COUNCIL MEETING MINUTES
July 25, 1989
Minutes of a regular meeting held in the city municipal building,
July 25, 1989.
Present: Mayor John O. Cotant, Jr., Councilmembers Leroy S. Quick,
Steven M. England, David A. Landon, Dwain A. Kinghorn, Attorney
Thomas J. Holmes, Public Works Director Steven M. Smart and City
Clerk Ron C. Conlin.
Meeting called to order at 7:36 p.m. by Mayor Cotant.
INVOCATION was given by Bishop Kent Hansen, Second Ward, Chubbuck Stake,
The Church of Jesus Christ of Latter-Day Saints.
APPROVAL OF MINUTES - Mayor Cotant asked for additions or corrections
to the minutes of July 12, 1989.
Councilman Kinghorn expressed concern there was no mention of the re-
quirement of Mr. Sample painting the boxcars, in the minutes. City
Clerk Conlin said the painting of the boxcars are mentioned in #1
of the agreement. 1) All four boxcars would have to be painted, and
thereafter must be continually painted, as required, in neutral earth
tone colors, using top quality, highly durable metal paint. The paintz
lng would have to be continued so long as the boxcars are located on
the property.
Councilman Quick moved to approve minutes of July 11, 1989 as read.
Councilman Kinghorn seconded. All councilmembers voted in favor of
motion.
BUSINESS LICENSE APPLICATION - Deloy Palmer, 131 Drake, Pocatello, Idaho,
has applied to sell insurance door to door in the City.
Counoilman England moved to grant a business license to Deloy Palmer,
to sell insurance door to door in the City. Councilman Kinghorn second-
ed. All councilmembers voted in favor of motion.
ORDINANCE - An ordinance amending certain sections of Chapter 9.20, as
adopted by City Ordinance ~314, to provide for the licensing of cats
and to make the penalties for an unlicensed cat the same as for an
unlicensed dog.
Carolyn Cottle, 4825 Whitaker Rd. expressed concern, if licensing of
cats is required, a cat could get hung because of the collar.
Joyce Dixon, 809 Garden Drive said, she felt the ordinance would be
against the responsible cat owners in the City.
David Van Houton, 5060 Dorian said he felt the cat ordinance would
not be effective.
Discussion about conducting a neutering-spaying clinic. It was stated
the clinics have not been successful in the past.

ORDINANCE - AMENDING ANIMAL CONTROL ORDINANCE - (Cont.)
After considerable discussion, the council tabled the ordinance
for further review.
ORDINANCE %319 -Ordinance providing for the installation of neighborhood
box units "NBU" in new subdivisions.
Mayor Cotant read Ordinance %319 in full.
Terry Gardner, 324 Henry expressed concern the boxes in the "Neighbor-
hood Box Unit" are way to small. He stated his past experience is the
box is not large enough, when the post office puts the mail in, they
crush it. The large boxes on the side should take care of the problem.
Councilman England stated there is a safety problem with the mail boxes
being located on the sidewalks, this will take care of the problem.
After discussion, Councilman Kinghorn moved to dispense with the rule
of reading Ordinance %319 on three separate days. Councilman Quick
seconded. Roll Call Vote: Quick, yes; England, yes; Landon, yes; King-
horn, yes.
Councilman Landon moved to adopt Ordinance %319 as read. Councilman
England seconded. Roll Call Vote: Quick, yes; England, yes; Landon, yes
Kinghorn, yes.
MUNICIPAL AUDIT LETTER OF UNDERSTANDING - A mutual understanding that an
examination of the financiallstatements of the City of Chubbuck for the
period from October 1, 1989 to September 30, 1990, will be completed
on or before December 31, 1989. The audit will be undertaken at a rate
of $2,500.00.
Councilman England moved to direct Mayor Cotant to enter into the
Audit Letter of Understanding as read. Councilman Quick seconded.
All councilmembers voted in favor of motion.
CLAIMS - Computer print-out and handcheck claims have been presented to
Mayor Cotant and Council.
Councilman Kinghorn moved to approve computer print-out and handcheck
claims as read. Councilman Quick seconded. All councilmembers voted in
favor of motion.
PROPERTY MAINTENANCE ORDINANCE - Attorney Holmes presented a draft of the
property maintenance ordinance for council review.
The property maintenance ordinance will be on the August 8, 1989
Council Meeting Agenda.
GENERAL DISCUSSION -
1. Mr. Eric Stewart told Mayor Cotant and Council he obtained a
business license in the City to operate a consulting engineering
firm.

DUMP~TRUCK BID -Public Works Director Steve Smart stated we opee~.~i~
for a used dump truck, today. PWD Smart said we received no bids for
a used dump truck. PWD Smart said we received e bid for a new dump
truck.
Councilman Landon said ~he might be able to get a book on used trucks
from Western Equipment.
After discussion, PWD Smart was directed to see if he can come up with
a book on used trucks, or advertize for bid, ~he purchase of a new
dump truck.
At 9:10 p.m., Councilman Landon moved to go into executive session
meeting for the purpose to consider and advise it legal representative
in pending litigation, as authorized by Idaho Code 67-2345 (f).
Councilman Quick seconded. 100% of council voted in favor of motion.
Discussion about agreement between City of Chubbuck, City of Pocatello
and Bannock County.
At 9:35 p.m., Councilman Landon moved to adjourn from executive session
meeting to regular meeting. Councilman England seconded. All council-
members voted in favor of motion.
At 9:35 p.m., Councilman Landon moved, Councilman Quick seconded, with
full council approval to adjourn meeting.
