COUNCIL MEETING MINUTES
May 26, 1998
Minutes of a regular meeting held at the city municipal building, May 26, 1998.
Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin
C. Gunter, W. Dean Wood, Attorney Thomas J. Holmes, Public Works Director Steven
M. Smart and City Clerk Ron C. Conlin.
PLEDGE ALLEGIANCE TO THE FLAG
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions to Regular
Meeting Minutes of May 12'., 1998.
Councilman England moved to approve Regular Meeting Minutes of May 12'., 1998 as
read. Councilman Quick seconded. All council members present voted in favor of
motion.
ZONING CHANGE - HERITAGE DEVELOPMENT - An application by Heritage
Development, P.O. Box 2684, Pocatello, Idaho for a change in Land Use District, upon
requested annexation, to Limited Residential, (R -2) for property located at corner of
Siphon and Whitaker Roads. Property is presently zoned, Agricultural, (A).
This proposal was tabled from the May 12`h., 1998 Council Meeting.
Mike Bird, Heritage Development and Tim Shurtliff, Shurtliff Engineers were present to
answer any questions Mayor Cotant and Council had.
Discussion the following: 1) Irrigation Water. 2) Property to the northeast.
After discussion, Councilman Gunter moved to accept the Land Use and Development
Commission's recommendation to approve Heritage Development's proposal to change
the zoning, upon requested annexation to Limited Residential, (R -2) on Heritage
Development's property at Victorian Village, Whitaker Road. Councilman Quick
seconded. All council member voted in favor of motion.
PRELIMINARY PLAT - VICTORIAN VILLAGE 1ST. ADDITION - An application by
Heritage Development, P.O. Box 2684, Pocatello, Idaho for a preliminary plat for
Victorian Village V. Addition. A subdivision located at corner of Siphon and Whitaker
Road.
After review of preliminary plat, Councilman Wood moved to approve the Victorian
Village Preliminary Plat 1'. Addition as presented. Councilman England seconded. All
council members voted in favor of motion.

ORDINANCE #486 - Amending Section 5.03.030 to change the fees that can be assessed for a
false alarm, to increase the fixed fee for a false alarm to $150.00.
Attorney Holmes read Ordinance #486 in full for the first reading.
Councilman Gunter moved to dispense with the rule of reading Ordinance #486 on three
separate days. Councilman Wood seconded. Roll call Vote: Quick, yes; England, yes;
Gunter, yes; Wood, yes.
Councilman Wood moved to adopt Ordinance #486 as read. Councilman Quick
seconded. Roll Call Vote: Quick, yes; England, yes; Gunter, yes; Wood, yes.
RESOLUTION #6 -98 - A resolution of the City of Chubbuck amending the connection fees to
be charged by the City for residential water service connections to the municipal water
system.
Mayor Cotant read Resolution #6 -98 in full.
Councilman Wood moved to adopt Resolution #6 -98 in full. Councilman Quick
seconded. All council members voted in favor of motion.
DAY CARE APPLICATION - TEACH -A -TOT - 5565 YELLOWSTONE AVE - Brad Frasure,
5050 Yellowstone Ave. has applied for a day care license to operate Teach -A -Tot at 5565
Yellowstone Ave.
Police Chief Jerry Rowland recommended approval of the day care application.
Councilman England moved to grant Brad Frasure, 5050 Yellowstone Ave. a day care
business license to operate Teach -A -Tot at 5565 Yellowstone Ave. Councilman Gunter
seconded. All council members voted in favor of motion.
GROUNDWATER PROTECTION POLICY BOARD COMMITTEE REPRESENTATIVE
AND CHAMBER OF COMMERCE REPRESENTATIVE - Mayor Cotant suggested
appointing Councilman Gunter as City of Chubbuck representative to the Groundwater
Protection Policy Board Committee. Mayor Cotant suggested appointing Councilman
Wood as City of Chubbuck representative to the Chamber of Commerce.
Councilman Gunter moved to direct Mayor Cotant to appoint Councilman Gunter as
Groundwater Protection Policy Board Member and Councilman Wood as Chamber of
Commerce Representative. Councilman Quick seconded. All council members voted in
favor of motion.

CLAIMS - Computer print -out claims presented to Mayor Cotant and Council.
Councilman Wood moved to approve computer print -out claims as presented. All council
members voted in favor of motion.
GENERAL DISCUSSION -
1. Darren Bauer, Stuart Ave. was present to discuss his concern about kids at 5277 Stuart
Ave. having their basketball hoop facing the City Street. Mr. Bauer stated, he has
watched several near accidents, because of kids playing, and not seeing traffic coming
until it is about too late. Councilman Quick stated, he will talk with Chief Jerry Rowland
about the concerns.
At 8:05 p.m., Councilman Gunter moved, Councilman Wood seconded, with full council
approval to adjourn meeting.
