September 8, 1992
Minutes of regular meeting held in the city municipal building,
September 8, 1992.
Present: Mayor John O. Cotant, Council members Leroy S. Quick,
Steven M. England, David A. Landon, W. Dean Wood, Attorney
Thomas J. Holmes, Public Works D~rector Steven M. Smart and
City Clerk Roe C. Conlin.
Meeting was called to order at 7:35 p.m. by Mayor Cotant.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or
additions to Regular Meeting Minutes of August 25, 1992.
Councilman Wood moved to approve regular meeting minutes of
August 25, 1992 as read. Councilman Landor seconded. All
council members voted in favor of motion.
OFFICIAL OATH - Chief of Police Jerry Rowland ~ntroduced and City
Clerk Roe Conl]n administered Official Oath to newly hired
police officers: Marty Frasure, Greg Lobdell, Jean Higgens
and Larry Grossman.
RAILROAD CAR FOR STORAGE - MELVIN JACKSON - WHITAKER ROAD -
Mr. Jackson stated his property is screened with trees, and
asked if he could put two railroad cars for storage on his
property on Whitaker Rd.
Mr. Jackson said he can put the railroad cars back in the 300'
area, which is zoned Industrial (I), ~f he had to.
After discussion, Mr. Jackson was directed to apply for a
conditional use permit.
CLAIM CLYDE HARRIS - BROKEN WINDSHIELD Ctty Clerk Conl]n
reported to council, Mr. Harris was dF~v~ng by Cotant Park
when a ball was thrown by a member of an out of town team,
shattering his windshield.
City Clerk Conlin said the claim was filed with City Insurance
Company, they paid all but the $100.00 deductible, Mr. Harris
~s asking for the rest of the clalm to be paid. Mr. Harris had
only l~ability coverage on the vehicle.
Councilman Wood made motion to pay the $100,00 deductible
claim presented by Clyde Harris, 1048 N. Hayes for a broken
windshield. Councilman Landor seconded. All council members
voted in favor of motion.

MASSAGE PARLOR ORDINANCE - An ordinance defining and establishing
standards for the practice of massage or massage therapy;
requiring additional information for business license
purposes.
Attorney Holmes read Massage Parlor Ordinance by title, for
the second title reading.
Council decided to table the Massage Parlor Ordinance until
the September 22, 1992 Council Meeting.
CHUBBUCK DAY DISCUSSION - Councilman Wood presented a 1993 Chubbuok
Days Celebration Schedule.
Council was in favor of Councilman Wood chairing the 1993
Chubbuck Days Celebration.
Councilman Wood will meet and coordinate with Chubbuck
Baseball.
Chubbuck Days will be June 25 and June 26, 1993.
MUNICIPAL AUDIT LETTER OF UNDERSTANDING - Jones, Yost & Hart
presented a quote of $2,800.00 for the 1991-92 Fiscal 'Fear
Audit.
Councilman Landor moved to direct Mayor Cotant to enter into
agreement with Jones, Yost & Hatt for preparation of the 1991-
92 Fqscal Year Audit, Councilman England seconded. All council
members voted ]n favor of motion.
TANABE LAND PURCHASE PROPOSAL - Mayor Cotant stated George Shiozawa
approached the City about purchase of land north of city land.
PWD Smart stated Mr. Shiozawa presented a proposal of
$150,000.00 for the 17 acres.
Mayor Cotant stated the City will have to make a decision to
commit to the purchase of land for future uses, th~s is a good
Investment, land will most likely not decrease in value. Can
we afford the purchase of the property w~th the budget
constraints we face now.
PWD Smart presented the boundaries of the land.
Council was in favor of Mayor Cotant continuing meeting with
George Shiozawa, negotiating a purchase price on the property.
PWD Smart stated the chances of getting a grant are better if
we own the property when applying.

Possibility of recouping some monies from leasing land for
farming prior to development.
Mayor Cotant stated he will meet with George Shiozawa
tomorrow, and present further discussion at the September 21,
1992 Council Meeting.
VIOLATION OF FENCE REQUIREMENT - Mrs. Hernandez, 4600 Hlllne Rd.
Space 74, Briarwood Mobile Home Court explained how and why
she Installed the wood fence on her property. MFS.
Hernandez passed pictures to Mayor Cotant and Council
showing the fence does not block traffic view.
FC Campbell stated the fence does not comply with the fence
ordinance, which requires the fence cannot be over 3' within
the first 10' of fence.
Attorney Holmes was directed to research, to see how much
authority the City has on private property.
POLICE PERSONNEL POLICY - Police Chief Jerry Rowland explained to
council the 7 (k) Plan (FLSA Section 70vertqme Polqcy).
Councilman England moved to adopt the addition to Police
Personnel Policy 7(k) Plan. Councilman Landor seconded, All
council members voted in favor of motion.
RECOMMENDED CHANGES IN PERSONNEL POLICY - Mayor Cotant suggested
the councit meet w~th employees and discuss vacation, sick
leave policy.
Discussion about abusing sick leave policy.
GENERAL DISCUSSION -
PWD Smart stated the Council should meet and consider
increasing utility rates. PWD Smart said the current rates
are not meeting the needs. PWD Smart was d~rected to
prepare requests and present to the Council.
CLAIMS - Computer print-out claims presented to Mayor Cotant and
Council.
Councilman Quick moved to approve computer print-out claims
as presented. Councilman Landor seconded. All council members
voted in favor of motion.
