55 COUNCIL MEETING MINUTES March 28, 1989 Minutes of a regular meeting held in the city municipal building, March 28, 1989. Present: Mayor John O. Cotant, Jr., Councilmembers Leroy S. Quick, David A. Landon, Dwain A. Kinghorn, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Councilman Steven M. England was present after 8:00 p.m. Meeting was called to order at 7:30 p.m. by Mayor Cotant. APPROVAL OF MINUTES - Mayor Cotant asked for additions or corrections to the minutes of February 28th., Special Meeting Minutes of March 16th., and Special Meeting Minutes of March 21, 1989. Councilman Landon moved to approve the minutes of February 28, 1989 as read. Councilman Kinghorn seconded. All councilmembers voted in favor of motion. Councilman Kinghorn moved to approve the minutes of March 16, 1989 as read. Councilman Quick seconded. All councilmembers present at ~arch 16, 1989 meeting, voted in favor of motion. Councilman Landon moved to approve the minutes of March 21, 1989 as read. Councilman Kinghorn seconded. All councilmembers voted in favor of motion. WATER AND SEWER RATES FOR MOBILE HOME PARKS AND MULTIPLE HOUSING - Public Works Director Smart stated last time the Council met, he was given the responsibility to determine if the water and sewer rate scheme he developed would generate the kind of revenue that is necessary. Public Works Director Smart explained to mobile home park owners the water and sewer rate study. PWD Smart said, if mobile home park water and sewer rates are lowered, single family, etc. would have to be raised. Charlie Frasure, Circle Inn Mobile Homes asked if any of the water or sewer funds are spent in other funds. PWD Smart said none of the enterprise money goes to General Fund. Sue Parrish, 249 Parrish Drive asked why the City of Chubbuck's util- ity bill is so much higher than the City of Pocatello's. PWD Smart stated the City of Chubbuck has a large fiscal plant, with very sparse population to pay for it, if the City had high density, the bills would most likely be lower. Randy Hoffer, Bell Trailer Park stated a mobile home park has only one or two lin~to several trailers, and there should be some consid- eration there. PWD Smart said the City would like to make an in-deDth study, making all water and sewer rates equitable, but, it will take considerable time. Discussion about percentages of increase on water, sewer and sanita- tion. 57 WATER AND SEWER RATES FOR MOBILE HOME PARKS - (Cont.) Sue Parrish stated, while utility rates, taxes and insurances have went up, the amount charged to the renter is going down. It is hard for the owner to make ends meet. Councilman Quick said the Council has directed PWD Smart and City Auditor Scott Jones to make an in-depth study of water, sewer and sanitation rates. Councilman Quick asked mobile home court users if they have checked for leaks, or other ways to cut expenses. Jim Thilmont, J & M Enterprises stated the mobile park owners have to plan on what they are going to do, so when can they expect to have the in-depth rate study finished. After discussion, the Council set the first meeting in October, 1989 as a goal to have the study fin- ished. ORDINANCE #316 - An ordinance amending Chubbuck Code Section 18.08.040(B) to increase the maximum height of buildin~in General Commercial (C-2) and Industrial (I) zones to 70 feet; amending Section 18.12.020 (E) to provide structures may exceed the height restrictions of 18.040(B) by issuance of aconditional use permit. Mayor Cotant read Ordinance #316 by title only. Councilman Quick moved to dispense with the rule requiring ©rd. #316 be read on three separate days. Councilman Kinghorn seconded. Roll Call Vote: Quick, yes; England, yes; Landon, yes; Kinghorn, yes. Councilman Kinghorn moved to adopt Ordinance #316 as read. Councilman Quick seconded. Roll Call Vote: Quick, yes~ England, yes; Landon, yes; Kinghorn, yes. AGREEMENT - JOINT EXERCISE OF POWERS ACT - This agreement allows the City of Chubbuck to invest money in a local government pool, through the State Treasurer's Office. The procedure is to obtain bids each morning from the Idaho Banks which participate in the overnight Repurchase Agreement program, and to place overnight funds with the bank offering the highest avail- able bid. The rates are approx. 1% higher than investing in local banks. Councilman England moved to direct Mayor Cotant to enter into Joint Exercise of Powers Act Agreement with the State of Idaho. Councilman Landon seconded. All councilmembers voted in favor of motion. TRANSPORTATION PLAN FOR POCATELLO/CHUBBUCK URBANIZED AREA - Kevin Murphy, Manager of Transportation Planning for the North Bannock Metropolitan Planning Organization. Mr. Murphy stated the voting members on the NOBAMPO Policy Board from Chubbuck is Mayor Cotant and Councilmember Dwain A. Kinghorn. 59 TRANSPORTATION PLAN - (Cont.) Mr. Murphy said urbanized areas are required to have a transportation plan, which identifies projects and priorities in goals and objectives of which the transportation improvement program is based upon. Mr. Murphy said the transportation plan was approved by NOBAMPO Policy Board in September, 1988. The Land Use and Development Commission recommended the Council adopt the Transportation Plan for P©catello/ Chubbuck Urbanized Area. After discussion, Councilman Kinghorn moved to adopt the Transportatio Plan for the Pocatello/Chubbuck Urbanized area prepared by North Bannock Metropolitan Planning Organization. Councilman England second- ed. All councilmembers voted in favor of motion. PROCLAMATION - SOCCER CHAMPIONSHIP TOURNAMENT DAYS - Mayor Cotant read the Soccer Championship Tournament Days Proclamation in full. Councilman Landon suggested we send a letter to the soccer Dfficials asking them to advise parents, etc. to use all parking around Cotant Park,~ rather than congesting one side of the park, also to park with- in the~parking lines. Might want to use Police Exployers for warnings. Councilman Landon moved to direct Mayor Cotant to proclaim April 15th. 16th., 29th. and 30th. to be"Soccer Championship Tournament Days". Councilman England seconded. All councilmembers voted in favor of motion. FIRE DEPARTMENT REPORT - Fire Chief Cary Campbell gave a report on Vol- unteer Firemen physicals. Chief Campbell said some of the firemen felt the ICC Physical should be good enough for the required physicals Chief Campbell said he had the ICC Physical checked by the doctor, the doctor said there is a couple other tests he requires in addition to the ICC Physical. Chief Campbell said the deadline for the physical is May 1, 1989. Chief Campbell said he told the doctor what is re- quired of a volunteer fireman, the doctor then developed requirements f6r ~tke physical. After discussion, council decided all volunteer firefighters are required to have a city physical by May 1, 1989. Chief Campbell stated, it had never happened, but, if there was a a fire at a School District out of our fire districts, would our Fire Department respond. Attorney Holmes expres~d concen~if we respond ed without a mutual aid agreement. Council directed Attorney Holmes and Chief Campbell to work on getting mutual aid agreements. CLAIMS - Computer print-out claims presented to Mayor Cotant and Council. After discussion, Councilman England moved to approve claims as read. Councilman Landon seconded. All councilmembers voted in favor of motion., 61 POLICE DEPARTMENT - Asst. Chief Jerry Rowland and Scott Birch was pre- sent, Scott Birch said the Police Department recently received a memo banning smoking in all City Offices. Detective Birch said the ban presents a problem, in that, when interrogating people, some peopl, might talk better when smoking. Detective Birch proposed the officers that smoke, be allowed to, in their office, under the following four conditions: 1) Door closed. 2) Windows open. 3) Officer purchases an air filter at own expense. 4) No smoking when there is non-smoking individuals in their office. After discussion, Council decided to allow officers to smoke in their offices under the four conditions. Councilman Quick suggested arrangements be made, so the council can tour the Police Department to see capibility of computer. Council will come to next Council Meeting at 6:30 p.m. At 9:55 p.m., Councilman England moved, Councilman Landon seconded, with full council approval to adjourn meeting. Ron C.
