Minutes of regular meeting held at city municipal building,
November 22, 1994.
Present: Mayor John O. Cotant, Council members Leroy S. Quick,
Steven M. England, Marvin C. Gunter, W. Dean Wood, Public
Works Director Steven M. Smart and City Clerk Ron C. Conlin.
Attorney Thomas J. Holmes was excused.
Meeting was called to order at 7:30 p.m. by Mayor John O. Cotant.
APPROVAL OF MINUTES - Mayor John O. Cotant asked for corrections
or additions to Regular Meeting Minutes of November 8, 1994.
Councilman Quick moved to approve Regular Meeting Minutes of
November 8, 1994 as read. Councilman England seconded. All
council members voted in favor of motion.
BUSINESS LICENSE APPLICATION Darrell C. Pinney, Lawntech, DBA
Elves Christmas Forest has applied for license to sell
Christmas trees in Wal-Mart Parking Lot.
Police and Fire Departments suggested approval of the llcense.
Councilman Wood moved to approve a business license to Darrell
C. Pinney, Lawntech, DBA Elves Christmas Forest to sell
Christmas trees from the Wal-Mart Parking Lot. Councilman
Gunter seconded. All council members voted in favor of motion.
DON YOWELL WAS PRESENT SPEAKING FOR CHAD J. BAUM, 310 BRISCOE -
stated he purchased a piece of land with a house on it at 310
Briscoe Rd. The house was not in good shape, so Mr. Baum
decided to demollsh the home. Mr. Baum said he hoped to pour
a foundation and modular home set up in approximately the
same location the old house was. Mr. Baum said, being out of
town he did not realize he needed a Conditional Use Permit,
and how long it would take. Mr. Baum said not being able to
pour the foundation prior to being approved by the Land Use
& Development Commission Decision will set his plans back
almost a month, he is worried about the cold weather being a
problem. Mr. Baum asked for approval to pour the foundation
prior to the Land Use & Development Commission Decision.
PWD Smart stated the application will be presented to the Land
Use and Development Commission, December 8, 1994.
PWD Smart stated, most likely the application will be
approved, but there is always a possibility it will not.

Councilman England suggested this discussion trigger
discussion at the Land Use & Development Commission Meeting
about review of ordinance regulating mobile homes in
residential areas.
Councilman Gunter moved to allow Chad Baum, 310 Briscoe Rd.
to pour concrete for his foundation at 310 Briscoe Rd., prior
to the Land Use & Development Commission's Public Hearing on
the matter, December 8, 1994, subject to the Land Use &
Development Commission's final approval of the application.
Councilman Wood seconded. All council members voted in favor
of motion.
SAFETY POLICY - Attorney Holmes suggested the following
paragraph be added to the City Safety Policy:
"Anytime a City employee is involved in any type of
accident causing property damage, vehicle damage or personal
injury to anyone, no matter how minor, that employee as well
as that employee's immediate supervisor has a duty and
responsibility to notify that employee's department head as
well as the City's safety officer. This should be done within
48 hours of the occurrence unless it is a vehicle accident or
a major injury accident where an individual has to be
hospitalized or is killed, in which case the notification is
to be immediate and, if the city safety officer is not on
duty, any police officer is to be contacted so the accident
can be adequately investigated.
In addition to the supervisor's accident report, Form SIF17-
82 that is filed with the City, the City employee that is
involved in the incident shall give a detailed statement to
the investigating officer or City safety officer as to what
and how the accident happened.
Additionally, the employee and, if appropriate, the employee's
supervisor, shall detail what steps need to be taken by the
City and its employees so that type of incident is prevented
in the future".
Councilman England moved to incorporate the above paragraph
to City Safety Policy. Councilman Gunter seconded. All council
members voted in favor of motion.

RECIPROCAL FIRE FIGHTING ASSISTANCE AGREEMENT - between the U.S.
Department of Energy, City of Arco Fire Department, City of
Blackfoot Fire Department, City of Idaho Falls Fire
Department, City of Pocatello, City of Chubbuck, Fire
Department, City of Rexburg/Madison County Fire Department,
Jefferson Central Fire District Fire Department and City of
Rigby fire Department. ~
Council decided to table the agreement until the December 13,
1994 Council Meeting.
WATER AND SEWER UTILITY RATES Mayor Cotant suggested the
following rate reductions=
WATER RATES
1. Minimum shall be $10.00 with no water allowed.
2. All water used above the minimum shall be charged at the
rate of .60 per thousand gallons.
SEWER RATES
1. Reduced from minimum of S17.00 to
Council decided to table the suggestion until the December 13,
1994 council Meeting.
CLAIMS - Computer print-out claims presented to Mayor Cotant and
Council.
Councilman Gunter moved to approve computer print-out claims
as presented. Councilman Wood seconded. All council members
voted in favor of motion.
At 8:03 p.m., Councilman Wood moved, Councilman England seconded,
with full council approval to ad3ourn meeting.

Dear Sir:
My wife and I recently purchased a piece of land with a house on it at 310 Briscoe
Road in Chubbuck. The house was in a horrible state of disrepair but we thought, with a
little work, we could remodel it. A15er talking with some people in the construction field
and with Rex Orgill from the Chubbuck Fire Dept. we decided it would be best to have
the house demolished.
The house has been demolished and removed to the country landfill. We had
hoped to have a foundation and modular home set up in approximately the same location
the old house was in. We thought eveD-thing was well planned out and we would have
the foundation in before the weather got to cold, but we have come across a snag and we
were hoping you could help us.
Being from out of town we didn't realize we needed a Conditional Use Permit and
that we could only get approved for one by the city council on the first Tuesday of the
month. This would set our plans back almost a month and we are worried the cold
weather will become a problem.
Our friend Don Yowell has been helping us get everything coordinated for our
new home. He said, he talked to you about the delay and that you might be able to help us
get the foundation approved so we could at least have that done before the snow flies and
the weather tums colder. Don said you might be able to get us on the agenda this coming
Tuesday, November 22.
Anything you could do to help us with this problem would be greatly appreciated.
