Cotant, Jr., Councilmembers Leroy S. Quick, Steven M. England, David A. Landon, Dwain A. Kinghorn, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 7:36 p.m. by Mayor Cotant. APPROVAL OF MINUTES - Mayor Cotant asked for additions or corrections to the minutes of June 13, 1989. Councilman Quick moved to approve read. Councilman England seconded. of motion. the minutes of June 13, 1989 as Ail councilmembers voted in favor CLAIM - Mrs. Pat Little, 5126 Stuart presented a claim to the Council, stating on, Wednesday, May 31, 1989, a foul ball hit her pickup and shattered the window. She stated her pickup was parked in the drive- way of her home. Mrs. Little said this is the third time a foul ball has hit and broke a window at her home, and asked the city to pay for the damage this time. The estimate on repairing the window is $246.70. After discussion, Councilman England moved to pay the claim 0f $246.70, to Mrs. Pat Little, for repair of broken window. Councilman Landon seconded. All councilmembers voted in favor of motion. ANNEXATION FEE FOR HERITAGE WEST SUBDIVISION - Gary Gibson and Mike Bird attended the May 16, 1989 Council Meeting and asked the council to consider waiving the remaining annexation fees for Heritage West Subdivision, Phase I, II and III. Mayor Cotant said Steve, Councilman Kinghorn and himself met with Mr. Bird and Mr. Gibson today. Mr. Bird and Mr. Gibson were told, that because of agreement they would be required to pay the remaining $540.00 per lot in Phase I of the Heritage West Subdivision. After Phase I is completed, and Phase II is started American Heritage would be required to dedicate land for park and recreational purposes to serve the immediate and future needs of the residents of the develop- ment, or make a contribution in lieu of actual land dedication, or a combination of both, at the option of the city. The $540.00 annex- ation fee will not be required in Phase II, or Phase III of Heritage West Subdivision. Mr. Bird and Mr. Gibson were agreeable to these suggestions. ORDINANCE - An ordinance adding Chapter 8.20 to the Chubbuck Municipal Code, providing the city may contract with private property owners for the improvements of sidewalks. Mayor Cotant suggested we contact residents affected by the ordinance and invite them to the July 11, 1989 Council Meeting for comments. 107 ORDINANCE - An ordinance providing for the election of councilmembers by districts. Mayor Cotant and Council discussed ordinance at length. After discussion, the council decided not to adopt the ordinance, and look at it again in two years. ORDINANCE #318 - An ordinance amending Section 2.04.010 of the Chubbuck Municipal Code by restoring salary of the Mayor of the City to and setting the salary at $800.00 per month. Mayor Cotant read Ordinance ~318 in full. The Mayor's salary was $700.00 in 1987, Mayor Cotant suggested the salary be lowered to $600.00 at that time. Councilman Kinghorn suggested with the time Mayor Cotant.spends at the City Offices, or acting as Mayor, the salary should be raised to SS00.00. After discussion, Councilman England moved to dispense with the rule of requiring Ordinance ~318 to be read on three separate days. Council- man Quick seconded. Roll Call Vote: Quick, yes; England, yes; Landon, yes; Kinghorn, yes. Councilman Kinghorn moved to adopt Ordinance #318 as read. Landon seconded. Roll Call Vote: Quick, yes; England, yes; yes; Kinghorn, yes. Councilman nandon, CLAIMS - Computer print-out and handcheck claims presented to Mayor Cotant and Council. Councilman Kinghorn suggested the claim for Elwin Anderson for $900.00 not be paid until Mr. Anderson finishes the job and removes the trees from the Fire Station property. Councilman Kinghorn moved to approve computer print-out and handcheck claims as read, subject to Elwin Anderson's claim of $900.00 not being released until, Mayor Cotant and Councilman Kinghorn say the contract between Mr. Anderson and City is completed. Councilman Landon seconded. All councilmembers voted in favor of motion. CABLE COMMISSION REPORT - Mary Harker was not present to present budget requests for Cable Commission.
