COUNCIL MEETING MINUTES
March 23'd., 1999
Minutes of a regular meeting held at Chubbuck City Council Chambers, March 23'x, 1999.
Present: Mayor John O. Cotant, Council members Steven M. England, Marvin C. Gunter, B.
Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and
City Clerk Ron C. Conlin. Councilman Leroy S. Quick was excused.
Meeting was called to order at 7:30 p.m. by Mayor Cotant.
PLEDGE ALLEGIANCE TO THE FLAG lead by Doug Cranor.
INVOCATION was given by Pastor John Robinson of Gate City Christian Church.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions to the Regular
Meeting Minutes of, March 9'''., 1999.
Councilman Kearns moved to approve Regular Council Meeting Minutes of, March 9'''.,
1999 as read. Councilman Gunter seconded. All council members present voted in favor
of motion.
APPEAL OF POLICE DEPARTMENT'S DECISION TO DENY A DAYCARE EMPLOYEE
LICENSE TO BRENDA PEACE - APPLYING TO WORK AT FUN TIME KIDS DAYCARE -
Police Chief Jerry Rowland presented Council in writing, reasons why the daycare
employee license was denied. 1. Failure to disclose on the application, a battery citation
issued in July of 1997, which involved battery in a domestic violence situation.
Chubbuck Code, Chapter 6, Section 6.04.180.2) Being found or pled guilty to a
misdemeanor involving domestic violence. (Section 6.04.180).
Brenda Peace, 2445 South Second, Pocatello presented letters from the Manager of Fun
Time Kids Day Care, Carmen Flockhart and Fun time Kids Day Care Employee Kim
French stating, Brenda Peace would be a good daycare employee.
Brenda Peace explained to Mayor Cotant and Council how the battery citation and
misdemeanor involving domestic violence occurred. Mrs. Peace stated she works for
School District #25 now, she had to complete an application similar to this, she included
the information on the School District #25 application, but just forgot to include on the
City of Chubbuck's application. Mrs. Peace stated she was convicted of a DUI charge.
Councilman England suggested a periodic review with Brenda Peace, if approved.

Discussion about how long a misdemeanor might stay on an applicant's record.
Councilman Gunter moved to grant a daycare employee license to Brenda Peace, Fun
Time Kids Day Care, subject to a review by Police Department, two times in the first six
months. If the reviews are okay, Brenda Peace will be reviewed the same as all approved
day care employees. Councilman England seconded. All council members presented
voted in favor of motion.
PAWN SHOP BUSINESS LICENSE APPLICATION - Donn Cooper, Double D Gun & Pawn
has applied for a business license to operate a pawn shop at 4818 Yellowstone Ave.
Donn Cooper presented the City with a License and Permit Bond of $10,000., as required
by Code.
Councilman Kearns moved to grant Donn Cooper, Double D Gun & Pawn Shop, 15071
W. Reservation Road, Pocatello, Idaho a business license to operate a pawn shop at 4818
Yellowstone Ave. Councilman Gunter seconded. All council members present voted in
favor of motion.
1997 -98 FISCAL YEAR AUDIT - City Auditor Scott Jones presented the 1997 -98 Fiscal Year
Audit to Mayor Cotant and Council.
Councilman Kearns moved to accept the 1997 -98 Fiscal Year Audit as presented by City
Auditor Scott Jones. Councilman England seconded. All council members present voted
in favor of motion.
FINANCIAL REPORT for month of February, 1999 presented to Mayor Cotant and Council.
CLAIMS - Computer print -out claims presented to Mayor Cotant and Council.
Councilman England moved to approve computer print -out claims as presented.
Councilman Kearns seconded. All council members voted in favor of motion.
At 8:25 p.m., Councilman England moved, Councilman Kearns seconded, with full council
approval to adjourn meeting.
