COUNCIL MEETING MINUTES
October 23, 1990
Minutes of regular meeting held in the city municipal building,
October 23, 1990.
Present: Mayor John O. Cotant, Jr., Council members Steven M.
England, David A. Landon, W. Dean Wood, Attorney Thomas J.
Holmes, Public Works Director Steven M. Smart and City
Clerk Ron C. Conlin.
Meeting was called to order at 7:30 p.m. by Mayor John O. Cotant.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or
additions to the minutes of October 9, 1990.
Councilman Wood moved to approve minutes of October 9, 1990
as read. Councilman England seconded. All council members
present voted in favor of motion.
CERTIFICATE OF RECOGNITION - Mayor Cotant presented Ryan Weston
and Brian Beech with Certificate of Recognition for their
participation, taking 1st. and 5th. respectively, in the 9 and
10 year World Age Group Power Tumbling Games in Oillenbach,
Germany.
PROCLAMATION - EARLY INTERVENTION WEEK - Mayor Cotant read the
proclamation in full.
Jan Todd, 2297 Tonja Lane, Pocatello was present to ask Mayor
Cotant to attend a proclamation signing with Mayor Angstad at
the Human Development Center, ISU, on November 8, 1990. Mrs.
Todd stated Governor Andrus is going to sign the proclamation
in Boise, on the same day.
Mayor Cotant proclaimed November 11th. - 17th, 1990 as "Early
Intervention Week".
DONATION TO CHUBBUCK BANK SHELTER - Liz Johnson, West One Bank was
present to donate $500.00 to the Chubbuck Band Shelter.
DAY CARE PROVIDER LICENSE - After School Today/SEIOAA/Mary Harker,
has applied for license to operate a day care center at
Chubbuck School, 5045 Hawthorne Rd.
Mary Harker, 783 Boyd gave a report on how the after school
day care program operates.
Councilman England moved to approve a day care provider
license to After School Today/SEICAA/Mary Harker to operate
an after school day care service at Chubbuck School, 5045
Hawthorne. Councilman Landon seconded. All council members

present, voted in favor of motion.
CABLE COMMISSION MEETING REPORT - Mary Harker stated things are
running more smoothly between TCI and Cable Commission, now
we know refunds on tax overcharge, will go to residents.
Mrs. Harker stated TCI will keep the interest on tax monies
collected, to pay for TCI's litigation costs.
HAWTHORNE HAUNTED HOUSE Fire Chief Cary Campbell presented to
Mayor Cotant and Council a list of suggested requirements for
the Hawthorne Haunted House.
After discussion, Councilman Landon moved to approve a
business license to operate a Haunted House on Hawthorne Road
subject to the following conditions:
1. City of Chubbuck must be named as an additional
insured on liability policy.
2. Required to turn off external loud speaker at 10:00
p.m.
3. Activities will be completed at midnight on weekends,
11:00 p.m. on week nights.
4. No smoking by the public will be allowed, this
includes the entire area from Hawthorne Road east.
5. No alcoholic beverage during the time Hawthorne House
is open to the public.
6. The south driveway shall be kept clear and maintained
for emergency vehicles at all times.
Councilman Wood seconded. All council members present voted
in favor of motion.
CLAIMS - Computer print-out and hand check claims presented to
Mayor Cotant and Council.
Councilman Landon moved to approve computer print-out and hand
check claims as read. Councilman Wood seconded. All council
members present voted in favor of motion.
ORDINANCE - An ordinance, adding Chapter 8.28 to provide for the
construction of sidewalks and curbs; to provide for the
assessment of cost of construction against the property owner.
Mayor Cotant read the ordinance in full for first reading.
After discussion, Council decided to table the ordinance
until, November 13, 1990 Council Meeting.

ORDINANCE #344 - An ordinance, amending Section 5.04.020 of the
Chubbuck Nunicipal Code to provide for recovery of costs
incurred in investigating applicants for business licenses,
to require proof of an Idaho Sales Tax Number by applicants.
Attorney Holmes read Ordinance ~344 in full for the second
reading.
Councilman Wood moved to dispense with the rule of reading
Ordinance #344 on three separate days. Councilman Landon
seconded. Roll Call Vote: Quick, absent; England, yes; Landon,
yes; Wood, yes.
Councilman England moved to adopt Ordinance #344 as read.
Councilman Landon seconded. Roll Call Vote: Quick, absent;
England, yes; Landon, yes; Wood, yes.
CITY
PER DIEM ALLOWANCES - PWD Smart stated the city council
approved an increase in per diem expenses for meals. Since
then PWD Smart came across an article in the Idaho Cities
report referring to the per diem's set by the State of Idaho.
PWD Smart suggested the Council adopt the State's rates for
meals.
After discussion, Councilman England moved to adopt the same
policy as the State on per diem allowances. Councilman Wood
seconded. All council members present voted in favor of
motion.
GENERAL DISCUSSION -
Day Cares with less than 6 children - Mayor Cotant
suggested the city require a license, with a police
background check required.
At 8:40 p.m., Councilman Landon moved, Councilman England seconded,
with full council approval
to a~djourn meeting.
