COUNCIL MEETING MINUTES
November 14, 1995
Minutes of regular meeting held at city municipal building,
November 14, 1995.
Present: Mayor John O. Cotant, Council members Leroy S. Quick,
W. Dean Wood, Attorney Thomas J. Holmes, Public Works Director
Steven M. Smart and City Clerk Ron C. Conlin. Councilman
Steven M. England was excused.
Meeting was called to order at 7:37 p.m. by Mayor Cotant.
PLEDGE ALLEGIANCE TO THE FLAG
APPROVAL OF MINUTES - Mayor Cotant asked for corrections or
additions to regular meeting minutes of October 24, 1995,
and Special Meeting Minutes of November 9, 1995.
Councilman Wood moved to approve regular meeting minutes of
October 24, 1995 as read. Councilman Quick seconded. All
council members present voted in favor of motion.
Councilman Gunter moved to approve Special Meeting Minutes of
Novemberq,W, 1995 as read. Councilman Wood seconded. All
council members present voted in favor of motion.
ORDINANCE - Enacting Section 10.04.100 of the Chubbuck Municipal
Code designating Alpine Ave. as a Minor Arterial and
prohibiting parking on certain portions of Alpine Ave.,
located in the Kasiska Subdivision and Country Acres
Subdivision.
Mark Crawley, 525 Alpine expressed concern about the ordinance
prohibiting parking on certain portions of Alpine Ave. Mr.
Crawley stated he operates an herbal business from his
residence on Alpine Ave., if parking is prohibited he could
not operate the business. Mr. Crawley stated residents on
Alpine Ave. need the parking when family visits. Mr. Crawley
asked if the residents on Alpine Rd. connecting to Hawthorne
Rd., can have grandfather rights.
Mayor Cotant stated, not knowing at this time what is going
to happen with traffic on Alpine Rd., the City is preparing
for the future and prohibiting parking on sections of Alpine
Ave. Mayor Cotant said it could be several years before
traffic is heavy enough to required no parking on Alpine Ave.
connecting to Hawthorne Ave. Mayor Cotant stated, it is not
the City's intend to stop parking on Alpine Ave. right now.
The City wants people purchasing homes in the new subdivisions
to be aware at some point in time there will be no parking on
Alpine Ave. in the future.

ORDINANCE - PROHIBITING PARKING ON CERTAIN PORTIONS OF ALPINE AVE.

PWD Smart suggested the ordinance be modified to say, "parking
may be prohibited in the future when traffic is deemed to be
heavy enough to warrant no parking on Alpine Ave".
After discussion, Council decided to table the ordinance until
the November 28, 1995 Council Meetlng.
BUSINESS LICENSE APPLICATION - Darrell C. Pinney, LawnTech dba
Elve's Christmas Forest has applied for license to sell
christmas trees at 4240 Yellowstone Ave. (Wal-Mart Parking
Lot ) .
Police and Fire Departments suggested approval of license.
Councilman Quick moved to approve a business license to
Darrell C. Pinney, Elve's Christmas Forest to sell christmas
trees on the Wal-Mart Parking Lot, 4240 Yellowstone Ave.
Councilman Wood seconded. Ail council members present voted
in favor of motion.
ORDINANCE - Repealing Section 9.20.061 in its entirety and enacting
in lieu thereof a new Section 9.20.061 to provide for civil
penalties for violations of certain sections of the Animal
Control Act; to increase the civil penalty to $25.00 if paid
within 10 days and S30.00 if paid later.
Mayor Cotant read ordinance in full for the second reading.
Council decided to table the ordinance until the November 28,
1995 Council Meeting.
ACCEPTANCE OF DEDICATION - HERITAGE WEST SUBDIVISION -
Mayor Cotant read the Acceptance of Offer of Dedication in
full.
PWqD Smart explained the Acceptance of Offer of Dedication.
Councilman Quick suggested the City accept in separate phases.
After discussion, Council decided to table the Acceptance of
Offer of Dedication until the November 28, 1995 Council
Meeting.
1994-95 CITY STREET FINANCE REPORT City Clerk Conlin presented
the 1994-95 City Street Finance Report of dedicated funds to
be presented to the State Auditor as required by Idaho Code,
Section 40-708.

Councilman Wood moved to accept the 1994-95 City Street
Finance Report as presented. Councilman Quick seconded. All
council members present voted in favor of motion.
CLAIMS - Computer print-out claims presented to Mayor Cotant and
Council.
Councilman Gunter moved to approve computer print-out claims
as presented. Councilman Wood seconded. All council members
present voted in favor of motion.
ORDINANCE #446 Amending Section 10.04.050 of the Chubbuck
Municipal Code to require compliance with the directions of
a fire fighter, volunteer parking enforcement officer, or
parking attendant; employed or commissioned by the City;
amending Section 10.04.080 of the Chubbuck Municipal code to
change parking violations fees; amending Section 10.04.090 of
the Chubbuck Municipal Code, to clarify the marking of fire
lanes and to provide penalties for violations and e×emptions~
adding Chapter 10.06 accessible parking to the Chubbuck
Municipal Code to provide for the establishment of accessible
parking spaces for persons with disabilities; marking and
signing of such spaces; making it unlawful for unauthorized
use of accessible parking spaces or obstruction of accessible
parking spaces; and enforcement pursuant to this ordinance;
adding Chapter 10.28 volunteer parking enforcement program ct
provide for the use of volunteers to enforce certain ?r~drg
violations.
Chief of Police Jerry Rowland read Ordinance #446 for the
third and final reading.
Councilman Wood moved to adopt Ordinance #446 as read.
Councilman Quick seconded. Roll Call Vote: Quick, yes;
England, absent; Wood, yes; Gunter, yes.
At
8,30 p.m., Councilman Wood moved to go into executive session
meeting to discuss a personnel matter as authorized by Idaho
Code 67-2345 (b), and discuss an interest in real property not
owned by the City, as authorized by Idaho Code 67-2345 (c).
Councilman Quick seconded. Roll Call Vote: Quick, yes;
England, absent; Wood, yes; Gunter, yes.
No action or final decision was made.
At 9:09 p.m., Councilman Wood moved, Councilm~ Quick seconded,
