COUNCIL MEETING MINUTES
September 12, 1989
Minutes of a regular meeting held in the city municipal building,
September 12, 1989.
Present: Mayor John O. Cotant, Jr., Councilmembers Leroy S. Quick,
Steven M. England, David A. Landon, Dwain A. Kinghorn, Attorney
Thomas J. Holmes, Public Works Director Steven M. Smart and city
Clerk Ron C. Conlin. Councilman Leroy S. Quick was excused at
9:00 p.m.
Meeting was called to order at 7:31 p.m. by Mayor Cotant.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections om additions
to the minutes of September 12, 1989.
Councilman Kinghorn moved to approve the minutes of September 12,
1989, as read. Councilman England seconded. All councilmembers
present voted in favor of motion.
WAIVER OF PLATTING - A request for a Waiver of the Platting require-
ments of the Land Development Ordinance from Mr. and Mrs. George
Shiozawa and Kent Shiozawa. The request is on land adjoining the
west side of Whitaker Road, just north (outside) of the city limits.
Shiozawas would like to divide 7% acres into 3 parcels on land just
out of city limits. Mr. Shiozawa stated, they did not anticipate
any further development, and asked to hookup to city water and sewer.
The project will be served by the existing street, water and sewer.
Councilman Quick stated the Land Use and Development Commission
Members recommended the project be annexed into the city.
Councilman England moved to accept the recommendations of the Land
Use and Develpment Commission and grant a waiver of platting to
Mr. and Mrs. George Shiozawa and Kent Shiozawa on land adjoining
the west side of Whitaker Road, just north (outside) of city limits,
subject to; 1) If there is anyldevelopment to the west of properties,
the property would be subject to subdivision ordinance requirements,
2) Property will be annexed to the city. Councilman Kinghorn seconded

ORDINANCE ENFORCEMENT COMPLAINT - Betsy & Steve Nickels, 5154 Redfish
were present to express their feelings inregards to warning tickets
placed on thei~ camper, parked in front of their home. Mrs. Nickels
said the WArning ticket stated, you cannot leave a camper on the
street for more than 24 hours.
Mrs. Nickels said she explained to the officer, she was going to
install a fence on September 1, 1989, the officer told her, no
problem. After 30 days another warning ticket was placed on her'RV.
Mrs. Nickels said she called Monroe Fence again.
ORDINANCE ENFORCEMENT COMPLAINT - {Cont.)
Mrs. Nickels presented a list of residents in her subdivision that
have RV~ parked in front of their residence, she is wondering why
she was singled out for the warning tickets.
Mrs. Nickels suggested the ordinance be changed to allow RVs to be
parked on streets from April 15 to October 15th. Mayor Cotant stated
sweeping and snow removal are not the only considerations for the
ordinance, the most important reason is safety of pedestrians.
Discussion about cleanup of weeds in the area.
Mayor Cotant took the list of residents that have RVs parked in front
of their residences, and told Mrs. Nichels a police officer would
contact the residents.
Discussion about the liability, if the city does not have,
enforce ordinances.
MUTUAL AID AGREEMENT - An agreement between Marsh Valley Joint School
District #21 and the City of Chubbuck, whereas Chubbuck maintains
equipment and personnel for the purpose of combating and suppressing
fires within it own jurisdition and areas; and whereas School Dist.
#21 has space which could be used to house people and equipment in
the case of a calamity or disaster.
Mayor Cotant read the agreement in full.
Fire Chief Cary Campbell said the City of McCammon does not have the
necessary equipment to fight a fire at the School District #21.
Councilman Landon moved to direct Mayor Cotant to enter into the
Mutual Aid Agreement with Marsh Valley Joint School Disrtict #21.
Councilman Quick seconded. All councilmembers voted in favor of
motion.
PROCLAMATION -"BOY SCOUT POPCORN SALE DAYS"- Mayor Cotant read the
proclamation in full.
Councilman England moved to direct Mayor Cotant to proclaim Sept-
ember 13th. through September 22, 1989 as "Boy Scout Popcorn Sale
Days". Councilman Landon seconded. All councilmembers voted in favor
of motion.
PROPOSED FIRE STATION DISCUSSION - Fire Chief Campbell stated Mayor
Cotant, Councilman Dwain Kinghorn, Kent Parrish, Steve Smart and
Charle Dickman have reviewed plans for a new Chubbuck Fire Station,
along with plans for an addition to the shop area for parking the
garabage trucks. Chief Campbell said there needstobe a decision made
by the Council on proceeding with the plans.
Public Works Director Steve Smart gave a report on financing the
proposed project.

Architect Kent Parrish gave a report on the proposed fire station.
Councilman Landon moved to direct Architect Kent Parrish to proceed
with plans to advertise the project for bid. Councilman England
seconded. All councilmembers voted in favor of motion.
AGREEMENT - TREE VALLEY ROAD - Public Works Director Steve Smart stated
Tree Valley Road is a private easement. The land was subdivided by
probate several years ago. The landowner desires to obtain a building
permit for the property at this time.
Attorney Holmes prepared this agreement to protect the city, but yet,
let some~of property owners build new homes there. The agreement
states, by the city letting them build now, that in the future they
agree to participate either in an LID or some other way, to install
street,?sewer, water, curb, gutter and sidewalk along their property.
The agreement will be recorded.
After considerable discussion, Council decided to table the Tree
Valley Road Agreement until Public Works Director Steve Smart can
talk with Robert Johannson.
RESOLUTION %8-89 - A resolution proclaiming a General City Election
to be held November 7, 1989, designating the polling place, designat-
ing the registrar and deputy registrars, and ordering the city clerk
to give notice of such election.
Councilman Landon moved to adopt Resolution %8-89 as read. Councilman
Kinghorn seconded. All councilmembers present voted in favor of
motion.
BID - Sealed bids for a new truck cab and chassis with attached dump
body, GVW-24,000-30,000~lbs. was opened August 29, 1989. 1990 Diesel.
Public Work Director Smart gave a report on the two bids;~receiv~d.

Councilman England moved to approve purchase of 1990 Diesel ~ru~k, with
automatic transmission from Hirn~ng Pontiac,.Councilman Landon second-
ed. All councilmembers voted in zavor or motion.
FINANCIAL REPORT for month of August, 1989 was presented to Mayor Cotant
and Council.
CLAIMS Computer print-out and handcheck claims presented to Mayor
Cotant and Council.
Councilman Kinghorn moved to approve computer print-out and handcheck
claims as read. Councilman Landon seconded. All councilmembers voted
in favor of motion.

GENERAL DISCUSSION
1)
Kent Parrish, 249 Parrish Lane thanked Mayor Cotant and Council
for a job well done, on street improvement on Parrish Lane.
At
9:50 p.m., Councilman England moved to go into executive session
meeting for the purpose of considering and advising Attorney Holmes
on possible litigation and for personnel reasons, as authorized
by Idaho Code 67-2345 (f) and Idaho Code 67-2345 (b),respectively.
Councilman Kinghorn seconded. 100% of councilmembers present, voted
in favor of motion.
Fire Chief Cary Campbell discussed fire department personnel.
Discussion about Resolution #7-89, a resolution of the City of Chub-
buck withdrawing from Resolution ~1986-29.
No action or final decision was made.
At 10:10 p.m., Councilman London moved to adjourn from executive
session meeting to regular meeting. Councilman England seconded.

RESOLUTION ~7-89 - A resolution of the City of Chubbuck, withdrawing
from Resolution ~1986-29 being a Joint Resolution of the City of
Chubbuck and the City of Pocatello to aid in the operation of the
Magistrate division of the District Court of the Sixth Judicial
District.
After discussion, Councilman Landon moved to direct Attorney Holmes
to draft a letter to Administrative District Judge Peter D. McDermott
expressing the council's desire to withdraw from Resolution ~1986-29.
City Clerk Conlin was asked put Resolution ~7-89 on the September 26,
1989 Council Meeting Agenda.
At 10:25 p.m., Councilman Landon moved, Councilman England seconded,
with full council approval to adjourn meeting.
