COUNCIL MEETING MINUTES
January 26, 1988
Minutes of a special meeting held in the city municipal building,
January 26, 1988.
Present: Mayor John O. Cotant, Jr., Councilmembers Leroy S. Quick, Steven M.
England, Boyd L. Fullmer, David A. Landon, Attorney Thomas J. Holmes, Public
Works Director Steven M. Smart and City Clerk Ron C. Conlin.
Meeting was called to order at 6:30 p.m. by Mayor Cotant. ~'
PURPOSE OF MEETING was to discuss with the Land Use and Development Commission
two items: 1~ Appeal by Rand~Broadhead. 2. Proposal to change the comprehensive
plan--Paradise Acres Subdivision and Greener Pasture SubdiVision from R-2
to R-1.
Land Use and Development Commission Members present: Chairman Pete Anderson,
Sue Parrish, Bob Anderson and Myrna Cain.
APPEAL - RANDY BROADHEAD.- LAND USE AND DEVELOPMENT COMMISSIONrS DECISION TO DENY
A VARIANCE.
Mayor Cotant, Council and Land Use and Development Commission discussed at
length, the denial of a variance to Mr. Randy Broadhead by the Land Use and
Development Commission.
Attorney Holmes stated the variance request is in conflict with the Comprehensive
Plan.
Commission Chairman Pete Anderson stated that one of the conditions of granting
a variance is that, there is a hardship involved. Mr. Broadhead does not own
the property at this time, therefore, there is not a hardship involved.
Chairman Anderson said one of the reasons the variance was denied was, it was
beyond the scope of a home occupation. ~
Fire Chief Cary Campbell reported he.had not received the material data safety
sheets for the chemicals that would be stored in the garage.
The appeal by Randy Broadhead is the first item on tonights City Council Meeting.
A PROPOSED CHANGE IN THE CITY'S COMPREHENSIVE PLAN USE PATTERN and the existing
Land Use District in the Paradise Acres Subdivision, excepting block 18, and in
the Greener Pastures Subdivision.
Mayor Cotant suggested rezoning Subdivisions that are R-2, but have restrictive
covenants which are R-I, to R-1.
Chairman Anderson stated the Commission directed Attorney Holmes to research
what happens where livestock is allowed now, the residents move, is the livestock
still allowed. Attorney Holmes was directed to amend ordinance~to correct question.
Attorney Holmes stated the areas that will always have livestock should be
identified now, and be treated has a separate matter.

Chairman Anderson stated letters were send to all residents affected.by the
proposed change. The residents that attended the meetings were in favor of
the proposed changes.
Mayor Cotant suggested Neider Addition 1 & 2 be zoned R-1.
After discussion, it was decided to send notices to residents in Neider Addition
1 & 2 telling them of a public meeting that will be held, March 3, 1988 at the
Land Use & Development Commission Meeting. The meeting will be in negards to
a cha~ge in zoning from R-2 to R-1 in the Nei~er Addition I & 2.
The proposed change in the City's Comprehensive Plan Land Use Pattern and the exis~
~9~L~d Dse District in ~he~P~radise~Acres Subdivision~ excepting bl~k 18~ and
in,the Greener Pastures Subdivision~will be item #6 on tonights regular Council
Meeting.
At 7:30 p.m., Councilman Fullmer moved, Councilman England seconded, with full
council approval to adjourn the meeting.

CITY OF CHUBBUCK
Pursuant to Idaho Code Section 50 -604, the undersigned
Mayor of the City of Chubbuck, Idaho, hereby calls a special
meeting of the City Council to be held at the Chubbuck City
Municipal Building, 5160 Yellowstone Avenue., at the hour of
6:30 p.m., on the 26th day of January 1988. The object of the
special meeting shall be to Discuss with the Land Use and Development
Commission two items 1. Appeal by Randy Broadhead; 2. Proposal
to change the comprehensive plan -- Paradise Acres Subdivision
and Greener Pasture Subdivision from R -2 to R -1.
