COUNCIL MEETING MINUTES
October 29, 1991
Minutes of a special meeting held at the city municipal building,
October 29, 1991.
Present: Mayor John O. Cotant, Council members Steven M. England,
David A. Landor, W. Dean Wood, Attorney Thomas J. Holmes and
Public Works Director Steven M. Smart. Councilman Leroy S.
Quick was excused.
Meeting was called to order at 5:20 p.m. by Mayor Cotant.
PURPOSE OF MEETING is to; 1) Public Hearing - Vacate Candindagua
Rd. in Bar-X Tracts Subdivision. 2) Moratorium - Mobile Manor
Subdivision. 3) SICOG Agreement.
PUBLIC HEARING - An application by Robert D. Orchard, Mary Orchard,
Jerry Morrison, Micky Morrison and Shelia Morrison to vacate
Canindagua Road in Bar-X Tracts Subdivision, it is situated
within the area of city impact. The public hearing is being
held by authority of I.C. 50-1306A.
Mayor Cotant declared the public hearing open.
Jerry Morrison, 14390 Promise Lane explained to Mayor Cotant
and Council why he wanted Canindagua Road vacated.
Mayor Cotant asked if there was anyone present, against
vacating Canindagua Road. They was nobody against.
Mayor Cotant declared the public hearing closed.
Councilman Wood stated most of the roads in the subdivision
have been vacated. ,
Councilman Landor moved to vacate Candindagua Road
Tracts Subdivision. Councilman Wood seconded. All
members present voted in favor of motion.

SZCOG AGREEMENT - Mayor Cotant and PWD Steve Smart recommended the
Council enter into agreement with SICOG.
The cost of entering into the agreement will be approximately
$700,00 a year.
Councilman Wood moved to direct Mayor

PROPOSED ORDZNANCE - An ordinance amending Chapter 15,20 "Building
Moving" to clarify its applicability to production buildings,
clarifying the time limits and what needs to be done within
those time limits after a permit to move a building ie
granted.
The moratorium the Council put on second hand homes moving
into Mobile Manor Subdivision is in effect 30 days, through
November 12th., !991.
Mayor Cotant read the proposed ordinance for discussion.
Jim Thilmont, 2705 Lois Lane expressed concern, liability is
being put on the property owner, it should be the mobile home
owners responsibility. Mr. Thitmont said the way laws are
now, it is really expensive and takes time to evict a tenant.
Mayor Cotant said the proposed ordinance affects mobile home
subdivisions only, not trailer parks.
Rodney Panfish, 689 E. Chubbuck Rd. asked, how will the
City inspect mobile homes coming in from out of State.
Bart Panfish, 229 Panfish Lane stated, when the City sent out
letters advising residents they are required 'bo clean up their
property, it was much more effective, than when the property
owner tells the tenants to clean up.
Discussion about surety bond required by proposed ordinance.
Mayor Cotant stated we are trying to protect the property
owners in a subdivision.
FC Campbell said, if there is nothing wrong with the
structure, we do not get involved. Zf the mechanical has been
altered, we have the night to ask that problems be corrected.
Rodney Parrish said the only mobile homes coming into the City
are second hand, the new mobile homes are so expensive, the
payments are as expensive as purchasing a new home.
Rodney Panfish said he has no objection to bringing a second
hand mobile home to mobile home code, but it impossible to
bring a mobile home to the Uniform Building Code.
Attorney Holmes was directed to make necessary changes
discussed tonight, and present to the Council at a Special
Meeting, Tuesday, November 6, 1991 at 5:30 p.m.

At 7:00 p.m., Councilman England moved, Councilman Wood seconded,
with full council1 approval to adjourn meeting.

of the City of Chubbuck, Idaho, hereby ca]]s a specfial meeting of
the City Council to be held at the Chubbuck Municipal Building, a%
