COUNCIL MEETING MINUTES
October 22, 1991
Minutes of regular meeting held in the city municipal building,
October 22, 1991.
Present: Mayor John O. Cotant, Council members Steven M. England,
David A. Landor, W. Dean Wood, Attorney Thomas J. Holmes,
Public Works Director Steven M. Smart and City Clerk Ron C.
Conlin. Councilman Leroy S. Quick was excused.
Meeting was called to order at 7:35 p.m. by Mayor Co%ant.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or
additions to minutes of October 8, 1991.
Councilman Wood moved to approve minutes of October 8, 1991
as read. Councilman Landor seconded. All council members voted
in favor of motion.
BUSINESS LICENSE APPLICATION - Robert Betty, Squires Car Club has
applied for license to operate a haunted house at 4500
Hawthorne Rd.
Mayor Cotant and Council reviewed conditions required on last
years approval. There were no complaints received last year.
After discussion, Councilman Landor moved to approve a
business license to operate a Haunted House on Hawthorne Rd.,
subject to the following conditions:
1. City of Chubbuck must be named as an additional
insured on liability policy.
2. Required to turn off external loud speaker at 10:00
3. Activities 'will be completed at midnight on weekends,
11:00 p.m. on week nights.
4. No smoking by the public will be allowed, this
includes the entire area from Hawthorne Rd. east.
5. No alcoholic beverage during the time Hawthorne House
is open to ti~e public.
6. The south driveway shall be kept clear and maintained
for emergency vehicles at all times.
Councilman Wood seconded. All council members present voted
in favor- of motion.

ORDINANCE ¢360 - An ordinance providing for a change of Land Use
District with respect to certain lands within the boundaries
of the City of Chubbuck located in Section 3, Township 6
South, Range 34 E.B.M., from limited Residential (R-2) to
General Commercial (C-2).
Mayor' Cotant read ordinance in full for first reading.
Councilman Wood moved to dispense with the rule of reading
Ordinance ¢360 on three separate days. Councilman England
seconded. Roll Call Vote: Quick, absent; England, yes; Landor,
yes; Wood, yes.
Councilman Landor moved to adopt Ordinance ~360 as read1
Councilman Wood seconded. Roll Call Vote: Quick, absent;
England, yes; Landor, yes; Wood, yes.
FINDINGS OF FACT, CONCLUSIONS OF LAW AND DECISION for a change in
Land Use District for real property described on Exhibit "A"
at 207 Briscoe, from (R-2) to (C-2) and for a conditional use
permit to park construction equipment and vehicles on the real
property located at 207 Briscoe Rd.
Councilman Wood moved to adopt the Findings of Fact and
Conclusion of Law for change of Land Use District and
Conditional Use Permit at 207 Briscoe as presented. Councilman
Landor seconded. All council members present voted in favor
of motion.
CLAIM - Cheri Wells, 502? Rose Street presented a claim to the City
of Chubbuck in the amount of $355.00 for Doctor bills,
prescriptions and personal embarrassment.
After discussion, Councilman England moved to direct City
Clerk Ron Conlin to forward the claim to City Insurance Co.
Councilman Wood seconded. All council membeFs present voted
in favor of motion.
FINANCIAL REPORT for month of August presented to Mayor Cotant and
Council.
MORATORIUM STATING NO SECOND HAND HOMES WILL BE MOVED INTO MOBILE
MANOR SUBDIVISION - Mayor Cotant and City Officials have received
many complaints from property and home owners residing in
Mobile Manor Subdivision of the condition of various homes
that have been located in or could be located in the
subdivision. Mayor Cotant declared that an emergency exists
due to the moving of second hand homes into Mobile Manor
Subdivision, pending further investigation by the City
Council, this moratorium will be in effect for 30 days.

Land Use and Development Commission was invited to this
meeting,
The moratorium was placed on Mobile Manor because it is the
only mobile home subdivision in the city, The moratorium does
not include mobile home parks.
Mayor Cotant suggested the Council look at adopting
ordinance that would govern standards for second hand
mobile homes.

Mayor Cotant suggested we contact the Attorney General's
Office to see what a City is allowed to require.
Mayor Cotant said city ordinance requires a mobile home, or
home moved in the City, be brought to code within 90 days of
time it is moved in, this ordinance will be enforced.
Mayor Cotant stated residents will be notified and asked for
input, prior to an ordinance being adopted. City will look at
several ordinances around the area.
Discussion about Restrictive Covenants. City cannot enforce
Restrictive Covenants.
Mayor Cotant suggested the Council meet with residents in
Mobile Manor to discuss problems and possible solutions,
during a Special Meeting, Tuesday, October 29th., 1991 at 5:15
p.m. in City Council Chambers.
PROPOSED REDISTRICTING PLAN - A petit;on requesting the Legislative
Reapportionment Committee, presently commissioned by the 1991
Idaho Le91slatur'e to draw a plan for redistricting the State
of Idaho, to draw the redistricting plan in a manner which
will keep the City of Chubbuck in one Legislative district.
Mayor Cotant suggested a Resolution be adopted supporting the
plan.
After discussion, it was decided a letter of support of the
proposed redistricting plan will be prepared then signed by
Mayor Cotan~ and Council. Councilman Quick is in Boise, and
said, if he can get the letter of support, he will present it
on behalf of the Council.

explanation of the proposed redistricting plan.
CABLE COMMISSION REPORT - Mary Harker and Carol Stoddard, Chubbuck
Cable Commission Representatives were present %0 give a report
on Cable Commission Meeting.

Mayor Cotant reported Carol Stoddard is resigning as City of
Chubbuck Cable Commission Member as of January I, 1992.
Attorney Holmes atated he will review the current cable
ordinance.

with full council approval to adjourn meeting.
