COUNCIL MEETING MINUTES
April 12, 1988
Minutes of a regular meeting held i~ the city municipal building,
April 12, 1988.
Present: Mayor John O. Cotant, Jr., Councilmembers Leroy S. Quick, Steven M.
England, Boyd L. Fullmer, Attorney Thomas J. Holmes, Public Works Director
Steven M. Smart and City Clerk Ron C. Conlin. Councilmember David A. Landon
was excused.
Meeting was called to order at 7:40'p.m. by President of CounCil Leroy S. Quick.
INVOCATION was given by Bishop Randy Kress, Chubbuck 5th. Ward, Church of Jesus
Christ of Latter-Day Saints.
APPROVAL OF MINUTES - President of Council Quick asked for corrections~and add]i~i~ns
to the minutes of March 22, 1988.
Councilman England moved to approve the minutes of March 22, 1988 as read.
Councilman Fullmer seconded. All councilmembers present voted in favor of
motion.
PUBLIC HEARING - A proposal by the City of Chubbuck to change the city's
Comprehensive Plan Land Use Pattern and the existing Land Use District
in the Neider 1st. and 2nd Addition Subdivision. It is proposed that the
Land Use Pattern and Land Use District be changed from ~imited Residential
(R-2) to Single Family Res~idential (R-l). Streets affected by the change will
be Scott, Sheppard, Spraker, Easy, Joy, Boyd and West Side of Hawthorne.
Attorney Holmes asked the record reflect this matter came before the Land Use
& Development Commission, at the request of Mayor John O. Cotant, Jr.,:606 Scott

President of Council Leroy S. Quick declared the public~:hear~ng'open.
President of Council Quiak a§ked if there=wereY~ny comments fortor~against the

President of Council Quick stated there is no mention of the morth Side~.of
West Chubbuck Rd. in the proposed change.
Public Works Director Smart suggested the Council consider leavi'm§'Lt~6= west sideoi
Hawthorne and the North side of Chubbuck Rd. as (R-2) Limited Residential.
President of Council Quick suggested deleting the west side of Hawthorne Rd.
of the Neider Ad~tionfrom the zone change.

Councilman Fullmer made motion to accept~the~ recommendations of the Land Use &

During the public hearing process of the Land Use and Development Commission
and City Council there was no opposition to the zoning change. Councilman England
seconded. Roll Call Vote: Quick, yes; England, yes; Fullmer, yes; Landon, absent.
ORDINANCE #301 - An ordinance of the City of Chubbuck, providing for change of land
use district with respect to certain lands within the boundaries of the City
located in the southwest quarter, section 34, township 6 south, Range 34 E.B.M.
from limited residential (R-2) to single-family residential (R-l).
Mayor Cotant read Ordinance #301 in full.
Councilman England moved to dispense with the rule of reading Ordinance #301
on three separate days. Councilman Quick seconded. Roll Call Vote: Quick, yes;
England, yes; Fullmer, yes; Landon, absent.
Councilman Quick moved to adopt Ordinance #301 as read. Councilman England
seconded. Roll Call Vote: Quick, yes; England, yes; Fullmer, yes; Landon, absent.
ORDINANCE - An ordinance of the City of Chubbuck, providing for the licensing of
security officers and private investigators; establishing standards for the
issuance of licenses; limiting the authority of licensed security officers and
private investigators; establishing procedures for the revocation of licenses
granted pursuant to this ordinance.
Asst. Police Chief Jerry Rowland was present to discuss the ordinance with
Mayor Cotant and Council.
Discussion about amount of bond,asd insurance the proposed Ordinance requires.
After discussion, it was decided the Council would review the proposed ordinance
and discuss at the April 26, 1988 Council Meeting.
UTILITY RATE DISCUSSION - At the March 22, 1988 Council Meeting, Public Works
Director Steve Smart presented a study covering the following subjects: 1) The
need to build up the reserve funds to a reasonable level, and maintain that
level. 2) Depreciations of assets in the enterprise funds. 3) Utility rates of
a number of cities in the state. 4) Number of water, sewer-and sanitation employees
~n several: cities in the state. Council decided to review and discuss at this
meeting.
Mayor Cotant included notification to,the residents in the Mayor's letter,~.the
Council would discuss the pos§ibility of a rate increase and invited discussion:
on the increase, at the April 12, 1988 Council Meeting.
Mr. Ken Kearns, 4831 Elizabeth stated he felt, if the City is going to provide
services the residents want, the resident should expect to pay for the services
provided.
Mayor Cotant suggested the council review the rate ihcrease and d~scuss at the
April 26, !988 Council Meeting.

Councilman Fullmer made motion; that based upon the anticipated revenue
requirements surveyed, carefully reviewed and recognizf~g'itheneed for depreciation
reserve funding for improvements that we move to increase the monthly water
user fee by ~18 per thousand gallons to .60 per thousand gallons over the 5000
gallon minimum, ~he sewer monthly fee be increase18% and the sanitation monthly
fee be increased by 16%. The rate increase will be on the next monthly utility
billing. Councilman England seconded. All councilmembers present voted in favor
of motion.
ECONOMIC GROWTH COUNCIL OF THE~GREATER POCATELLO CHAMBER OF COMMERCE - The City?
has been asked, by the Economic Growth~Council to contribute $6,000.00 this
fiscal year for the development of a strategic plan for community development.
Attorney Holmes reported he sent a letter to Daniel Chadwick, Chief of
Intergovernmental Affairs asking the question as to whether or not a donation
of this sort by the City to the Economic Growth Council is a Violation of
Article 12, Section 4 of the Idaho Constitution.
Attorney Holmes reported he has not received an answer as of yet.
After discussion it was decided the City of Chubbuck would release a check for
$1,667.00 as budgeted, to the Economic Growth Council on this council meeting
claims. The request for $6,000.O~for the 1988-89 Fiscal Year will be discussed
in 1988-89 budget discussions. Attorney Holmes stated he would report to the
council when he receives an answer from Mr. Chadwick.
CLAIMS - Computer print-out and handcheck claims presented to Mayor Cotant and
Council.
After discussion, Councilman England moved to approve the computer print-out and
handcheck claims as read, with the addition of releasing a check included in
last council meeting claims for $1,667.00 to the Economic Growth Council.
Councilman Fullmer seconded. All councilmembers present voted in favor of motion.
PROCLAMATION - SOCCER CHAMPIONSHIP TOURNAMENT DAYS - Mayor Cotant read the
proclamation in full.
Councilman Fullmer moved to direct Mayor Cotant to proclaim April 30 and May 1,
1988 as "Soccer Championship Tournament Days'. Councilman England seconded.
All councilmembers present voted in favor of motion.
ORDINANCE #302 - An ordinance of the City of Chubbuck, amending the land use
provisions of the Chubbuck Municipal Code to distinguish between major and minor
home occupations; providing for minor home occupations; to provide for major
home occupations to be permitted only upon the'issuance of a conditional use permit
to define and establish regulations governing both major and home occupations.
Attorney Holmes reported this ordinance reflects all changes discussed at prior
council meetings.
Mayor Cotant asked if there was any comments in regards to the ordinance. There
was none.

GENERAL DISCUSSION -
1) Alan Farnsworth gave a report on Chubbuck League Volleyball. There will be
a fund raising tournament April 23, 1988.
At 9:40 p.m., Councilman England moved, Councilman Quick seconded, with full
council approval to adjourn meeting.
