COUNCIL MEETING MINUTES
May 28, 1991
Minutes of regular meeting held in the city municipal building,
May 28, 1991.
Present: Mayor John O. Cotant, Council members Leroy S, Quick,
Steven M. England, David A. Landon, W. Dean Wood, Attorney
Thomas J. Holmes, Public Works Director Steven M. Smart and
City Clerk Ron C. Conlin.
Meeting was called to order at 7:25 p.m. by Mayor Cotant.
INVOCATION was given by Bishop Joe Chapman, Chubbuck 6th. Ward,
Church of Jesus Christ of Latter-Day Saints.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or
additions to the minutes of May 14, 1991.
Councilman Wood moved to approve the minutes of May 14,
1991 as read. Councilman England seconded. All council members
voted in favor of motion.
APPOINTMENT OF CHIEF OF POLICE AND ASSISTANT CHIEF OF POLICE - City
Clerk Ron Conlin swore in Jerry L. Rowland as Chief of Police
and Richard Webb as Asst. Chief of Police,
BUSINESS LICENSE APPLICATION - Joseph Jensen, Eagle Marketing, 285
Adams has applied for license to sell door to door in the
City of Chubbuck.
Mr. Jensen as not present at meeting.
The application was tabled until Mr, Jensen can attend
meeting.
JERRY FETZER, 541 CANAL - Mrs. Fetzer said she lost her job
with Best Friends, and would like to start a dog grooming
business at her address. Mrs. Fetzer stated she talked to Cary
Campbell, he said this is not allowed in a residential
area.
Mrs. Fetzer said she went to all her neighbors, they did not
have objection to this type of business in the area.
Attorney Holmes read the ordinance, then stated, unless
oouncil amended the ordinance, this use is not allowed in
residential area.
After discussion, Mayor Cotant and Council said the staff will
proceed with doing what is required, to allow a dog grooming
business, with a conditional use permit in residential areas.

RECYCLING - OTMAR WEHRLI - MR. DELI, PINE RIDGE MALL - Mr. Wehrli
stated he is trying to recycle everything possible, and would
like to see everyone get involved in some recycling program.
Mr. Wehrli said the most important aspect of recycling is
educating the public. Mr. Wehrli stated it will be better if
we take hold now, rather than waiting until we are mandated.
PWD Smart said the problem Pocatello has had, is residents do
not separate the sanitation properly, it is costly having city
crews separate. If the sanitation is separated properly by the
resident, the costs can be recovered.
Mayor Cotant stated, the City will proceed in trying to find
ways to recycle.
NOBAMPO SPEED LIMIT RECOMMENDATIONS - Mayor Cotant and Council
invited residents from Hiline Rd., from Chubbuck Rd north to
city limits, Hiline Rd. from Chubbuck Rd. south to city
limits and Whitaker Rd. from Chubbuck Rd. north to city
limits for comments about proposed speed limits. Joe Olson,
NOBAMPO was present to respond to questions.
Mayor Cotant said he received several comments from drivers,
Whitaker speed limit is too slow.
Residents on Whitaker Rd. said the problem is school bus
drivers, delivery trucks and teachers are speeding on Whitaker
Rd.
Velbert Jackson stated residents on Whitaker Rd. like the
lower speed limit, they do not want the speed limit on
Whitaker Rd. changed.
Mr. Olson said NOBAMPO did radar speed studies on roads
requested. The studies are accepted traffic engineering
principals used all over the country. Mr. Olson gave a report
on how proposed limits are arrived at. Mr. Olson stated, just
because the limit is raised, it does not mean the driver
drives that much faster.
Residents on Whitaker Rd. suggested better police patrol to
correct speeding on Whitaker Rd.
Residents present did not have a problem with Hiline Rd. speed
limit being raised to 35 miles per hour.
Concern expressed about several school bus stops on
Whitaker Rd., if the speed limit is raised, there will
that much more chance of an accident.

Mayor Cotant thanked residents for their comments,
a decision will not be made without residents on
Whitaker Rd. knowing about it.
and said
SKATEBOARD ORDINANCE - An ordinance adding Section 9.08.151 to the
Chubbuck Municipal Code to prohibit the use of skateboards,
roller blades and roller skates.
Council will review and discuss at June 11, 1991 Council
Meeting.
ORDINANCE - SMALL DAY CARE - An ordinance amending Section
18.04.050(e), 18.12.030(g)(1)(n), 6.04.030 and 6.04.040 to
provide that any place where child care is provided to less
than five (5) children for compensation, shall be treated as
a minor home occupation.
Council will review and discuss at June 11, 1991 Council
Meeting.
RESOLUTION ¢6-91 - A resolution that requires the City of chubbuck
to designate the local emergency response authorities.
Mayor Cotant read resolution in full.
Councilman England moved to adopt Resolution $6-91

RESOLUTION ¢7-91 Whereas, the Idaho Transportation Department,
Division of Highways, hereafter called the State, has
submitted an Agreement stating obligations of the State and
the Cities of Chubbuck and Pocatello, Idaho for the
construction of improvements to U.S. 91, Quinn Road, and Pole
Line Road intersections, including draining grading, base and
surfacing, sidewalk, curb and gutter.
Mayor Cotant read resolution in full.
Councilman Wood moved to adopt Resolution ¢7-91 as read.
Councilman England seconded. All council members voted in
favor of motion.
BUSINESS LICENSE APPLICATION - Yong Uk Hah, 230 W. Chubbuck Rd.
~A-2 has applied for license to sell T-Shirts from the Green
Triangle parking lot.
After discussion, Councilman Wood moved to approve a business
license to Yong Uk Han, 230 W. Chubbuck Rd. to sell T-Shirts
at the Green Triangle parking lot.

CLAIMS - Computer print-out and hand check claims presented to
Mayor Cotant and Council.
Councilman Wood moved to approve computer print-out and hand
check claims as read. Councilman Landon seconded. All council
members voted in favor of motion,
GENERAL DISCUSSION -
Residents on Whitaker Rd. complained of sewer or gas smell
along Whitaker Rd. PWD Smart stated he felt it could be
the sewer causing the problem.
2. Discussion about nominations for Business Man of Year,
Citizen of Year and Jr. Citizen of the Year.
3, Mayor Cotant and Council invited to be on Channel 12, June
4, 1991 at 7:00 p.m. for an hour.
At 9:30 p.m., Councilman England moved, Councilman Quick seconded,
with full council approval to adjourn meeting.
