COUNCIL MEETING MINUTES
October 12", 1999
Minutes of a regular council meeting held at the Chubbuck City Council Chambers, October 12' ",
1999.
Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin
C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven
M. Smart and City Clerk Ron C. Conlin.
Meeting called to order at 7:30 p.m. by Mayor Cotant.
PLEDGE ALLEGIANCE TO THE FLAG
APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the Regular
Meeting Minutes of, September 28`", 1999.
Councilman Kearns moved to approve the minutes of September 28", 1999 as read,
subject to typo corrections, Councilman Quick seconded. All council members voted in
favor of motion.
HANSEN ACRES SUBDIVISION FINAL PLAT - PWD Smart stated the preliminary plat has
been approved by both Bannock County and Chubbuck City Council. This Hansen Acres
Final Plat has been approved by Bannock County.
Discussion about accesses to the property.
Councilman England moved to approve the Hansen Acres Subdivision Final Plat,
Councilman Kearns seconded. All council members voted in favor of motion.
PTA PROCLAMATION - Mayor Cotant read the PTA Proclamation in full.
Councilman Kearns moved to direct Mayor Cotant to proclaim October as PTA Month,
Councilman Gunter seconded. All council members voted in favor of the motion.
ORDINANCE - Regarding two entire Chapters of the Chubbuck Municipal Code, Chapter 2.16
establishing the Municipal Improvements and Services Advisory Board and Chapter 2.32
establishing the Chubbuck Cable Commission.
Attorney Holmes read ordinance in full for the second reading.
Council tabled the ordinance until the October 26", 1999 Council Meeting.

ORDINANCE #518 - Providing for a change of Land Use District with respect to certain lands
within the boundaries of the City of Chubbuck. 706 Washburn, legally described as
Lot 13, Block 4 of Mountain Park Subdivision.
Attorney Holmes read Ordinance #518 in full for the first and final reading.
Councilman Kearns said he felt that zone changes should be driven by the
Comprehensive Plan. The map he has, shows the land use districts. Councilman Kearns
stated that by adopting this ordinance, it would create a kind of a bubble zoning. PWD
Smart explained the map Councilman Kearns is looking at is a zoning map, which is
different than the Comprehensive Plan map. The Comprehensive Plan map is much more
general.
Councilman Gunter moved to dispense with rule of reading Ordinance #518 on three
separate days, Councilman England seconded. Roll Call Vote: Quick, yes; England, yes;
Gunter, yes; Kearns, no. Motion passes
Councilman England moved to adopt Ordinance #518 as read, Councilman Gunter
seconded. Roll Call Vote: Quick, yes; England, yes Gunter, yes; Kearns, no. Motion
passes.
RESOLUTION #7 -99 - GENERAL CITY ELECTION - Mayor Cotant read Resolution #7 -99 in
full.
Councilman Gunter moved to adopt Resolution #7 -99 as read, Councilman Quick
seconded. All council members voted in favor of motion.
CLAIMS - Computer print -out claims presented to Mayor Cotant and Council.
Councilman Gunter moved to approve computer print -out claims as presented,
Councilman Kearns seconded. All council members voted in favor of motion.
At 7:50 p.m., Councilman England moved to go into executive session meeting as authorized by
Idaho Code 67 -2345 (b) to discuss employee evaluation, Councilman Quick seconded.
Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes.
Discussion about employee salaries as compared to other comparable city's in the State.
No final action or decision was made.

At 8:40 p.m., Councilman Kearns moved to adjourn to regular meeting, Councilman England
seconded. All council members voted in favor of motion.
GENERAL DISCUSSION -
Councilman Kearns gave a report on E. Chubbuck Road residents comments on the
possibility of a local improvement district on their portion E. Chubbuck Road.
Residents asked what improvements would be made: 1) Curb, gutter and sidewalk on
both sides of street. 2) Park or Recreation of some type. 3) Widen East Chubbuck
Road east of Hiline Road to three lane. Discussion about who all will be included in
paying to the local improvement district.
2. PWD Smart gave a report about on Siphon Road sewer back up.
3. Councilman Gunter asked what is happening at Mike Scott's Subdivision. Councilman
Gunter said there is a road that is blocked off with weeds, etc. blocking the paved
street. Councilman Gunter suggested the road be opened up. PWD Smart said we can
require them to open the street. City Staff will check out.
4. Councilman Kearns said he received a request from the Mary Harker, Chubbuck Pride
Committee saying they had a hard time coming up with the Community Citizen
Award this year. Chubbuck Pride came up with the idea of awarding it to the Portneuf
District Library. Council had no objection to the request.
At 9:10 p.m., Councilman Gunter moved, Councilman England seconded, with full council
approval to adjourn meeting.
