July 26, 1994
Minutes of regular meeting held at city municipal building,
July 26, 1994.
Present: President of Council W. Dean Wood, Council menfoers Leroy
~. Quick, Steven M. Engtand, Marvin C. Gunter, Attorney
Thomas J. Holmes, Public Works Director Steven M. Smart and
City Clerk Ron C. Coniin. Mayor John O. Cotant was excused.
Meeting was called to order at 7:30 p.m. by President of Council
W. Dean Wood.
APPEOVAL OF MiMUTES President of Council Wood asked for
corrections or additions to regular meeting minutes of July
12, 1994.
Councilman Gunter moved to approve regular meeting minutes of
July 26, 1994 as read. Councilman Quick seconded. All cclvcil
members voted in favor of motion,
ORDINANCE - A proposal by the City of Chubbuck amending Section
i8.i2.$26 (d}, to provide tllat bay windows may extend into
the front yard setback up to two feet.
Councilman Wood read ordinance in full for the second reading~
Council tabled the ordinance until the August 9, 1994 Council
Meeting.
ORDINANCE - A proposal by the City of Chubbuck amending Section
i8.2~.~3~ to decrease the minimum area Fequlr_~J for a Planned
Unit Development; addlng Section i8.2~.~75 to define how
density is calculated in PUD.
Councilman Wood read ordinance by title only for the second
reading.
Council table the ordinance until the August 9, 1994 Council
Meeting.
ORDINANCE #418 Amending Section 9.2~.0i~ of ti%e Animal Control
Ordinance to eiiminate duplication, and 9.2~.03~ and 9.2~.03i
to provide strict liability for an animal owner who allows an
animal to run at large.

Councilman Wood read ordinance by title only for the third and
final reading.
Councilman England moved to adopt Ordinance #418 as read.
Councilman Gunter seconded. Roil Call Vote: Quick, yes~
England, yes; Wood, yes; Gunter, yes.

Councilman Wood read ordinance by title for the second

After discussion, Council tabled the ordinance until the

SEWER HOOK-UP REQUIREMENT - PW~, Smart stated, in 1993 he sent
letters to residents not connected to City Sewer ~ystem
advising them they are required to eonnect to City Sewer by
September, 1993.
Several residents arcund tile City have not responded.
Letters were sent to the following property owners: Marcia
Sullivan, 550 Homestead, Paul Kramer, 575 Homestead, Ronaid
Peterson, 576 Homestead, Floyd's Trophies~ 56~3 Yellowstone
Ave., Ralph Mickeison, 626 Boyd, Sam"s Body Shop, i3~ Ward.
PWD Smart stated the City can force the resident to connect~
if they won't the City carl install, ther~ bill the resident.
Councilman Wood suggested, when the property is sold, is ther~
way to require the sewer hook-up. Attorney Holmes stated we
can file a notice saying the property is not hooked to the
City Sewer System, most lending agencies require the property
be hooked to the sewer system. Attorney Holmes stated we
should notify the property owners, when they sell, this will
be required.
PWD Smart stated the Health Department might contact the City
before a permit is lss%~ed.
Councilman Quick s%~ggested these property owners be notified,
and invited to next Council ~[eeting.

1994-95 FISCAL YEAR BUDGET DISCUSSION - Police Chief Jerry Rowland
and Fire Chief Cary Campbell gave a report ,on theiF 1994-95
Budgets.
Police Chief Rowland presented proposed plans for City of
Chubbuck doing own dispatching. Chief Rowland stated the costs
now for doing our own dispatching, are high, but will level
off.
Chief Rowland stated he is asking for support, to do our own
dispatching from the Co~_~ncll.
Council was inagreement to give Chief Rowland okay to proceed
with City of Chubbuck Dispatch System.
City Clerk Coniin was directed to set Special Meeting, August
2, 1994 to discuss 1994-95 Flscai Year Budget.
CLAIMS - Computer print-cut claims presented to Council.
Councilman ,Quick moved to approve computer print-out claims
as presented. Councilman England seconded. All council members
voted in favor of mot!oil,
At 8:4e p.m., Councilman England moved, Councilman Quick seconded,
with full council approval to adjourn meeting.
