Cotant, Council members Leroy S. Quick, Steven M. England, Marvin C. Gunter, W. Dean Wood, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 7:30 p.m. by Mayor John O. Cotant INVOCATION was given by Bishop Rick Hall, Chubbuck Second Ward, The Church of Jesus Christ of Latter Day Saints. APPROVAL OF MINUTES - Mayor John O. Cotant asked for correction~ or additions to Special Meeting Minutes of August 9, 1994, Regular Meeting Minutes of August 9, 1994 and Special Meeting Minutes of August 9, 1994. Councilman Gunter moved to approve Special Meeting Min~Ates of August 9, i994 as read. Councilman England seconded. All council members voted in favor of motlon, Councilman Quick moved to approve regular meeting minutes of Allgust 9, 1994 ss read. Councilman Wood seconded. All council members voted in favor of motion. Councilman England moved to approve special meeting minutes of August 16, 1994 as read. Councilman Gunter seconded. All council members voted In favor of motion. PUBLIC HEARING - 1994-95 FISCAL YEAR BUDGET - Mayor Cotant declared the public hearing open. Mayor Cotant explained the one increase in property taxes amounting to $157,3~3., is the creation of Chubbuck Police Dispatch System, the remaining $144,546. property tax increase is, Highway, Streets & Road Pro3ects. Mayor Cotant explained the proposed projects. John Boyle, expressed concern about the Interstate 86 landscaping going on~ when we are short of water and monies to maintain. Mayor Cotant explained the pro3ect is a Federal/State Pro3ect where costs are 8~% Federal/State; 2~% City match. _i89 1994-95 FISCAL YEAR BUDGET PUBLIC HEARING {cont.) There have been several individuals in the City wanting something done about the Interchange. Mr. Boyle expressed concern about the purchase of the street sweeper. Mayor Cotant explained the EPA is mandating the purchase of the sweeper. EPA says the sweeper the City is using now is not meeting the requirements. Mayor Cotant stated the sweeper is also an 80/20 match project. Dean Trumbeil, 937 Salmon was against the Interstate 86 Landscaping Project. Mr. Trumbell stated he is against drilling of wells, if the City cannot g~larantee the water will be under the DEQ levels. Discussion abo%lt sewer law suit with City of Pocatello. Dennis Harmers asked what when taxes are raised. Mr. increase. happens to the low income people Hanners stated he is against a tax Rick Carlsen, 4735 Chateau stated the City of Chubbuck is not equipped to handle these large charges of Federal and State mandates. Mr. Carlsen stated he is against a property tax increase. Councilman Quick explained the City of Chubbuck dispatching plans. The should be Just one dispatching center in the area, but, City of Pocatello and Bannock County is against a central dispatch. Diane Payne, 5~3~ Dorian stated she is in favor of City of Chubbuck doing our own dispatching, but concerned about why Bannock County is shoving City of Chubbuck out. Chief Rowland gave an explanation on costs of dispatching. Chief Rowland stated there is a one time cost of $45,000. for Bannock County dispatch this year, in this budget, that will not be in budget next year. Diane Payne expressed concern about proposed street light at E. Chubbuck Rd/Hiiine Rd intersection during winter time. Officer Steve Hleb stated sophomores at Highland High School will not be allowed to take their own vehicle to school next year, this will help. Discussion about EPA contamination levels requirements. Discussion about proposed water rate increase. 1994-95 FISCAL YEAR BUDGET - PUBLIC HEARING -(cont.) Discussion about the potential of Secondary Irrigation System. Mayor Cotant stated a secondary irrigation system will cost more now, but less expensive in the future. Roy Rhodes, 4431 Hawthorne Rd. was concerned because the cost~ of drilling wells had doubled from the time of public meetings at Ellis School, to now. PWD Smart stated the est. costs at that meeting were a rough estimate. After spendlng more time, consulting with other people, also adding to it, the cost of test wells, and distribution ilnes, the cost Just about doubled. Rich Marley, 5i50 Stuart suggested the City offer a level payment plan, that might help the lower income individuals. Discussion about Chubbuck Development Authority (tax increment financing). Mayor Cotant declared the public hearing closed. ORDINANCE #422 An ordinance appropriating the several sums of monies deemed necessary and sufficient to defray all expenses and liabilities of the City of Chubbuck, for fiscal year beginning the ist. of October, 1994 and ending on the 30th. day of September, i995~ designating the different fund~ to which shall be drawn and paid, and known as the "Annual Appropriation Ordinance of Fiscal Year, 1994-95" Mayor Cotant read Ordinance #422 in full for the first reading. Councilman England moved to dispense with the rule of reading Ordinance #422 on three separate days. Councilman Wood seconded. Roll Call Vote: Quick, yes; England, yes; Wood, yes; Gunter, yes. Councilman Gunter moved to adopt Ordinance #422 as read. Councilman Wood seconded. Roll Call Vote: Quick, yes; England, yes; Wood, yes; Gunter, yes. RESOLUTION #8-94 - Be it resolved that the City of Chubbuck request an amount of ad valorem tax revenues for its 1994-95 Fiscal Year Annual Budget that exceeds one hundred five per cent {1~5%). Mayor Cotant read Eesoiution #8-94 in full. Councilman Wood moved to adopt Resolution #8-94 as read. Counci[~h-'AQhl~~, ~cnnded. All council members voted in favor ]95 RESOLUTION #9-94 - Dollar certification of budget reqt~e~t to Bannock County Commissioners. Mayor Cotant read Resolution #9-94 in full. Councilman Quick moved to adopt Resolution #9-94 as read. Councilman England seconded. All council members voted in favor of motion. PUBLIC HEARING ORDINANCE #423 An ordinance to amend Section 17.12.050, to change fees for plat review, and to eliminate the requirement the developer distribute copies of the plat to public utilities, and affected governmental entit!em. President of Council Wood declared the public hearing open. Attorney Holmes read Ordinance #423 in full for the first reading. Councilman Wood asked for comment from publlc, there being no comment Co%lncilman Wood declared the public hearing closed. FINAL PLAT - LOTS 10-i3, BLOCK 8, HERITAGE WEST NO. 4 -PWD Smart stated all the construction aspects of this plat were previously approved, PWD Smart recommended the Final Plat be approved. Councilman England moved to authorize Attorney Holmes to prepare necessary ordinance to vacate Lots 1~-13, Block ~, Heritage West No. 4. Councilman Quick seconded. All council members voted in favor of motion. BiD - CHUBBUCK WASTEWATER COLLECTION SYSTEM IMPROVEMENTS - The bid opening for the project was held on August 18, 1994. The following two bids were received: B & C Construct,.on $183,211.35 H-K Contractors $237,054.00 197 CHUBBUCK WASTEWATER COLLECTION SYSTEM IMPROVEMENTS BID - (cont.) Eric Stewart, Stewart Engineering recommended the Council award B & C Construction the construction contract. Councilman Quick moved to accept B & C Construction's low bid of $183,211.35, authorizing Mayor Cotant to enter into contract with B & C Construction, Chubbuck, Idaho. Councilman Gunter seconded. All council members voted in favor of motion. BUSINESS LICENSE APPLICATION - Joseph Martlnez, J & V Tool Co. has applied for license to sell tools outside of local businesses in the City of Chubbuck. Police Department reviewed and approved the bYlsiness license application. After discussion, Councilman England moved to approve a business license to Joseph Martinez, J & V Tool Co. to sell tools. Councilman Gunter seconded. All council members voted in favor of motion. ORDINANCE Enacting Chapter 9.32, "Public defining what noises constitute a providing penalties for violations. Disturbance Noises;" public disturbance; President of Council Wood read the ordinance by title for the second reading. After discussion, Council decided to table the ordinance until September 13, 1994 Council Meeting. ORDINANCE - Amending Section 15.04.~3i to the Chubbuck Municipal Code to amend the Uniform Building Code to require Occ~]pancy Permits for all structures. President of Council Wood read ordinance by title only foe the second reading. After discussion, Council declded to table the ordinance until the September 13, 1994 Council Meeting. CLAIMS - Computer print-out claims presented to Mayor Cotant and Council. Councilman Quick moved to approve computer print-out claims as presented. Councilman England seconded. Box 5604 Chubbuck, Idaho 83202 RE: Chubbuck Wastewater Collection System Improvements Bid Opening Dear Steve: The Bid Opening for the above referenced project was held on August 18, 1994 at the Chubbuck City Hall. Two general contractors submitted bids. A bid tabulation is enclosed for your information. The apparent low bidder is B & C Construction, Inc. whose office is located in Chubbuck, Idaho. My conversations with Mr. Jerry Giesbrecht, Public Works Director for the City of American Falls and former public works director for the City of Aberdeen and Mr. John Millar, Consulting Engineer, indicated that B & C Construction have a very good reputation and have successfully comple~xt projects similar to the Chubbuck Project. My recommendation to the Chubbuck City Council is to award a construction contract to B & C Construction, Inc. for the Chubhnck Wastewater Collection System Improvement Project in the amount of $183,211.35. Two copies of the proposed contract is attached for council consideration at their regular city council meeting on August 23, 1994.
