COUNCIL MEETING MINUTES
January 28, 1992
Minutes of regular meeting held in the city municipal building,
January 28, 1992.
Present: President of Council Steven M. England, Council members
Leroy S. Quick, David A. Landor, W. Dean Wood, Attorney Thomas
J. Holmes, Public Works Director Steven M. Smart and City
Clerk Ron C. Conlin. Mayor John O. Cotant was excused.
Meeting was called to order at 7:31 p.m. by President of Council
Steven M. England.
APPROVAL OF MINUTES Mayor Cotant asked for corrections or
additions to regular meeting minutes of January 14th., 1992.
Councilman Quick moved to approve regular meeting minutes of
January 14th., 1992 as read. Councilman Landor seconded. All
council members voted in favor of motion.
ORDINANCE ~365 - Adding definition of screening fence and solid
fence to the General Land Use definitions of Chapter 18.04,050
of the Chubbuck Municipal Code, amending Section 18.12.020 (c)
to provide solid fences around commercial structures or uses
bordering residential areas maybe a minimum of six feet in
height and further pro¥iding that the determination of
sufficient landscaping or screening to satisfy the buffer
requirements shall be by the building inspector or the
building official subject to review by the Land Use and
Development Commission and the City Council; amended Section
18.12.030 (e) of the Chubbuck Municipal Code to require a
minimum six foot solid fence at drive inn establishments
bordering residential property or residentially zoned areas;
amending Chapter 18,12,030 (h) of the Chubbuck Municipal Code
to provide for screening fences around kennels; amending
Chapter 18.12,030 (j) to provide for screening fences around
outdoor storage areas for commercial and industrial products;
amending Chapter 18.12.030 (k) of the Chubbuck Municipal Code
to provide for solid fences between a production building
cluster arrangement and adjoining property; amending Chapter
18.12.030 (n) of the Chubbuck Municipal Code to provide for
screen fences around vehicle storage sites; amending Chapter
18.12.040 (d) of the Chubbuck Municipal Code to provide for
solid fences around certain trash areas; amending solid fences
around certain trash areas; amending 18.12.040 (e) to provide
fences shall normally be six foot high, but granting the
building official or building inspector discretion to
authorize a fence height of up to eight feet based upon
certain factors.

There was no comment for, or against the ordinance.
Councilman Landor moved to dispense with the rule of reading
Ordinance ~365 on three separate days. Councilman Wood
seconded. Roll Call Vote: Quick, yes; England, yes; Landor,
yes; Wood, yes.
Councilman Wood moved to adopt Ordinance ¢365 as read.
Councilman Landor seconded. Roll Call Vote: Quick, yes;
England, yes; Landor, yes; Wood, yes.
APPLICATION FOR REZONE - STAN LEBSACK, 4692 BURLEY DRIVE -
Jennifer Gortari, 4692 Burley was present on behalf of Stan
Lebsack, 4692 Burley Dr., and requested the Council table the
application for rezone, until the February 11th., 1992 Council
Meeting, when Mr. Lebsack can be present.
Councilman Quick moved to table the application for rezone
until Mr. Lebsack can be present at the February 11th., 1992
Council Meeting. Councilman Wood seconded. All council
members voted in favor of motion.
PROPOSAL TO PROVIDE SOLID WASTE COLLECTION SERVICES FOR THE CITY
OF CHUBBUCK -
Jami Jones, Snake River Sanitation, Inc. presented the
following proposal to the Council:
Residential - Provide house to house service with each
residence using a ninety five (95) gallon OTTO refuse
cart. Based on the City's established rate for
residential collection we will charge $5.50 per OTTO
Cart.
B. Commercial
1) Front Load Containers 2yds. to 8yds.
2yd. container $24.00/mon
3yd. $36.O0/mon
4yd $48.00/mon
6yd. $64.00/mon
8yd. $76.00/mon
Rate is based on size of container,
and one day a per week/wk. More than
one day a week service is available.
2) Roll Off's are available.
Councilman Wood suggested the council needs more detailed
information on how the system will fit into the City's budget.

PWD Smart was directed to present to Mayor Cotant and Council
a comparison between Snake River Sanitation, Hunter
Enterprises, and our current system.
PWD Smart stated, if the Council is interested after reviewing
comparisons, the city will advertize for bid.
Wayne Baker, American Recycling presented a proposal with the
City using 3yd., 6yd. and 8yd. front load dumpsters. The
dumpsters would be serviced with a front load compactor truck,
owned by Snake River Sanitation. Snake River Sanitation is
willing to provide the dumpsters to the City, making sure they
are kept clean.
Mr. Baker proposed that two redemption centers be established
in the city. Separate containers for aluminum, steel cans,
newspaper and card board, others can be added. Snake River
Sanitation will pick up the dumpsters, take to American
Recycling, weigh and the City would receive a portion of
the revenue. No cost to the City.
Discussion about federal government regulations.
Council will review.
ORDINANCE - An ordinance adding Chapter 15.32 to the Chubbuok
Municipal Code providing for new commercial uses of property
to comply with existing ordinance regarding curb, gutter,
sidewalk, streets and landscaping.
Ordinance was read by title only for the third reading.
Councilman Wood expressed concern of putting burden of cost
of having to comply with ordinance on new property owners that
might not have the monies. Councilman Wood said at this time,
you cannot get financing on existing buildings.
Discussion about deferral fee required.
Kent Kearns, Land Use and Development Commission Chairman
stated the Land Use and Development Commission looked at the
ordinance and asked, what is the long term goals of the
City of Chubbuck.
After discussion, the Council tabled the ordinance until the
February 11, 1992 Council Meeting.

ORDINANCE An ordinance amending Section 18.12.040 (f) of the
Chubbuck Municipal Code to the vision triangle restrictions
on a driveway by a street right-of-way.
President of Council England read the ordinance by title only
for the third reading.
Fire Chief Cary Campbell and Building Inspector Rex Orgill
suggested the ordinance be presented to the Council, because
the current ordinance is difficult to understand.
Councilman Quick stated he received several
concern about the ordinance. Councilman

After considerable discussion, the council decided not to
adopt the proposed vision triangle ordinance.
ORDINANCE - MOBILE HOME PARK - Adding a Section 15.36.060 to the
Chubbuck Municipal Code to require mobile home park owners and
operators to notify the city building department within five
(5) days of a unit moving into that park.
Councilman Wood expressed concern, Mobile Manor Subdivision
lot owners be required to notify the city. Councilman Wood
said the subdivision is different, in that each lot is
individually owned.
President of Council England read proposed mobile home park
ordinance by title only for the third reading.
Council decided to table the ordinance until the February 11,
1992 Council Meeting.
APPLICATION FOR DAY CARE EMPLOYEES - Dora Thorton, 204 Mingo Lane,
Shauntel D. Jones, 534 Warren and Klm Hemperly, 265 Melrose,
Pocatello have applied for license to be day care employees
at The Wizard Day Care & Learning Center, Pine Ridge Mall,
4155 Yellowstone Ave.
Police Department gave approval to the police records check.
Councilman Wood moved to approve day care employee licenses
to Dora Thorton, 204 Mingo, Shauntel D. Jones, 534 Warren,
Pocatello and Kimberly Hemperly, 265 Melrose, Pocatello,
employed at The Wizard Day Care & Learning Center. Councilman
Landor seconded. All council members voted in favor of motion.

CLAZMS - Computer print-out claims presented to the Council.
Councilman Landon moved to approve computer print-out claims
as read. Councilman Wood seconded. All council members voted
in favor of motion.
At 10:00 p.m., Councilman Landon moved,
with full council approval
