COUNCIL MEETING MINUTES
July 25, 1995
Minutes of regular meeting held at city municipal building,
July 25, 1995.
Present: Mayor John O. Cotant, Council members Leroy S. Quick,
W. Dean Wood, Marvin C. Gunter, Attorney Thomas J. Holmes,
Steven M. Smart and City Clerk Ron C. Conlin. Councilman
Steven M. England was excused.
Meeting was called to order at 7:30 p.m. by Mayor John O. Cotant.
PLEDGE ALLEGIANCE TO THE FLAG
APPROVAL OF MINUTES - Mayor John O. Cotant asked for corrections
or additions to regular meeting minutes of July 11, 1995.
Councilman Wood moved to approve regular meeting minutes of
July 11, 1995 as read. Councilman Quick seconded. All
council members present voted in favor of motion.
BUSINESS LICENSE APPLICATION - Virgina McClosky, Baskin-Robbins 31
Flavors, Pocatello has applied to sell ice cream from a
vending truck in the City of Chubbuck.
Police Department approved the application.
Councilman Gunter moved to grant a business license to Virgina
McClosky, Baskin-Robbins 31 Flavors, Pocatello to sell ice
cream from a vending truck. Councilman Wood seconded. All
council members present voted in favor of motion.
BUSINESS LICENSE APPLICATION - Matt Lucas, Summer Snow, 739 S.
Arthur, Pocatello has applied for licence to sell sno cones
from a vending truck in the City of Chubbuck.
Police Department approved the application.
Councilman Wood moved to grant a license to Matt Lucas, Summer
Snow a business license to sell sno cones from a vending truck
in the City. Councilman Gunter seconded. All council members
present voted in favor of motion.
1 APPEAL - ANIMAL DESTRUCTION - Wendy Kunz and Wayne Adams, 475
Chickadee were advised they have a right to a hearing with
Signe Peterson, Animal Control Officer, Chief of Police Jerry
Rowland and Attorney Kelly Kumm to determine whether their dog
is a vicious animal, Adams and Kunz were both in attendance
at the meeting. After discussion, Chief Rowland and Animal
Control Officer Signe Peterson determined the wolfcross dog
to be a vicious animal.

Mr. Adams contacted City Clerk Ron Conlin to schedule request
for appeal of the decision to the City Council.
Wendy Kunz explained the dog is kept on a leash, or in a van,
someone other than the family released the dog. Mrs. Kunz
said she could guarantee the dog would not get away again.
Wendy Kunz asked that the dog not be destroyed.
Wayne Adams stated he felt the dog should not be destroyed
because someone else released the dog. '
Chief Rowland stated he feels, because of the City's liability
the animal should be destroyed.
Attorney Holmes agreed the City could be held liable if the
animal got loose, causing problems again.
Councilman Wood expressed concern about destroying an animal
because of one incident, killing chickens.
Councilman Quick moved to accept recommendation of Animal
Control Officer Signe Peterson, Chief ferry Rowland and
Attorney Kelly Kumm that the animal is vicious, and that it
be destroyed. Councilman Gunter seconded. Roll Call vote:
Quick, yes; England, absent; Wood, no; Gunter, yes. Motion
passes.
CLAIM - Kevin Koompin, 530 N. Ash presented a claim for $53.00, for
the towing of his vehicle. The vehicle was towed because of
notice sent, requiring residents to remove vehicles from
street for seal coating.
P`WD Smart stated the contractor gave short notice, and
vehicles needed to be removed at once.
After discussion, Councilman Wood moved, because of short
notice given, to reimburse the $53.00 towing charges to Kevin
Koompin. Councilman Gunter seconded. All council members
present voted in favor of motion.
CLAIM - Troy Horsch, 4617 Tahoe presented a claim for $61.00 for
the towing of his vehicle. The vehicle was towed because of
notice sent, requiring residents to remove vehicles from
street for seal coating.
Councilman Wood made motion, because of the short notice
given, to reimburse the $61.00 towing charges to Troy Horsch,
4617 Tahoe. Councilman Gunter seconded. All council members
present voted in favor of motion.

BID ON CONSTRUCTION AND DEVELOPMENT Or MUNICIPAL WELL - PWu Smart
presented the following bids the City received:
High Plains Drilling, Rexburg $159,584.00
Vollmer Well Drilling, Aberdeen $244,900.00
Hiddleston Drilling, Mountain Home $204,798.00
Layne Western, California $195,323.00
Riverside Drilling, Parma $202,682.0.0
PW -D Smart recommended the Council authorize Mayor Cotant to
enter into agreement with low bidder pending the finding they
are a responsible bidder.
Councilman Gunter moved to authorize Mayor Cotant to enter
into agreement with the low bidder, pending the finding they
are a responsible bid. Councilman Gunter seconded. All council
members present voted in favor of motion. '
CLAIMS - Computer print-out claims presented to Mayor Cotant and
Council.
Councilman Wood moved to approve computer print-out claims as
presented. Councilman Quick seconded. All council members
present voted in favor of motion.
At 8:20 p.m., Councilman Gunter moved, Councilman Wood seconded,
with full council approval to adjourn meeting.
