COUNCIL MEETING MINUTES
September 26, 1989
Minutes of a regular meeting held in the city municipal building,
September 26, 1989.
Present: Mayor John O. Cotant, Jr., Councilmembers Leroy S. Quick,
Steven M. England, David A. Land,n, Dwain A. Kinghorn, Attorney
Thomas J. Holmes, Public Works Director Steve Smart and city Clerk
Ron C. Conlin.
Meeting was called to order at 7:32 p.m. by Mayor Cotant.
INVOCATION was given by Pastor Don Bishop, Chubbuck Baptist Church.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions
to the minutes of September 1.2, 1989.
Councilman Kinghorn moved to approve the minutes of September ~,
1989 as read. Councilman Landon seconded. Ail councilmembers voted
in favor of motion.
BRIARWOOD MOBILE HOME PARK - Nancy Armstrong, Briarwood Mobile Home
Park was present to state some problems residents have to put up
with living in Briarwood Mobile Home Park:
1. Vandalism
2. Weeds
3. Leaking water hydrants in their yards.
Mrs. Armstrong asked if the city could help in getting the owner
of Briarwood to take care of these problems.
Mayor Cotant stated a city officiallwill contact the owne~330f~Bmiar-
wood Mobile Home Park, and see what can be done.
ORDINANCE - PROPERTY MAINTENANCE - An ordinance adding Chapter 8.24 to
the Chubbuck Municipal Code providing for the maintenance of property
within the City of Chubbuck.
The purpose of this ordinance is to promote the health, safety and
welfare of the citizens of Chubbuck and to protect neighborhoods
against blighting and deteriorating influences by establishing re-
quirements for maintenance of all building exteriors and all premises
and vacant land.
Mayor Cotant read Property Maintenance Ordinance by title only for
the second title reading.
Mayor Cotant suggested the ordinance be advertised, so we can get
residents comments before the ordinance is adopted.
TREE VALLEY ROAD AGREEMENT - Public Works Director Steve Smart was
directed to contact, Robert Johannson and discuss the agreement.
PWD Smart said he did not contact Mr. Johannson, but, felt Mr. Johann-
son would not think the agreement was very fair, pa~dnot enter into
it.

PWD Smart recommended, at this time the Tree Valley Road Agreement,
not be pursued.
After discussion, the council decided not to act on the Tree Valley
Road Agreement.
ORDINANCE - CAMPER - An ordinance clarifying Chapter 8.12 of the Chubbuck
Municipal Code with respect to the parking of campers, motorhomes and
like vehicles on public streets and public property.
The purpose of this ordinance is to clean up some provisions in the
nuisance section on vehicles.
Mayor Cotant read the ordinance in full, for the first reading.
After discussion, the Council decided to review and discuss at the
October 10, 1989 Council Meeting.
RESOLUTION #7-89 - A resolution of the City of Chubbuck, withdrawing from
Resolution ~1986-29 being a Joint Resolution of the City of Chubbuck
and City of Pocatello to aid in the operation of the Magistrate Divis-
ion of the District Court of the Sixth Judicial District.
Councilman Quick moved to adopt Resolution #7-89 as read. Councilman
Landon seconded. All councilmemb6rs voted in favor of motion.
CLAIMS - Computer print-out and handcheck claims presented to Mayor
Cotant and Council.
Councilman England moved to approve computer print-out and handcheck
claims as presented. Councilman Kinghorn seconded. All councilmembers
voted in favor of motion.
POLICE DEPARTMENT - Scott Birch stated a Speed Store 240 Mega-Byte
hard drive was purchased for the Police Department this month. When
the hard drive was delivered, we found out it is not compatible.with
our AT System.
Detective Birch said he found a way to get a more updated file service
storage capacity needed, higher memories capabilities and updated
version of software for the same amount of monies~spen~ on the Speed
~[~t~he cost is $2,400.00 per year for four years, with a $1000.00
Detective Birch said Tech-Stuff Co. will carry the contract, so as
not to bound a future council.
Councilman England moved to approve the purchase of 1 Novell File
server for $2,400.00 per year for four years, with a $1,000.00 buy-out
at conclusion of lease. Councilman Landon seconded. All councilmembers
voted in favor of motion.

GENERAL DISCUSSION:
1)
Discussion about how many animals allowed, if conditionally
approved on East Chubbuck Rd.,across from the Doll House. Owners
of the pasture are being notified, they are in violation of
ordinance, by not applying for a conditional use permit to put
mules or horses on their pasture.
2)
Councilman Quick said residents around the ice skating pond, are
aski~g,~if the city'plans to develop the land to a park and when.
PWD Smart said the last few years, it has been budgeted, but we've
ran short of monies, and that is where the cuts were made. Council-
man Quick said the residents are willing to donate time and trees
if needed. Councilman Kinghorn expressed concern of installing
a sprinkling system, because of pipes freezing in the winter.
At 8:40 p.m., Councilman England moved, Councilman Kinghorn seconded
with full council approval to adjourn meeting.
