Cotant, Council members Leroy S. Quick, Steven M. England, W. Dean Wood, Marvin C. Gunter, Attorney Thomas J. Holmes, Public Works Director Steven ~. ~mart and City Clerk Ron C. Conlin. Meeting was called to order at 7:30 p.m. by Mayor Cotant. INVOCATION was given by Bishop Ted Corrington, 5th. Ward, Chubbuck Stake, The Church of Jesus Christ of Latter-Day Saints. APPROVAL O~TM MINUTES - Mayor Cotant asked for corrections or additions to regular meeting minutes of December i4, 1993. Councilman Wood moved to approve regular meeting minutes December 14, 1993 as read. Councilman Quick seconded. Ail council members voted in favor of motion. of APPROVAL OF DECEMBER, 1993 CLAIMS - Computer print-out claims were presented to Mayor Cotant and Council. Councilman Quick moved to approve December, 1993 Computer print-out claims as presented. Councilman England seconded. All council members voted in favor of motion. ADMINISTRATION OF OATHS OF OFFICE - City Clerk Ron C. Coniln administered the oaths of office to the newly elected officials of the City of Chubbuck; Mayor John O. Cotant, Council members Leroy S. Quick and Marvin C. Gunther. Councilman England moved, Councilman Gunter seconded, with full council approval to adjourn the meeting. Mayor Cotant then re-called the meeting to order with newly elected officials present. STATE OF CiTY ADDRESS was given by Mayor Cotant, relating past accomplishments of city, together with future plans for the city. Mayor Cotant made the following Departmental Council member assignments: Councilman ~. uean Wood .... Council President, Parks and Recreation. Councilman Leroy S. Quick --Police Department Councilman Marvin C. Gunter-Fire Department and Chubbuck Days. Councilman Steve M. England-NOBAMPO and SiCOG Representative. PUBLIC HEARING -An application by W~ltaker Farm Assoc., 280 Arthur for a preliminary plat for Winltaker Farm Planned Unit Development at 49i5 W~itaker Rd. Mayor Cotant declared the public hearing open. The proposal was tabled by the Land Use and Development Commission at the January 6, 1994 Land Use and Development Commission Meeting. The proposal will be heard at the February 3, 1994 Land Use and Development Commission Meeting. There was no comment from the public. Mayor Cotant declared the public hearing closed. Council tabled the proposal until the Land Use and Development Commission presents their recommendations in February. PUBLIC HEARING - An application by Joiene Hutchinson, 8i5 E1 Rancho for review of a Cottage Grove Preliminary Plat, located at the north end of Stuart Ave. PW~ Smart stated the City shows in the Comprehensive Plan, a proposed street right-a-way that goes through the property. The Land Use and Development Commission concerned about the issue, passed to the City Council, without the road being dedicated, built, or an easement for the road. The Commission hoped the potential developer to the north, and Mrs. Hutchinson get together, and can agree on the construction of a street. Mrs. Hutchinson proposed to start the development on the west side of the property, so her first storage bulidlng will not block any proposal worked out by her, and Paul Jensen, W~itaker Farms Estate, if Mr. Jensen can proceed with their development. 5 PRELIMINARY PLAT - HIGHLAN~ MINi-STORAGE SUBDiVISiON - (cont.) Attorney Holmes suggested the street issue in the Comprehensive Plan be addressed at a public hearing at the next Land Use and Development Commission Meeting. Mayor Cotant declared the public hearing open. Randy Budge, Mrs. Hutchinson's Attorney stated Mrs. Hutchinson will start the mini-storage construction against the railroad tracks to the west of the property, it will probably be three years before Mrs. Hutchinson gets to the east end of the property. Bob Daipino, 4924 W~itaker Rd. stated the proposed road will not benefit the City of Chubbuck, but will only benefit the ~nitaker Farm Association proposal, and residents in the area are against the apartment proposal. Alane Hale, 4825 ~itaker Rd. expressed concern about the storage units not being fenced. Attorney Holmes stated generally it is a marketing decision of the owner to secure their units. If they have a problem, it is in their best interest to secure. There is a requirement that there will be a screening fence on the east side if the road does not go through. Mayor Cotant declared the public hearing closed. Councilman Gunter moved to approve the Preliminary Plat of Highland Mini-Storage Subdivision as presented, subject to the development of the storage units starting on the west side of Mrs. Hutchinson's property. Councilman Wood seconded. Ail council members voted in favor of motion. PUBLIC HEARING - PRELIMINARY PLAT OF COTTAGE GROVE SUBDIViSiON An application by American Heritage, inc. for a review of a Preliminary Plat of Ccttage Grove Subdivision located at the north end of Stuart Ave. PWD Smart stated the area that is to be developed is currently zoned as Limited Residential (R-2). PWD Smart said the preliminary plat conforms with code requirements except developer needs to establish the plans for a park or cash contribution for park lands and the north-south portion of Stuart needs to be renamed to avoid confusion for emergency response. PRELIMINARY PLAT OF COTTAGE GROVE SUBDIVISION - (cont.) Mayor Cotant declared the public hearing open. Mayor Cotant suggested we get together with the Stuarts~, to get their input on renaming the north-south portion of Stuart Street. There being no comment, Mayor Cotant declared the public hearing closed. PWD Smart stated in R-2 areas, they are allowed to have 6~~ wide lots, the LU&D Commission suggested the west side be changed to nine lots instead of the ten, so as to give a little more lot frontage and allow a little nicer home. Councilman Wood stated the lots as presented, are over 8000~. Councilman England stated the smaller lots are being built to put the smaller homes on initially, with the idea of adding on if owner wants to. Councilman Wood moved to approve the Preliminary Plat of Cottage Grove Subdivision as presented by American Heritage, Inc. with the recommendation to American Heritage, inc. that the lots on the west side be changed to nine lots, rather than the ten presented. This would give a little more lot frontage, allowing a nicer home. Councilman Gunter seconded. All council members voted in favor of motion. MORATORIUM A proposal by the Clty of Chubbuck moratorium pursuant upon permitted industrial Chubbuck Municipal Code to enact a uses under Mayor Cotant read the proposed Moratorium in full. Mayor Cotant declared the public hearing open. Melvin Jackson, 5101 W~ltaker Rd. stated most residents in area have no plans for any industrial use of the properties on Whitaker Rd. Mayor Cotant asked for public comment, there being none, Mayor Cotant declared the public hearing closed. Attorney Holmes stated while Mr. Jackson does not plan on using or selling his property for industrial use, other property owners in the area might not feel that way in the future. 9 MORATORIUM - (cont.) Attorney Holmes stated the moratorium will not prohibit industrial uses, but will require all industrial uses to be approved with a conditional use permit. Councilman England moved to enact the moratorium as read. Councilman Quick seconded, ail council members voted in favor of motion. ORDINANCE - An ordinance by the City of Chubbuck to require paved driveway connecting the public right of way with any required off-street parking spaces; to require appropriate striping. Councilman Steven M. England read by title for the second reading. Council tabled the ordinance until the January 25, I994 Council Meeting. ORDINANCE - An ordinance by the City of Chubbuck to allow e Class III production building to be used as a productlon building sales office. Mayor Cotant read the crdinance by tltie only for the second reading. Council tabled the ordinance until the January 25, 1994 Council Meeting. ORDINANCE - An ordinance adding Chapter 10.20, ~TResident only Parking Permit Areas'~ to the Chubbuck Municipal Code; designating portions of Victor Ave., Teton Street and Bonanza Ave. as permit only parking areas from Aprll 15 to October 15. Mayor Cotant read ordinance by title only for the first reading. Council tabled the ordinance until the January 25, 1994 Council Meeting. ORDINANCE An ordinance amending limitations on temporary signs; temporary signs. Chapter 15.24 to provide to provide for a permit for Mayor Cotant read ordinance by tltie only for the first reading. Council tabled the ordinance until the January 25, 1994 Council Meeting. il 1993-94 ENTERPRISE BUDGET DiSCUSSiON PW~ Smart stated he contacted two engineering firms, asking them to give the City a proposal on the development of test hole drilling specs and well drilling spec. for two production wells. Councilman England stated, after conducting the summer meetings, getting the residents views, the general conclusion was to go with the production wells, rather than treating. Discussion about providing a filter for each home. Maintaining the filters could be a problem. PW~ Smart stated the consulting engineering firms should have their proposals to the City next week, hopefully at the January 25, 1994 Council Meeting we should be in position to authorize a contract. P~ Smart recommended the Clty put a test hole down at i) Well #i, 2) Chubbuck and Hiline Rd., Siphon Rd. and Whitaker Rd. (north end) and 3) Along Hawthorne Rd, near the Interstate. Council reviewed map. Discussion about ways to finance new production wells. Councilman England moved to direct PWD Smart to proceed 1 getting the proposals for test wells from consulting engineers. 2) Looking into polnt of delivery solution. Councilman Wood seconded. All council members voted in favor of motion. Smart working on revising commercial sanitation rates. FINANCIAL REPORT for month of December, 1993 presented to Mayor Cotant and Council. GENERAL DISCUSSION - Councilman Gunter asked why the barrier was removed from the easement by stop sign at Teton and Victor. After discussion, it was decided Staff will review. 2.
