COUNCIL MEETING MINUTES
November 13, 1990
Minutes of regular meeting held in the city municipal building,
November 13, 1990.
Present: Mayor John O. Cotant, Jr., Council members Leroy S. Quick,
Steven N. England, David A. Landon, W. Dean Wood, Attorney
Thomas J. Holmes, Public Works Director Steven M. Smart and
City Clerk Ron C. Conlin.
Meeting was called to order at 7:32 p.m. by Mayor John O. Cotant.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or
additions to the Special Meeting Minutes of October 23, 1990,
Regular Meeting Minutes of October 23, 1990, .Special Meeting
Minutes of October 30, 1990 and Special Meeting Minutes of
November 7, 1990.
Councilman Wood moved to approve Special Meeting Minutes of
October 23, 1990 as read. Councilman England seconded. All
council members present voted in favor of motion.
Councilman Landon moved to approve Regular Meeting Minutes of
October 23, 1990 as read. All council members present voted
in favor of motion.
Councilman England moved to approve Special Meeting Minutes
of October 30, 1990 as read. Councilman Landon seconded. All
council members present voted in favor of motion.
Councilman Landon moved to approve Special Meeting Minutes of
November 7, 1990 as read. Councilman Wood seconded. All
council members present voted in favor of motion.
PUBLIC HEARING - ORDINANCE - Amending Chubbuck Municipal Code
Section 18.04 to define self-service storage facilities;
amending Chubbuck Municipal Code Section 18.08.040 to provide
for a self-service storage facility in the schedule of Land
Use Controls.
Mayor Cotant read ordinance in full for first reading.
Mayor Cotant declared public hearing open,
Mayor Cotant asked for comments for, or against the ordinance,
there being none, Mayor Cotant closed the public hearing.
Mayor Cotant stated he would like more comments from
residents, Mayor suggested the ordinance be tabled until the
November 27, 1990 Council Meeting,

EXTENSION OF APPROVAL OF BRINGHURST PRELIMINARY PLAT - Tim
Shurtliff presented a letter of request to the council,
requesting extension of approval of Bringhurst Preliminary
Plat, approved March 13, 1990.
Mr. Shurtliff requested the approval of the preliminary plat,
be extended another six months, so there is time to complete
the final plat, construction drawings, etc.
PWD Smart recommended extension of approval of the Bringhurst
Preliminary Plat.
Councilman England moved to extend approval of Bringhurst
Subdivision Preliminary Plat for an additional six months.
Councilman Landon seconded. All council members voted in favor
of motion.
ORDINANCE #345 - Amending Section 5.04.020 of the Chubbuck
Municipal Code to increase the annual business license fee.
Mayor Cotant read Ordinance #345 in full for first reading.
Councilman England moved to dispense with rule of reading
Ordinance #345 on three separate days. Councilman Landon
seconded. Roll Call Vote: Quick, yes; England, yes; Landon,
yes; Wood, yes.
Councilman England moved to adopt Ordinance #345 as read.
Councilman Wood seconded. Roll Call Vote: Quick, yes; England,
yes; Landon, yes; Wood, yes.
ORDINANCE ~346 - Providing for technical corrections to Ordinance
#333, which added Chapter 8.24 "Property Maintenance" to the
Chubbuck Municipal Code.
Attorney Holmes read Ordinance ~346 by title only.
Councilman England moved to adopt Ordinance #346 as read.
Councilman Wood seconded. Roll Call Vote: Quick, yes; England,
yes; Landon, yes; Wood, yes.
SIDEWALK ORDINANCE Adding Chapter 8.28 to provide for the
construction of sidewalks and curbs; to provide for the
assessment of the cost of construction against the property
owner.
Attorney Holmes read ordinance in full for second reading.
Councilman England suggested the appeal clause in 8.28.040 (a)
be lengthened.

Attorney Holmes was directed to draft an appeal process that
wi]] extend the process, so as to protect residents that
might have extenuating circumstances.
Bill Slaven, 147 W. Linden expressed concern about residents
that might not have financial means to install sidewalks if
required.
Council decided to table the sidewalk ordinance until November
27, 1990 Council Meeting.
ORDINANCE - Amending Chubbuck Code Section 9.20.061 to change the
civil penalty for animals running at large from $10.00 to
$20.00 for each occurrence and from $15.00 to $25.00 if not
paid within ten days.
Attorney Holmes read ordinance in full for first reading.
Council was in agreement, the fine for running at large should
be higher than the proposed raise of $20.00 per occupance,
after 10 days, $25.00.
After discussion, it was decided the running at large
ordinance will be discussed at Staff Meeting, with Animal
Control Officer in attendance.
The ordinance will be presented at the November 27, 1990
Council Meeting.
BID - SALE OF 1980 SANITATION TRUCK WITH PACKER - PWD Smart stated,
with the purchase of the new sanitation truck, the city is in
position to sell our 1980 Sanitation truck with attached
packer.
PWD Smart stated sa]e of the 1980 Sanitation Truck was
advertized for sale, with bids to be received until November
6, 1990.
PWD Smart said we received on bid from Metro-Quip Co., Boise,
for $7,001.00.
Councilman England moved to approve sell of 1980 CT8000 Ford
Cab & Chassis, with attached packer to Metro-Quip. Co., Boise
for $7,001.00. Councilman Quick seconded. All council members
voted in favor of motion.
CITY
STREET FINANCE REPORT - City Clerk Ron C. Con]in has prepared
the City Street Finance Report. Idaho Code requires approval
of City Street by Council, with certification by Mayor Cotant.

After discussion, Councilman Landon moved to approve the City
Street Finance Report and authorized certification of the same
by Mayor Cotant. Councilman Wood seconded. All council members
voted in favor of motion.

DISCUSSION ABOUT UTILITY RATES TO SUPPORT 1990-91 FISCAL YEAR
BUDGET -
Bill Slaven, 147 W. Linden said he could live with a sewer
increase, because of the situation with Pocatello, but, he
thought any water increase will make us way too high.
Mayor Cotant explained, with increased costs the City is
receiving, regulations, etc., these costs have to be passed
on.
Discussion about possibility of billing owners for sewer
and water installed by vacant lots. We could collect on
rolls if bills not paid.

Discussion about the possibility of building our own sewer
plant.
After discussion, Councilman England moved to adopt the single
family equivalency method, when assessing sewer charges,
$10.50 single family equivalency, plus $.85 per thousand
gallons used. Councilman Landon seconded. All council members
voted in favor of motion.
At 10:10 p.m., Councilman Landon moved, Councilman Quick seconded,
with full council approval to adjourn meeting.
