HomeMy WebLinkAbout06 25 1991 CM85 COUNCIL MEETING MINUTES June 25, 1991 Minutes of regular meeting held in the city municipal building, June 25, 1991, Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, David A. Landon, W. Dean Wood, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 7:35 p.m. by Mayor Cotant. APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions to the minutes of June 11, 1991, and Special Meeting Minutes of June 21, 1991. Councilman Wood moved to approve the minutes of June 11, 1991 as read. Councilman Landon seconded. All council members voted in favor of motion. Councilman Landon moved to approve Special Meeting Minutes of June 21, 1991 as read. Councilman England seconded. All council members present at the meeting voted in favor of motion, POLICE OFFICERS SWORN IN - Chief of Police Jerry Rowland introduced the new D.A.R,E. Officer, Steve Hieb, Patrolman Mark Jones and Patrolman Ron Cotton. City Clerk Conlin swore in the Police Officers. NOBAMPO SPEED LIMIT RECOMMENDATIONS - Mayor Cotant and Council invited all residents west of Yellowstone Ave. to this meeting for comments regarding the NOBAMPO speed limit recommendations. Letters from Van Vanderwood, John and Jill King and Shauna Miller opposed any raise in the speed limit on Hawthorne Rd. Mayor Cotant stated the comments received from residents in this area are opposed to raising the speed limit. Mayor Cotant said after comments received from a prior meeting, the only street that should be raised is Hiline Road, possibly Whitaker Rd. Residents on Whitaker Road are opposed to any speed limit raise. Attorney Holmes was directed draft an ordinance, raising the speed limit on Hiline Rd, to 35 miles per hour. 87 NOBAMPO SPEED LIMIT RECOMMENDATIONS - (cont.) Oouncilman Quick suggested preparing a letter advising residents on Whitaker Rd. the speed limit will stay the same, with the Police Department patrolling the street. Councilman England suggested Whitaker Rd. speed limit be put on the agenda for discussion in approx, six months. COMPUTER BIDS - City of Chubbuck received bids for computer hardware and software on May 23rd. at 2:00 p.m. City Clerk Conlin was directed to check with Amerisys to be sure 1) Their hardware maintenance bid of $1,000.00 per year was correct. 2) Full maintenance on all hardware which includes, computer, terminals and printer. Larry Christensen, Data Solutions representing Computer Software Co. and Howard Voss, Amerisys Co. was present to answer any questions Mayor Cotant and Council might have. The following bids were presented: AMERISY. COMPUTER SOFTWARE CO. HARDWARE UNISYS $ 13,045.00 $ 17,353.00 SOFTWARE FUND PACKAGE $ 23,600.00 $ 36,645.00 HARDWARE MAINTENANCE $ 3,984.00 $ 18,600.00 $ 36,253,00 $ 392.00 Difference $ 6,600,00 $ 2,676.00 Difference City Clerk Conlin suggested the City go with Amerisys. based on past experience and confidence on how they have handled prior computer needs for the City. Amerisys. Co., including hardware maintenance over a five year period is $2,284.00 less than Computer Software Co. After considerable discussion, Councilman Quick moved to accept the low bid of $40,629.00, this includes hardware maintenance for a five year period. Councilman Landor seconded. All council members voted in favor of motion. DAMAGE CLAIM - Ellen Watson, 14251 W. Wallin Rd. presented a claim stating she was traveling south on Hwy. 91, when a rock hit and broke her side window. Officer Jim Phelps investigated, he said, the rock was thrown by the weed eater. Councilman England moved to pay the claim of repair of Ellen Watson's window. Councilman Wood All council members voted in favor of motion. $212.05 for seconded. DAMAGE CLAIM - Gall Higgins, RemWest presented a claim to the City in the amount of $1,038.32 for damage at 120 Burnside. Mrs. Higgens stated the sewer backed up and damaged 33.56 yards of carpet. PWD Smart said someone vandalized a sewer manhole, which caused the sewer to back up. After discussion, Councilman Wood moved to turn the claim to Insurance Designers, City's Insurance Co. for determination of liability. Councilman Quick seconded. All council members voted in favor of motion. SKATEBOARD ORDINANCE - An ordinance adding Section 9.08.151 to the Chubbuck Municipal Code to prohibit the use of skateboards, roller blades and roller skates in certain areas of the City. Chief of Police Rowland said there have been complaints from the Pine Ridge Ma]] of skateboarders doing damage to their flower boxes, etc. However, Mayor Cotant received a letter from the Bon Marche'saying they have never had a problem with skateboarders or roller skaters. Councilman England suggested we amend proposed ordinance to cover posted areas only, then discuss at the July 9, 1991 Council Meeting. SMALL DAY CARE ORDINANCE - An ordinance amending Section 18.04.050 (E), 8.04.050(E), 18.12.030(G)(1)(n), 6.04.030 and 6.04.040 to provide that any place where child care is provided to less than five (5) children for compensation, shall be treated as a minor home occupation. Fire Chief Cary Campbell was directed to publish some suggestions of what residents should do if they want to operate any kind of child care center. After discussion, Council decided not to proceed with this ordinance. 91 ORDZNANCE - CURB, GUTTER~ SIDEWALK, STREETS AND LANDSCAPING - It was decided to discuss this ordinance at Staff Meeting. ORDINANCE ¢355 - An ordinance amending Chapter 8.04 of the Chubbuck Municipal Code to clarify the authority of city staff to remove weeds; to allow for successive removal of weeds in one notice. Mayor Cotant read Ordinance #355 in full for first reading. Councilman England moved to dispense with rule requiring Ordinance ¢355 to be read on three separate days. Councilman Wood seconded. Roll Call Vote: Quick, yes; England, yes; Landor, yes; Wood, yes. Councilman Wood moved to adopt Ordinance ~355 as read. Councilman Quick seconded. Roll Call Vote: Quick, yes; England, yes; Landor, yes; Wood, yes. CLAIMS -Computer print-out and hand check claims presented to Mayor Cotant and Council. Councilman Wood moved to approve computer print-out and hand check claims, Councilman England seconded. All council members voted in favor of motion. GENERAL DISCUSSION - 1. Retirement Party for Arnold Stone, Saturday June 29, 1991 at Days Inn, 7:00 p.m. 2. Chubbuck Days discussion - Chubbuck Days on June 28th. and June 29 at Cotant Park. 3. Pocatello Pioneers Baseball Game, Chubbuck Night, June 29th. at 7:00 p.m. Mayor Cotant and Council invited. Fire Chief Cary Campbell stated the State Fire School went well. Over 500 people attended festivities at Cotant Park. Food was served from concession stand. PWD Smart passed to Mayor Cotant and Council a Community Involvement Plan on slag, Council was asked to get comments to Mayor Cotant. Attorney Holmes will draft a letter with City of Chubbuck response. Girls Softball Awards Program is at Stuart Park, Thursday at 6:00 p.m. Mayor Cotant and Council are invited to help serve. 7. Considerable discussion about proposed 1 percent initiative and effect on City budget. City of Chubbuck will loose 93 GENERAL DZSCUSSZON - (cont.) approx. $70,000.00, if one percent initiative is adopted again, 8. Discussion about running our own animal control facility, on City property. This would have to be put as far away from City residents as possible. At 9:20 p.m., Councilman Quick moved to go to executive session meeting .to discuss litigation on condemnation of Rodney Parrish property north of City Offices, as authorized by Idaho Code 67-2345 (f). Councilman Wood seconded. 100% of council members voted in favor of motion. Quick, yes; England, yes; Landon, yes.; Wood, yes. Attorney Holmes gave a update on litigation on condemnation of Rodney Parrish property north of City Offices. Attorney Holmes reported the trial is postponed until July 29th., 1991. NO action or final decision was made. At 10:00 p.m., Councilman Wood moved to adjourn from executive session meeting to regular meeting. Councilman Landon seconded. All council members voted in favor of motion. At 10:01 p.m., Councilman England moved, Councilman Wood seconded, with full council approval to adjourn meeting. Ron C.
