Cotant, Council members Leroy S. Quick, Steven M. England, W. Dean Wood, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Councilman Marvin C. Gunter was excused. Meeting was called to order at /:33 p.m. by Mayor Cotant. APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions to special meeting minutes of March 8, 1994, and regular meeting minutes of March 8, i994. Councilman Wood moved to approve special meeting minutes of March 8, 1994 as read. Councilman England seconded. All council members present voted in favor of motion. Councilman England moved to approve regular meeting minutes of March 8, 1994 sub3ect to Attorney Holmes correction and addition to preliminary plat for ~nltaker Farms Assn. Planned Unit Development. Councilman Wood seconded. All council members present voted in favor of motion. BUSINESS LICENSE APPLICATION - William Matson, Blackfoot has applied for license to sell coffee & slushes at a temporary stand on the Green Triangle Parking Lot. Police and Fire Departments did not have a problem with the application. Councilman Wood moved to approve a business license to William Matson, Java Hut to sell coffee & slushes at the Green Triangle Parking Lot from a temporary stand. Councilman Quick seconded. All council members present voted in favor of motion. CHUBBUCK CABLE COMMISSION REPORT FROM CHUBBUCK CABLE MEMBER IRENE SCHLADER - Irene Schlader presented the Vision 12 Handbook and Access User's Agreement Cotant and Council for review. COMMiSSiON Pocatello- to Mayor irene Schiader stated the City of Pocateilo is renegoiatlng their Cable Franchise Ordinance, even thought the City of Chubbuck~s Cable Franchise Ordinance does not expire for six years, the City of Chubbuck can renegoiate along with the City of Pocatello. CHUBBUCK CABLE COMMISSION REPORT - (cont.) Mrs. Schiader said TCI sent a questionaire to residents in the area, asking subscribers to comment on what they like, or dislike about TCI. Discussion about City of Chubbuck sending a questionaire in utility bills this month. Mrs. Schlader said she will check to see if there is a problem with Chubbuck using the same format, with some changes on the questionaire. Mayor Cotant stated he has been discussing the franchise agreement with Mayor Angstadt, the City of Chubbuck intends to pay our fair share. Council was in favor of, 1) Renegolatlng the Cable Franchise Ordinance along with the City of Pocatello. 2) Sending out approx. 300 questionaires in this month's utility bills. COMPOSTING MATERIAL PICK UP - Mayor Cotant stated he is going to mention in Mayor's Letter to Residents this month, suggesting composting material being taken to other places than land fill, maybe composting businesses, mulching mower or compost yourself. Mayor Cotant suggested a high percentage of the waste going into the land fill comes from yards. City might get involved in the pick up of composting material in the future. CLAIM - Michael Maiito, 500 Brent, Pocatello, Idaho presented a claim stating he was proceeding west on Chubbuck Rd. after dark, City road construction left a ditch open, extending the entlre wldth of the road. The construction site contained no warning of any kind. Due to no warnings Mr. Malito could not avoid hitting ditch with his vehicle. The amount of claim is $667.67. After discussion, Councilman Wood moved to dlrect City Clerk Conlin to send the claim presented by Michael Mallto, to City Insurance Co. Councilman England seconded. Ail council members present voted in favor of motion. iDAHO OUTDOOR ADVERTiSiNG - ADVERTISING SIGNS - Scott Frost, Idaho Outdoor Advertising, explained the request to the south of Smith's Parking Lot is only enlarging the sign to I2r X 24~, the second request is to install another sign, Just to the east of the Chee Gong Rest. PWD Smart stated the city has no ordinance at this time that prohibits the signs. 69 ADVERTISING SIGNS - (cont.) Police Chief Rowland stated some kind of control on signs by ordinance is needed, or the City will have this type of sign all over the City. RWD Smart said he will review information from the American Planning Assn. that might help address sign regulation. Councilman England moved to approve the installation of a sign east of the Chee Gong Rest., and enlarging the sign south of Smith*s Parking Lot, owned by Idaho Outdoor Advertising to 12' X 24'. Councilman Wood seconded. All council members present voted in favor of motion. RESOLUTION %3-94 - A resolution amending the fees to be chaFged by the City for water service connections to the Municipal Water System. Councilman Quick moved to adopt Resolution %3-94 as read. Councilman England seconded. All council members present voted in favor of motion. Agreement stating obligations of the State, and Chubbuck, for project of Intersection at W. and Hawthorne Rd. Mayor Cotant read Resolution #4-94 in full. Councilman England moved to adopt Resolution #4-94 as read, directing Mayor Cotant to enter into agreement with the Idaho Transportation Department, for pro3ect at W. Chubbuck Rd. and Hawthorne Rd. Intersection, and approve $3,~.~0 claim for State to revlew engineering expenses. Councilman Wood seconded. Ail council members present voted in favor of motion. RESOLUTION #5-94 - A cooperative agreement stating obligations of the State and the City of Chubbuck and Wal-Mart Stores, Inc. for the construction and maintenance of a traffic signal at the intersection of Yellowstone Ave and Breneman Rd. within the corporate limits of the city. PWD Smart stated Wal-Mart wants participation on costs of the signal at Brenamen Rd. intersection from Pine Ridge Mall. Councilman Wood stated at a meeting he attended, the Pine Ridge Mall felt they paid for the signal at Slmplots without help, so they do not want to participate in this signal. Councilman Wood was in favor of this resolution, but not in favor of putting pressure on Pine Ridge Mall to participate in the costs of the signal. Mayor Cotant said Pine Ridge Mall Management felt, if Wal- Mart was not there, the signal would not be needed. Councilman England sald if Wal-Mart and Pine Rldge out some kind of agreement, thats fine, but he is not of forcing Pine Ridge to contribute to the signal. can work in favor Ail council members present were in favor of not using City's Police Power to require Pine Ridge Mall Management to participate in costs of the signal at Breneman Rd. and Yellowstone Ave. RESOLUTION #5-94 - (cont.) Councilman Wood moved to adopt Resolution #5-94 as read, to authorize Mayor Cotant to enter into agreement wlth Transportation Department and Wal-Mart after the agreement is finalized. Councilman England seconded. All council members present voted in favor of motion. RESOLUTION #6-94 - Authorizing the Mayor to enter into an agreement to secure the services of a financial advisor to the city'for the purpose of selling revenue bonds to defray costs of. new production water wells. Mayor Cotant read Resolution #6-94 in full. Councilman England moved to adopt Resolution #6-94 as read. Councilman Wood seconded. All council members present voted in favor of motion. GENERAL DISCUSSION - PWD Smart stated DEQ called, asking for a proposal of schedule of compliance on plans to drill test holes, etc. PWD Smart presented current Tetraclhoroethylene Test results. Well ~3 averages are rising. The average continues to climb, if contaminated wells are converted to irrigation wells only, the City's water rights will be okay. CLAIMS - Computer print-out claims presented to Mayor Cotant and Council. Councilman Wood moved to approve claims as presented. Councilman Quick seconded.
