COUNCIL MEETING MINUTES
July 28, 1998
Minutes of a regular council meeting held at city municipal building, July 28, 1998.
Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin
C. Gunter, W. Dean Wood, Public Works Director Steven M. Smart and City Clerk Ron
C. Conlin.
PLEDGE ALLEGIANCE TO THE FLAG
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions to regular
meeting minutes of, July 14`"., 1998 and Special Meeting Minutes of, July 16`"., 1998.
Councilman Wood moved to approve regular meeting minutes of, July 14` "., 1998 as
read. Councilman Quick seconded. All council members voted in favor of motion.
Councilman Quick moved to approve Special Meeting Minutes of, July 16` "., 1998 as
read. Councilman England seconded. All council members voted in favor of motion.
ORDINANCE - Amending definition of day care employee to include unpaid employees or
unpaid volunteers, clarifying that both a Chubbuck Business License and a Day Care
Provider's license is required to be a day care provider.
Mayor Cotant, Council members Steve England, Leroy Quick, Dean Wood and Marvin
Gunter read the amended Day Care Ordinance in full for the second reading.
Council tabled the proposed amended Day Care Ordinance until the August 11, 1998
Council Meeting.
REQUEST FOR WAIVER OF LANDSCAPING REQUIREMENTS AT BOWEN
PETROLEUM'S BUILDING AT BURLEY AND LINDEN - Mayor Cotant and Council
received a letter from Craig Jorgensen, Bowen Petroleum's Attorney to request the
Council defer "landscaping requirements" at Bowen Petroleum's building until such time
as further development occurs.
Bowen Petroleum feels like, to install landscaping now, only to have it disrupted later
when curb, gutter, sidewalk and paving are done, seems illogical and a waste of
resources.
Mayor Cotant stated the street is going to be surveyed, when the street is installed, the
landscaping, sidewalk, curb and gutter will align with the street.
Mayor Cotant and Council were all in agreement the ordinance needs to be complied
with.

WAIVER OF LANDSCAPING - BOWEN OIL - (cont.)
Mayor Cotant stated there are several on the block that said when others install the
landscaping, curb, gutter and sidewalk, they will install theirs.
Mayor Cotant stated Con Jensen, across the street was required to install the landscaping,
curb, gutter and sidewalk and it looks nice.
Mayor Cotant stated we have two properties, Bowen Petroleum and Harris Construction,
that somehow misunderstood the requirements and wants to defer the requirements until
other development occurs.
Councilman Quick moved to deny the Bowen Petroleum Request for Deferral of
landscaping, sidewalk, curb and gutter and requiring Bowen Petroleum to comply with
City Ordinance. Councilman Gunter seconded. All council members voted in favor of
motion.
GENERAL DISCUSSION - Councilman Wood asked when a meeting will be set for;
1) Whitaker Road residents on their concerns about Whitaker Road becoming R -1.
2) Formation of a committee to address change in classifications of R -1 and R -2 zones.
Mayor Cotant stated he heard there is not 100% of the residents on Whitaker Road that
want R -1 zoning. Council was in agreement the neighborhood should meet together as a
group and see what they want to do.
CLAIMS - Computer print -out claims presented to Mayor Cotant and Council.
Councilman Wood moved to approve computer print -out claims as presented.
Councilman Gunter seconded. All council members voted in favor of motion.
At 8:17 p.m., Councilman Gunter moved, Councilman England seconded, with full council
approval to adjourn meeting.
