Cotant, Jr., Councilmembers Leroy S. Quick, Steven M. England, Boyd L. Fullmer, David A. Landon, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting called to order at 7:34 p.m. by Mayor Cotant. INVOCATION was given by Pastor Don Bishop, Chubbuck Baptist Church. APPROVAL OF MINUTES: Mayor Cotant asked for additions or corrections to minutes of July 26, 1988. Councilman Fullmer moved to approve minutes of July 26, 1988 as read. Councilman Landon secoMd~d. All councilmembers present at the July 26, 1988 Council Meeting voted in favor of motion. ORDINANCE - An ordinance of the City of Chubbuck, to provide for the exercise of the City's local option as provided by Idaho Code Section 39-1108 with respect to regulation and licensing of day care services; to provide for licensing and regulation of day care services~ to provide for background checks with respect to persons employed by or providing day care services; to provide for certain ~ fire code standards with respect to day care facilities; to provide a schedule of feesi to provide for penalties for violations of said ordinance. Day Care Operators in the City were sent a copy of the proposed ordinance, and invited to the council meetinq to discuss the ordinance. Katherine Watson, Boyd Crum~ Delores Barrus, Norris Brown a~tendance at the meeting to discuss the proposed ordinance. Mayor Cotant read proposed ordinance by title for the second time. Mr. Brown, 640 Dell Rd. suggested Section 6.04.110 would create more paper work, than is needed. Officer Jerry Rowland explained the reasoning behind the Section. Mrs. Crump, 420 W. Chubbuck Rd. stated she keeps complete records on each child, this would be a duplicate requirement. After discussion, it was decided the day care operators would prefer to maintain their own records, the Police Department could inspect the records at anytime. Katherine Watson, 4886 Pleasant View expressed concern Of requiremen~ requiring a.chauffeur's license, when she only transports children once or twice a year. Asst. Chief Rowland stated he thought it was a state law. Attorney Holmes stated he would research the matter. 116 PROPOSED DAY CARE ORDINANCE (Cont.) Discussion regarding seat belts for children while transporting. Attorney Holmes stated he would research the law and ~report at next meeting. Mr. Brown stated, he felt, with this proposed ordinance and the State Licensing, there is a lot of duplication. Attorney Holmes said the proposed city ordinance is more stringent than the state licensing. Mayor Cotant asked Attorney Holmes, if the proposed city ordinance is more stringent, will the State accept it, and not require the day care centers to have a State License. After further discussion, the Council decided to table the proposed ordinance until the August 23, 1988 Council Meeting. ORDINANCE - An ordinance amending provisions of the Chubbuck ordinances to provide that certain violations are infractions rather than misdemeanors; to define an infraction and the penalty for an in~. fraction; and to provide that a vehicle may be impounded if the operator or owner fails to furnish or is unable to furnish proof of financial responsibility as required by Title 49, Chapter 15 of the Idaho Code. Mayor Cotant read the ordinance by title only for the first time. After discussion, the ordinance was tabled until the August 23, 1988 Council Meeting. 1988-89 FISCAL YEAR TENTATIVE BUDGET - City Clerk Ron Conlin presented a proposed tentative budget and reminded Mayor Cotant and Council i the 1988-89 Tentative Budget should be adopted tonight and a time set for the public hearing. The Public Hearing will be held Tuesday, August 23, 1988 at a regular council meeting at 7:30 p.m. Discussion about health insurance rates increasing. City Clerk Conlin reported he had contacted other insurance- carriers for quotes. Council decided to call a Special Meeting to~d~seus~_hudget, Tuesday, August 23, 1988 at 6:30 p.m., prior to the Public Hearing. Public Works Director Steve Smart suggested $4,000.00 be added to State Grants-Cotant Park line item to cover the monies the State held back on the Cotant Park Grant. After considerable discussion, Councilman Landon moved to adopt the 1988-89 Tentative Budget, with addition of $4,000.00 to State Grants- Cotant Park line item. Councilman Fullmer seconded. All council- members voted in favor of motion. 118 CLAIMS Computer print-out and handcheck claims presented to Mayor Cotant and Council. Councilman Landon moved to approve computer print-out and hand- check claims as read. Councilman England seconded. All council- members voted in favor of motion. At 9:30 p.m., the council decided to ajourn to executive session meeting to discuss budget. Attorney Holmes stated the council could not go to executive meeting for the purpose of discussing budget items. The council adjourned back to regular council meeting to discuss budget line items. Asst. Police Chief Jerry Rowland and Officer Scott Birch was pre- sent to present to Mayor Cotant and Council a line by line present- ation of the Police Department Budget. Fire Chief Cary Campbell was present to present a line by line item presentation of the Fire Department Budget. At 11:30 p.m., Councilman Quick moved to go into executive seession for the purpose of discussing personnel matters as authorized by Idaho Code 67-2345 (b). Councilman England seconded. Roll Call Vote: Quick, yes; England, yes, Fullmer, yes; Landon, yes. 100% of Councilmembers voted in favor of motion. No action or final decision was made. At 12:30 a.m., Councilman Fullmer moved to adjourn from executive session meeting to regular meeting. Councilman England seconded. All councilmembers voted in favor of motion. GENERAL DISCUSSION - 1) Councilman Fullmer stated the Senior Citizens Center would like to have a Chubbuck Days at the Center. They would like to have Mayor Cotant, Council and spouses be in attendance at a lunch, Friday, August 19, at noon. After discussion Councilman Fullmer said he would get back with the Senior Citizens and finalize a date. 2) Councilman Fullmer reported he received complaints about two men park workers racing the lawnmowers in the parks and on the church parking lot.
