England, Thomas J. Holmes, City Clerk Ron C. Cotant, Council members Leroy S. Quick, W. Dean Wood, Marvln C. Gunter, Attorney Public Works Director Steven M. Smart and Conlln. Meeting was called to order at 7~30 p.m. by Mayor John O. Cotant. PLEDGE ALLEGIANCE TO THE FLAG APPROVAL OF MINUTES - Mayor John O. Cotant asked for corrections oF additions to regular meeting minutes of August 22, 1995, and Special Meeting Minutes of, August 29, 1995. Councilman Wood moved to approve regular meeting minutes of August 22, 1995 as read. Councilman England seconded. All council members voted in favor of motion. Councilman Gunter moved to approve Special Meeting Minutes of August 29, 1995. Councilman Quick seconded. All council members present voted in favor of motion. PUBLIC HEARING - An application by Jim Worthen, 730 E. Chubbuck Rd. for a review of a Preliminary Plat for Renae Subdivision. A subdivision located in Lot 15, in the Cloverdell Farms Subdivision (north of 242 and 244 E. Chubbuck Rd.). Property is presently zoned Industrial (I). Mayor Cotant declared the public hearing open. Council reviewed the preliminary plat as presented. Tim Shurtllff, 426 W. Lewis represented the Worthen's on this project. The preliminary plat was submitted some time ago and approved for a two lot subdivision. Worthen's passed the six month limit, and the preliminary plat expired. Mr. Shurtllff explained the proposal. Mayor Cotant declared the public hearing closed. Councilman Wood moved to approve the Renae Subdivision Preliminary Plat as presented by Jim Worthen. Councilman Quick seconded. All council members voted in favor of motion. 129 JOE OSIER, MISTI MANOR 2ND ADDITION REQUEST FOR EXTENSION OF APPROVAL OF PRELIMINARY PLAT - Tim Shurtliff, Shurtllff Engineering stated the preliminary plat of Mlstl Manor 2nd. Addition Subdivision was processed through and approved by the City Council in April of 1995. Mr. Shurtllff requested a six month extension of that approval, stating Mr. Osier is planning to complete the final plat and construction drawings this Fall, and to have the project ready for construction early next Spring. Councilman England moved to approve a six month extension of the Mlstl Manor 2nd. Addition Preliminary Plat as requested. Councilman Gunter seconded. All council members voted in favor of motion. ORDINANCE #442 - HAWTHOIqNE RIGHT-OF-WAYUNDERNEATH 1-86 - Annexing certain lands to be included within the boundaries and Jurisdictional limits of the City of Chubbuck; specifying the zoning classification which shall be applied to said lands newly annexed to the City of Chubbuck. Attorney Holmes read Ordinance ~442 in full for the first reading. Councilman Quick moved to dispense with rule of reading Ordinance #442 on three separate days. Councilman Wood seconded. Roll Call Vote, Quick, yes; England, yes; Wood, yes; Gunter, yes. Councilman Gunter moved to adopt Ordinance #442 as read. Councilman England seconded. Roll Call Vote, Quick, yes; England, yes; Wood, yes; Gunter, yes. Councilman Quick moved to remove words of "west half of Hawthorne Rd." in Section 1, in Ordinance #442, should read "Hawthorne Right-of-Way underneath 1-86". Councilman Wood seconded. All council members voted in favor of motion. ORDINANCE #443 - CHANGE IN ZONING - 218 W. CHUBBUCK RD. - Providing for change of Land Use District with respect to certain lands within the boundaries of the City of Chubbuck, Chubbuck Acres Subdivision, from Limited Residential (R-2) to Dense Residential (R-4); declaring that the City Council finds that such change in Land Use District is compatible with the Land Use Pattern prescribed by the City's Comprehensive Plan. Attorney Holmes read Ordinance #443 in full for the first reading. ORDINANCE #433 - (cont.) 131 Councilman England moved to dispense with the rule of reading Ordinance #443 on three separate days. Councilman Wood seconded. Roi1 Call Vote, Quick, yes; England, yes; Wood, yes; Gunter, yes. Councilman Quick moved to adopt Ordinance #443 as read. Councilman Gunter seconded. ORDINANCE #444 - Providing for a change of Land Use District with respect to certain lands within the boundaries of the City of Chubbuck located in the SW 1/4, NE 1/4, Section 10, Township 6 South, Range 34 E.B.M., from Limited Residential (R-2), to Industrial (I); declaring that the City Council finds that such change in the Land Use District is compatible with the Land Use Pattern prescribed by the Clty;'s Comprehensive Plan. Attorney Holmes read Ordinance #444 in full for the first reading. Councilman Wood moved to dispense with rule of reading Ordinance #444 on three separate days. Councilman Gunter seconded. Roll Call Vote, Quick, yes; England, yes; Wood, yes; Gunter, yes. Councilman Gunter moved to adopt Ordinance #444 as read. Councilman England seconded. Roll Call Vote, Quick, yes; England, yes; Wood, yes; Gunter, yes. RESOLUTION #6-95 A resolution proclaiming a General City Election, to be held on November 7, 1995, designating the polling place, designating the registrar and deputy registrars, and ordering the City Clerk to give notice of such election. City Clerk Conlln read Resolution #6-95 in full. E.L. Kremin, 5745 Sorrell suggested the Council consider going tb electing council members by district in the next election. Mr. Kremln's concern is a certain neighborhood might not be represented, electing council members at large. Councilman England moved to adopt Resolution #6-95 as read. Councilman Wood seconded. Ail council members voted in favor Of motion. CLAIMS - Computer print-out claims Council. presented to Mayor Cotant and 133 CLAIMS - (cont.) City Clerk Conlin was directed to void check made to City of Pocatello, then create a new check reflecting .57 per m gallons for sewer capacity fee instead of .81 per m gallons. Councilman Gunter moved to approve computer print-out claims as presented. Councilman Quick seconded. All council members voted in favor of motion. At 8~25 p.m., Councilman Gunter moved, Councilman Quick seconded, with full council approval to adjourn meeting. Ron C. Conlin, City Clerk
