COUNCIL MEETING MINUTES
June 29"'., 1999
Minutes of a regular council meeting held at the Chubbuck City Council Chambers, June 29`h
1999.
Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin
C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven
M. Smart and City Clerk Ron C. Conlin.
Meeting called to order at 7:30 p.m. by Mayor Cotant.
PLEDGE ALLEGIANCE TO THE FLAG was lead by Alan D. Romriel.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions to the Regular
Meeting Minutes of June 8h.,1999.
Councilman Kearns moved to approve Regular Council Meeting Minutes of June 8, 1999
as read. Councilman Quick seconded. All council members voted in favor of motion.
ORDINANCE #510 -To change the definition of a Class Il Production Building, to amend the
schedule of Land Use Controls to define a Class II Production Building as a permitted
use in certain residential districts. Making a technical correction to Section 15.20.010 as
enacted by Ordinance #473, amending 18.12.030, (k), (6) to change the front and rear
yard set backs for existing production building cluster arrangements.
Mayor Cotant asked for comments from public.
Bob Lurker, 4839 Whitaker Road stated he felt residents of the City did not understand
the publications of Ordinance #510, and objected to any further movement of the
Ordinance #510, until such time more research can be done on the matter. Mr. Lurker
said he attended the Land Use & Development Commission and first Council Meeting
and felt the public and Council did not understand what Ordinance #510 is doing. Mr.
Lurker suggested the City Council rewrite the City Code prior to adopting Ordinance
#510. Mr, Lurker presented a petition with 120 signatures; 1) Asking for a
comprehensive review of all existing residential codes. 2) Adoption of revised residential
codes combining the requirements of traditional site built homes with homes
manufactured off site. 3) Adoption of a uniform residential building code in compliance
with both State and Federal Mandates.
p-•. Alane Hale, 4825 Whitaker Road stated she felt the same way Mr. Lurker felt. Mrs. Hale
expressed two concerns 1) About set backs in Ordinance #510 being too close, 2)
Concern about the age of mobile homes allowed in R -2 residential area.

Melvin Jackson, 5101 Whitaker road suggested the Council take more time looking at the
code prior to adopting Ordinance #510.
K. C. Gibbs, 426 E. Chubbuck Road said he has two acres of property, he wants to put a
manufactured home on his property, he has ordered the home, it cost him $80,000.00.
Mr. Gibbs said he is going to put the manufactured home on his property no matter what.
Attorney Holmes explained what Ordinance #510 will do, if Council decides to adopt it.
Geri Barnard, 210 W. Chubbuck Road #82 suggested the Council read the final draft of
Ordinance #510.
Ross Minson, 4840 Whitaker Road expressed concern about manufactured homes going
in length way. Mr. Minson said this would give the appearance of a trailer court.
Steve Vigliaturo, 1745 Granite Drive explained his plans for property he is developing on
Whitaker Road. Mr. Vigliaturo said he is trying to develop a nice subdivision.
Mayor Cotant asked Mr. Vigliaturo if he would consider, in his Restrictive Covenants, a
section that requires the manufactured homes to be set facing the street, rather than length
way. Mr. Vigliaturo and Gary Chisum stated he would not have a problem with that.
Jody Underwood, 5441 Shenandoah stated the reason she moved to the area is because of
the looks of the homes in the area. Jody Underwood spoke against Ordinance #510.
Wayne Hale, 4825 Whitaker Road stated reasons he is not in favor of the Council
adopting Ordinance #510.
Mayor Cotant, Councilman England and Attorney Holmes read Ordinance #510 in full.
Councilman England moved to dispense with the rule of reading Ordinance #510 on three
separate days. Councilman Quick seconded. Roll Call Vote: Quick, yes; England, yes;
Gunter, yes; Kearns, yes.
Councilman Kearns moved to adopt Ordinance #510 as read. Councilman Gunter
seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Kearns, yes.

ORDINANCE- Adding Section 15.04.060 to require any residential structure built in an R -1, or
R72 zone to require a garage or carport.
Council decided to table the ordinance.
BID - EAST CHUBBUCK ROAD UTILITY IMPROVEMENTS PROJECT - PWD Smart
presented the following bids received:
Frasure Construction $121,861.51
Bannock Paving $191,971.91
Ferguson 4T Construction $194,686.00
Councilman Kearns moved to direct Mayor Cotant to enter into agreement with Frasure
Construction for the construction of East Chubbuck Road Utility Improvements Project.
Councilman England seconded. All council members voted in favor of motion.
BID - LICENSE AND SUPPORT AGREEMENT FOR COMPUTER SOFTWARE - City Clerk
Conlin explained the City received only one bid for Computer Software.
Caselle, Inc.
$50,135.00
Councilman Kearns suggested a company by the name of Info Systems, Pocatello be
contacted on the hardware portion of the Bid. Councilman Kearns suggested the
following be looked at:
1. Hard disk space.
2. 17" monitors instead of 15 ".
3. Auto Tone.
Councilman Quick moved to direct Mayor Cotant to enter into a Software License
Agreement with Caselle, Inc. Councilman Kearns seconded. All council members voted
in favor of motion.
CLAIMS - Computer print -out claims presented to Mayor Cotant and Council.
Councilman England moved to approve computer print -out claims as presented.
Councilman Kearns seconded. All council members voted in favor of motion.

approval to adjourn meeting.
