to
provide for the exercise of the city's local option as provided by
Idaho Code Section 39-1108 with respect to regulation and licensing
of day care services; to provide for licensing and regulation of
day care services; to provide for background checks with respect
to persons employed by or providing day care services; to provide
for certain fire code standards with respect to day care facilities;
to provide a schedule of fees~ to provide for penalties for viol-
ation of said ordinances.
Attorney Holmes reported the State Code allows a city to adopt a
more restrictive ordinance, especially with respect to the police
checks. Attorney Holmes said he has sent a copy of the ordinance
to the state, as of yet, we have not received a response.
Mayor Cotant read Ordinance #310 by title only, for the third read-
ing.
Councilman Quick moved to adopt Ordinance ~310 as read.
England seconded. Roll Call Vote: Quick, yes; England,
yes; Kinghorn, yes.

SUMMONS - MONTY W. GRIFFITHS vs. B.J. HAYBALL - Attorney Holmes gave
a report on the summons.
City Clerk Conlin reported Insurance Designers was sent a copy of
the complaint.
CLAIMS - Computer print-out and handcheck claims presented to Mayor
Cotant and Council.

After discussion, Councilman Kinghorn moved to approve the
computer print-out and handcheck claims as read. Councilman
Quick seconded. All councilmembers voted in favor of motion.
FINANCIAL REPORT for month of August presented to Mayor Cotant and
Council.
FIRE DEPARTMENT - Fire Chief Cary Campbell stated the sealed bids for
portable two-way radios and/or pagers were opened September 8, 1988.
Chief Campbell said the Motorola bid came in at approx. $17,000.00
and NECi came in at $14,500.00. He said the old pagers are not
working well, and the expense of repairing them is high, a decision
should be made as soon as possible.
Chief Campbell stated one of the differenc~in costs is a 5 year
parts~labor/maintenance warranty. The Motorola is a better quality
pager. The NEC warranty is not near as good.
After discussion, Councilman Quick moved to direct Chief Campbell
to review the Motorola Bid to see if there can be a~reduction ~
in costs, because the quote reflected specifications not required
in the bid specifications, and purchase the Motorola Pagers with
the five year warranty. Councilman Landon seconded. All council-
members voted in favor of motion.
WILLIAM SLAVEN - WATER BILL COMPLAINT - Mr. William Slaven, 147 Linden
was present, he stated, due to a broken waterline, his utility bill
has been running $100.00 per month. Mr. Slaven stated he is out of
town a lot. He said there was no one living in his home from July
5, 1988 to August 12, 1988. He felt the City should have contacted
him, to advise him of the high useage the last three months.

GENERAL DISCUSSION -
1) Mayor Cotant suggested a city bulletin board be iBstal!ed
at Smith's Food King.
2) Discussion about purchasing Police Department software and
Fire Department pagers with a loan from Enterpripe Department,
the loan pay back will include necessary interest.
3) Water useage is up, compared to last year.
4) Fire Department personnel Policy - Chief Campbell asked Council
to review.
