COUNCIL MEETING MINUTES
November 28, 1995
Minutes of regular meeting held at c~ty municipal building,
November 28, 1995.
Present: Mayor John O. Cotant, Council members Leroy S. Quick,
Steven M. England, W. Dean Wood, Attorney Thomas J. Holmes,
Public Works Director Steven M. Smart and City Clerk Ron C.
Conlin.
Meeting was called to order at 7:33 p.m. by Mayor Cotant.
PLEDGE ALLEGIANCE TO THE FLAG
APPROVAL OF MINUTES Mayor Cotant asked for corrections or
additions to regular meeting minutes of November 14, 1995.
Councilman Wood moved to approve regular meeting minutes of
November 14, 1995 as read. Councilman Gunter seconded. All
council members present voted in favor of motion.
PROJECT SAFE PLACE AREAS - Mlcki Adler, 5222 Country Drive was
present to explain the program, recommended the Chubbuck City
Offices be adopted as a Safe Place Site.
Mickl Adler explained the way the program works is, if a child
is in any kind crisis situation they can go to a designated
safe place, individuals at the designated safe place have been
trained so they know what to do.
Wal-mart and McDonalds are designated safe places in the City.
Micki Ad]er stated there is a $25.00 annual fee to cover costs
for signs, and materials.
Councilman England moved to adopt City of Chubbuck as a
designated safe place. Councilman Quick seconded. All council
members voted in favor of motion.
PETITION - Scott Nichols, 5742 Moses presented a petition stating
they protest the extra ordinary noise generated by the logging
operation located due east of Paradise Acres. They say they
understand the logging company is operating in an area zoned
Industrial, but request the City Council place restrictions
on their hours of operation to minimize the noise pollution.
They request the following limits: Monday - Friday, 6:00 a.m.
to 9~00 p.m., Saturday, 8,00 a.m. to 6~00 p.m., and no
operations allowed on Sunday. The petition contained 49
signatures.

Mr. Nichols stated the logging operation is operating 24 hours
a day. The complaints are the following; noise, working late
hours, chipping log late at night, front end loaders run
during the night and large logging trucks coming in and out.
Mayor Cotant stated the area is zoned Industrial. The two
businesses in the area are approved.
PWD Smart stated the Land Use & Development Commission did not
put restrictions on the company, probably because the logging
company is in an Industrial Zone.
After discussion, Mayor Cotant suggested the City look at the
concerns on the petition, then let residents know what can be
done.
HAPPY TIME DAY CARE CENTER - Police Chief Jerry Rowland stated he
received a letter from Annamarie and Tyrone Palmer, Stuart
Ave. stating, at this time Tyrone and Annamarie Palmer would
like to request that as owners and operators of the Happy Time
Station Daycare, that their day care l~cense issued by the
city, be voluntarily revoked until further notice.
Councilman Wood moved to revoke the day care license of Happy
Time Station Day Care Center. Councilman Quick seconded. All
council members voted in favor of motion.
MMERG~NCY CURB SERVICE CO. - VICTOR HERNANDEZ - 222 HENRY - Chief
of Police Jerry Rowland stated the Police Department and City
Offices have received numerous complaints about Victor
Hernandez, 222 Henry representing the City, and also using
pressure tactics to sell his curb painting service.
Victor Hernandez was invited to attend the meeting tonight,
but dld not come.
Chief Rowland stated he talked to Mr. Hernandez about the
complaints, but the complaints still came in.
Chief Rowland suggested the business license of ~mergency Curb
Service, Victor Hernandez, 222 Henry be revoked by the City
Council.
Councilman Quick moved to revoke the business license of
Emergency Curb Service, Victor Hernandez, 222 Henry.
Councilman Gunter seconded. All council members voted in favor
of motion.

BUSINESS LICENSE APPLICATION - Jenkin & Sons Tree Farm, Sandpoint,
Idaho has applied for license to sell christmas trees at
Polellne Rd. and Yellowstone Ave., (Green Triangle Parking
Lot).
Councilman Wood moved to grant a business license to Jenkln
& Sons Tree Farm to sell christmas trees at the Green Triangle
Parking Lot, Yellowstone Ave. Councilman England seconded. All
council members voted in favor of motion.
ORDINANCE #447 Repealing Section 9.20.061 in its entirety and
enacting in lieu thereof a new Section 9.20.061 to provide for
civil penalties for violation of certain Sections of the
Animal control Act; to increase the civil penalty to S25.00
if paid within 10 day and $30.00 if paid later.
Mayor Cotant read Ordinance #447 by title for the third
and final reading, one of which was in full.
Councilman England moved to adopt Ordinance #447 as read.
Councilman Gunter seconded. Roll Call Vote: Quick, yes;
England, yes; Wood, yes; Gunter, yes.
ORDINANCE #448 - Enacting Section 10.04.100 of the Chubbuck
Municipal Code designating Alpine Ave. as a minor arterial and
prohibiting parking on certain portions of Alpine Ave.,
located in Kasiska Subdivision and providing parking may be
restricted in the future on portions of Country Acres
Subdivision.
Mayor Cotant read Ordinance #448 in full for the third and
final reading, of which two readings were in full.
Councilman Wood moved to adopt Ordinance #448 as read.
Councilman Quick seconded. Roll Call Vote= Quick, yes;
England, yes; Wood, yes; Gunter, yes.
FAMILY AND MEDICAL LEAVE ACT OF 1993 - PWD Smart stated the City's
insurance carrier, ICRMP tells us that the cornerstone to
complying with the FMLA is to have a FMLA policy included in
the leave section of our personnel policy.
PWD Smart suggested the Council adopt this subsection for
inclusion in our general personnel policy.
After discussion, Councilman England moved to adopt the FMLA
Policy to the City of Chubbuck General Personnel Policy as
presented. Councilman Gunter seconded. All council members
voted in favor of motion.

CLAIMS Computer print-out claims presented to Mayor Cotant and
Councll.
Councilman Wood moved to approve the computer print-out claims
as presented. Councilman Quick seconded. All council members
voted in favor of motion.
At 8:16 p.m., Councilman Quick moved to go into executive session
meeting to discuss a personnel matter as authorized by Idaho
Code 67-2345 (b). Councilman Wood seconded. Roll Call Vote:
Quick, yes; England, yes; Wood, yes; Gunter, yes. 100% of
council voted in favor of motion.
No action or final decision was made·
At 9:25 p.m., Councilman Wood moved to adjourn from executive
session meeting to regular meeting. Councilman England
seconded. All councl] members voted in favor of motion·
GENERAL DISCUSSION -
Councilman Quick stated the Chubbuck Police Department
received an Award of Excellence for Pedestrian Safety in
the Clty of Chubbuck. The award is only one of two awards
presented throughout the Country.
2. PWD Smart reported Well #5 on Haw-thorne Rd. is a 117'
deep.
At 9~26 p.m., Councilman England moved, Councilman Quick seconded,
with full council approval to adjourn meeting.
