Cotant, Council members Leroy S. Quick, Steven M. England, Marvin C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. PLEDGE ALLEGIANCE TO THE FLAG APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions to Regular Meeting Minutes of December 8t`., 1998. Councilman Kearns moved to approve Regular Meeting Minutes of, December 8"1 ., 1998 as read. Councilman Gunter seconded. All council members voted in favor of motion. PUBLIC HEARING - An application by Heritage Development, P.O. Box 2684, Pocatello, Idaho for a change of Land Use District, upon requested annexations to Single Family Residential, (R -1) for property located, north of Lexington Street, (Heritage West Subdivision). (Section 4, Township 6 South, Range 34 East, SW 1/4). Tim Shurtliff, 426 W. Lewis was present to explain the zoning change request. Tim Shurtliff stated he will get a description of property to Attorney Holmes. Mayor Cotant declared the public hearing open, there being no comment, Mayor Cotant declared the public hearing closed. Councilman Kearns stated this is one of the first uses of a hammerhead on a dead end street. This follows the standards established by Fire and Police Departments. Project Engineer Gerd Dixon explained the hammerhead on a dead end street concept. Councilman Quick moved to accept the Land Use & Development Commission's recommendation to approve a change of Land Use District, upon requested annexation, to Single Family Residential, (R -1) for property located, north of Lexington Street, Heritage West Subdivision. Councilman England second. All council members voted in favor of motion. PUBLIC HEARING - An application by American Heritage, Inc. 609 West Maple Street, Pocatello, Idaho 83201, for a preliminary plat for Heritage West Subdivision No. 6. A subdivision located north of Lexington Street, (Heritage West Subdivision). Section 4, Township 6 South, Range 34 East, SW 1/4). 3 COUNCIL MEETING MINUTES - (cont.) January 12th., 1999 PUBLIC HEARING - PRELIMINARY PLAT - (cont.) Tim Shurtliff, 426 West Lewis presented and answered questions regarding the proposed preliminary plat. Mayor Cotant declared the public hearing open, there being no comment, Mayor Cotant declared the public hearing closed. Councilman Kearns moved to accept the Land Use & Development Commission's recommendations to approve the Heritage West Subdivision No. 6, a subdivision located north of Lexington Street, (Heritage West Subdivision). Section 4, T6S Range 34E SW 1 /4.Councilman Quick seconded. All council members voted in favor of motion. SEWER BACKUP DAMAGE ON CANAL STREET - PWD Smart gave a memorandum to Mayor Cotant and Council in regards to a Water Main Break and Subsequent Sewer Back Flow into 12 property owners residences, along Canal and Kevin Streets. PWD Smart explained, that about midnight, December 18- 19th., 1999 the city experienced a water main break on Canal Street. While excavating down to the leak, the pipe shifted, allowing a nearly full stream of water to gush from the pipeline and excavation into the street. Because of an error in locating and turning off mainline valves, this water ran of several hours before the valve was finally located and turned off. Our inexperienced crew upon seeing the flood water rise over the curb and across the sidewalk, and seeming to climb higher and higher became concerned about the rising water and removed a sanitary sewer manhole cover near the intersection of Canal and Kevin Streets. This allowed large quantities of water to enter the ser system. Which raised the hydraulic gradient to appoint where at least 12 homes received water damage from sewage backed up into their basements. Mayor Cotant asked for comments from residents on Canal and Kevin Streets. Neal Warner, 740 Canal Street complimented City Workers involved. Neal Warner expressed concern that the City should have taken more interest, by coming the next day and looking for themselves what had happen. Mr. Warner suggested some sort of contingency plan be prepared for future incidents such as this. Mr. Panko, 770 Canal explained the incident and how it affected in his family. Mr. Panko stated, the insurance adjuster has been difficult to deal with, Mr. Panko suggested the Council rectify the concerns, he felt City Representatives have not handled the damage claims properly. Discussion about developing a contingency plan. 5 COUNCIL MEETING MINUTES - (cont.) January 12`h., 1999 SEWER BACK UP DAMAGE DISCUSSION - (cont.) Mayor Cotant suggested Council get a list from each property owner concerning their losses. Neal Warner, 740 Canal Street expressed concern about property owners depreciation value of their homes, because of requirement to declare that their home has been flooded, at time of home sale. Attorney Holmes stated, this is a one time occurrence, hopefully this should not have an affect on the sale of a home. Mayor Cotant said, City will check into. PWD Smart gave an explanation of City of Chubbuck on call procedures. Trina Stewart, Kevin Street expressed concern their basements had raw sewage, the only thing they were told by the City, was if your lights flicker, you might want to leave the house. Mrs. Stewart stated there was no mention of extreme contamination. Mrs. Stewart said the property owners had to get their own information from cleaning people. Concerned about depreciation of homes, because of being flooded by sewer, it does not matter if it is one time or five times. Mrs. Stewart stated she was disappointed the City did not advise them on what to do. Mrs. Stewart stated the City Insurance Company has not been easy to deal with. Mrs. Stewart asked, in the future, information be available to help the property owner in these cases. Mrs. Friel, 750 Canal expressed concern property owners were not notified in a timely manner of health risks. Ivan Bloxham, 5165 Kevin expressed concern the City Insurance Company is dragging their feet. Discussion about Mr. Bloxham's sheet rock in his basement. Ronald Straley, 813 Canal expressed concern about the way the City Insurance Adjuster is prorating the damage. Mr. Straley asked the Council to get involved with the Insurance Adjuster to assure everything is covered. Anita Panko, 770 Canal did not approve of the way City of Chubbuck Office Employees and City Insurance Adjuster have handled the claims. Mayor Cotant suggested the City keep in touch with each property owner individually to see what takes place at each home. Mayor Cotant stated, Council will meet with City Insurance Adjuster and keep property owners notified. 7 COUNCIL MEETING MINUTES - (cont.) January 126., 1999 ORDINANCE - To allow trained massage therapists as a home occupation, to clarify massage by an untrained person is not allowed. Attorney Holmes read ordinance by title only for the second reading. Council tabled ordinance until the January 26`x., 1999 Council Meeting. ORDINANCE #502 - Providing for a change of Land Use District with respect to certain lands within the boundaries of the City of Chubbuck - Campolotarro, 435 E. Chubbuck Road, Slaven, 147 W. Linden Ave. and City of Chubbuck, 156 and 204 Hiway Ave. Mayor Cotant read Ordinance #502 by title only for the first reading. Councilman Quick moved to dispense with the rule of reading Ordinance #502 on three separate days. Councilman Gunter seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes. January 12th., 1999 GENERAL DISCUSSION - 1. Discussion about Idaho Survey and Rating City of Chubbuck received - City is a Class III Rating now. 2. Discussion about requirements for Fire Rating. 3. Mayor Cotant suggested a Council Study Session Tuesday, at 5:30 p.m., January 26th., 1999.
