COUNCIL MEETING MINUTES
October 25, 1994
Minutes of regular meeting held at city municipal building,
October 25, 1994.
Present: Mayor John O. Cotant, Council members Leroy S. Quick,
Steven M. England, Marvin C. Gunter, W. Dean Wood, Attorney
Thomas J. Holmes, Public Works Director Steven M. Smart and
City Clerk Ron C. Conlln.
Meeting was called to order at 7:30 p.m. by Mayor John O. Cotant.
APPROVAL OF MINUTES - Mayor John O. Cotant asked for corrections
or additions to Special Meeting Minutes of October 11, 1994,
and Regular Meeting Minutes of October 11, 1994.
Councilman Gunter moved to approve Special Meeting Minutes fo
October 11, 1994 as read. Councilman Wood seconded. All
council members voted in favor of motion.
Councilman Quick moved to approve Regular Meeting Minutes of
October 11, 1994 as read. Councilman England seconded. All
council members voted in favor of motion.
FINAL PLAT - MOUNTAIN PARK SUBDIVISION - PWD Smart presented Mayor
Cotant and Council with copies of the Mountain Park Final
Plat.
Discussion about Mountain Park Road going east and south.
Kent Kearns, 4831 Elizabeth Ave. stated the developers, at the
Land Use Meeting, were asked to widen the canal bank, this
will allow better visibility when entering Hlllne Rd.
Councilman Wood moved to approve the Mountain Park Subdivision
Final Plat as presented, sub3ect to 1) Mountain Park Rd. going
east, be renamed East Mountain Park Rd. 2) The canal bank on
Hlllne Rd. be widened where possible, so as to improve
visibility when vehicles enter on Hillne Road. Quick seconded.
All council members voted in favor of motion.
PETITION - AGAINST EAST CHUBBUCK ROAD INTERCHANGE - Jack Menard and
Wayne Taylor were present to present a petition, "Chubbuck
Citizens Against East Chubbuck Rd. Interchange to Mayor Cotant
and Council.

The Petition stated, the proposed interchange is poor
engineering to construct a new interchange within one-half
mile of the existing 1-15 to 1-86 Interchange. At present, E.
Chubbuck Rd. is extremely congested with traffic from
Highland High School, Bannock County Fairgrounds and
residential vehicles, the additional traffic off 1-15 will
only overwhelm the already congested Yellowstone-Chubbuck
Intersection.
Jack Menard, 909 E. Chubbuck Rd. suggested the Interchange
enter on Siphon Rd., rather than E. Chubbuck Rd. Mr. Menard
asked Mayor Cotant and Council to speak against the proposed
E. Chubbuck Rd. Interchange.
Mayor Cotant and Council were in favor of an interchange at
Siphon Rd., rather than E. Chubbuck Rd. location.
BEER, WINE AND LIQUOR LICENSE APPLICATION
Yellowstone Ave. has applied for license
and liquor at 4105 Yellowstone Ave.
Red Lobster, 4105
to sell beer, wine
Police Department recommended approval of the application.
Councilman Quick moved to approve a beer, wine and liquor
license to Red Lobster of Idaho, 4105 Yellowstone Ave.
Councilman Wood seconded. All council members voted in favor
of motion.
ORDINANCE - Amending Chapter 18.14 to define shrub size, require
sprinkler systems and require shrubs every five feet.
Attorney Holmes read ordinance by title only for the second
reading.
Council tabled the ordinance until the November 8, 1994
Council meeting.
ORDINANCE #429 - Adding Section 15.04.050, hours of operation to
the Chubbuck Municipal Code setting forth the hours of
construction and providing for exception.
Mayor Cotant read Ordinance #429 in full for the third and
final reading.
Councilm~n Gunter moved to adopt Ordinance #429 as read.
Councilman England seconded. Roll Call Vote: Quick, yes;
England, yes; Wood, yes; Gunter, yes.

ORDINANCE Enacting Chapter 10.24 truck routes; defining those
streets namely Yellowstone Highway and Siphon Rd within the
City upon which trucks may travel.
Mayor Cotant read ordinance for the second reading, by title
only.
Council tabled the ordinance until November 8, 1994 Council
Meeting.
PROCLAMATION - "WOMEN VETERAN'S RECOGNITION WEEK"
read the proclamation in full.

Councilman Wood moved to authorize Mayor Cotant to proclaim
November 6, 1994 through, November 13, 1994 as "Women
Veteran's Recognition Week". Councilman Quick seconded. All
council members voted in favor of motion.
AUTOMATED SANITATION COLLECTION - Council reviewed a comparison of
private contract to city ownership they received at the
October 11, 1994 Council Meeting.
PWD Smart stated if City goes to private contract automated
collections, the sanitation rates will stay the same for now.
Council was in favor of Snake River Sanitation providing the
containers to residents in the contract.
Council was in favor of ordering blue containers.
Jim Evans, Snake River Sanitation said he needs 30 day to six
weeks to get City set up with containers.
Discussion about pick up days in Chubbuck. Councilman England
suggested pick up days be Tuesday and Wednesdays. Mr. Evans
stated this will not be a problem.
Councilman England moved to direct Mayor Cotant to enter into
agreement with Snake River Sanitation for automated sanitation
collection, including Snake River Sanitation providing the
blue containers. Councilman Gunter seconded. All council
members voted in favor of motion.
CLAIMS - Computer print-out claims presented to Mayor Cotant and
Council.
Councilman Gunter moved to approve computer print out claims
as presented. Councilman Wood seconded. All council members
voted in favor of motion.
