COUNCIL MEETING MINUTES
October 24, 1989
Minutes of a regular meeting held in the city municipal building,
October 24, 1989.
Present: Mayor John O. Cotant, Jr., Councilmembers Leroy S. Quick,
Steven M. England, David A. Landon, Dwain A. Kinghorn, Attorney
Thomas J. Holmes, Public Works Director Steven M. Smart and City
Clerk Ron C. Conlin.
Meeting called to order at 7:32 p.m. by Mayor Cotant.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions
to the minutes of October 10, 1989.
Councilman England moved to approve the minutes of October 10, 1989
as read. Councilman Kinghorn seconded. All councilmembers voted in
favor of motion.
ORDINANCE - An ordinance, amending Chubbuck Code Section 18.12.030 (j)
to provide for screening of commercial products stored outdoors; to
provide for screening of outdoor storage in Industrial areas; to
provide for the partial screening of storage areas where products are
being offered for sale to the public.
Mayor Cotant read the screening ordinance by title only, for the
second time.
Councilman England suggested the Idaho State Journal write an art-
icle advising residents in the city, this will be the third and final
reading on the screening ordinance.
The screening ordinance will be on the November 14, 1989 Council
Meeting Agenda.
ORDIN~NCE #32:3 -Ordin:anc~ clarifying Chapter 8.12 of the Chubbuck Mun-
icipal Code with respect to the parking of campers, motorhomes and
like vehicles on public streets and public property.
Mayor Cotant read Ordinance ~323 in full for the third and last
reading.
Councilman Kinghorn moved to dispense with the rule,requiring Ord-
inance ~323 to be read on three separate days. Councilman Quick
seconded. Roll Call Vote: Quick, yes; England, yes; Landon, yes;
Kinghorn, yes.
Councilman Landon moved to adopt Ordinance ~323 as read. Councilman
Kinghorn seconded. Roll Call Vote: Quick, yes; England, yes; Landon,
yes; Kinghorn, yes.
CABLE COMMISSION REPORT - Mary Harker, Cable Commission Chairman was
present to give Mayor Cotant and Council a report on the Cable Com-
mission.
Mrs. Harker stated the cost of cable the last few years, has nearly
doubled.

Mrs. Harker stated there have been several options discussed at
meetings.
Sue Parker, TCI is the current manager of TCI.
Mrs. Harker asked Mayor Cotant and Council to go on record support-
ing the right of local communities to regulate cable rates, several
bil~are before congress, unregulated monopolies have ~ever been
tolerated in American Society. Mrs. Harker said the City of Chubbuck
could formerly invite outside cable companies to serve Chubbuck,
creating lower rates and better service.
Mrs. Harker said she would get to the City, numbers of the bills
before Congress.
Councilman Quick suggested Mrs. Harker find out what Bronco Cable
Company's rates are, and report back.
Mrs. Harker said she will report to the Council, Qn the November
14, 1989 Council Meeting.
CHUBBUCK DAYS DISCUSSION - Chubbuck Days Chairman Alice Cotant was pre-
sent to get suggestions on what day Chubbuck Days 1990, will be.
Discussion about what weekend, Chubbuck Days, 1990 will be on.
Discussion about suggested activities for Chubbuck Days Celebration.

Food and Booths
After discussion, it was decided Chubbuck Days, 1990 will be held on
the 28th and 29th of June, 1990. Decision on activities will be made
at a later date.
CLAIMS - Computer print-out and handcheck claims have been presented to
to Mayor Cotant and Council.
After discussion, Councilman Landon moved to approve
out and handcheck claims as read. Councilman England
councilmembers voted in favor of motion.

Announcement - Meeting of new Ricks College President at the
Quality Inn, Pocatello, October 26, 1989 at 7:00 p.m.
Christmas Party, December 8, 1989 at 6:30 p.m., at the E1
Cielito.

Councilman Landon said A1 Johnson farms some property to the west
of the dead end street on Pinewood. Councilman Landon said there
was a problem last week, when children in the area, went into Al's
field with 4-wheelers, bicycles, etc., and tore up seeded field.
Mr. Johnson got on the children, then the childrens parents went
to Councilman Landon suggesting Mr. Johnson install a fence or a
gate. After discussion, it was decided the matter will be discussed
with Officer Phelps at Staff Meeting in the morning.
Councilman Landon stated Keith Hirschi left on his mission today,
and Councilman Landon has taken over the baseball program until
Keith gets back.
Eric Stewart, Stewart Engineering was present and presented a
Master Plan for the City of Chubbuck's Wastewater System. Mr.
Stewart asked Mayor Cotant and Council to revie~ and if he could
be of any help, to contact him.
6. Training session for city planning personnel, city council and
staff, Thursday, November 9, 1989 at 7:00 p.m.
At
8:58 p.m., Councilman England moved to go into executive session
meeting for the purpose of considering acquisition of interest in
real property which is not owned by a public agency, as authorized
by Idaho Code 63-2345 (c). Councilman Quick seconded. 100% of council-
members voted in favor of motion.
Discussion about possibility of purchase of property for proposed
fire station.
No action or final decision was made.
At
9:30 p.m., Councilman Kinghorn moved to adjourn from executive
session meeting to regular meeting. Councilman England seconded.
All councilmembers voted in favor of motion.
HAWTHORNE HAUNTED HOUSE - Fire Chief Cary Campbell presented to Mayor
Cotant'~ and Council a list of requirements for the Hawthore Haunted
House.
1. City of Chubbuck must be named as an insured, on their liability
policy.
2. Required to turn off external loud speaker at 10:00 p.m.
3. Activities will be completed by 11;30 p.m. each day.
4. No smoking by the public will be allowed, this includes the entire
area from Hawthorne Road east.
5. No alcoholic beverages during the time Hawthorne House is open
to the public.
6. The south driveway shall be kept clear and maintained for emer-
gency vehicles at all times.
7. Hawthorne House building activities require a building permit~
from the City.

Mayor Cotant and Council were in agreement with the requirements
placed on the Hawthorne Haunted House.
At 9:58 p.m., Councilman England moved, Councilman Landon seconded,
with full council approval to adjourn meeting.
