COUNCIL MEETING MINUTES
October 8, 1996
Minutes of regular meeting held at city municipal building,
October 8, 1996.
Present: Mayor John O. Cotant, Council members Leroy S. Quick~
Steven M. England, W. Dean Wood~ Marvin C. Gunter, Attorney
Thomas J. Holmes, Public Works Director Steven M. Smart and
City Clerk Ron C. Conlin.
Meeting called to order at 7:32 p.m. by Mayor John O. Cotant.
PLEDGE ALLEGIANCE TO THE FLAG: Michael Avalon.
INVOCATION was given by Bishop Steven M. England, Chubbuck 6th.
Ward, The Church of Jesus Christ of Latter-Day Saints.
APPROVAL OF MINUTES: Mayor Cotant asked for corrections or
additions to regular meeting minutes of September 24~ 1996.
Councilman Wood moved to approve regular meeting minutes of
September 10, 1996 as read. Councilman Quick seconded. All
council members voted in favor of motion.

After discussion, Council decided to table the ordinance until
the October 22, 1996 Council Meeting.
EMPLOYEE PERSONNEL POLICY MANUAL - Council reviewed the revised
Personnel Policy Manual which included two amendments.
On page 6, Article 1, paragraph (C), the probationary
employees is changed to twelve months, to be consistent with
the police department.
On page 10, a change has been made to paragraph (D)(17),
referring to alcohol or illegal drug use and providing that
testing positive for use of drugs shall be evidence of being
under the influence at work. Nothing else has been changed in
the policy.
After discussion, Council decided

ORDINANCE - Amending Chubbuck Code Section 18.08.040(b), to provide
height and area regulations for R-3, R-4 and C-1.
Mayor Cotant read ordinance by title for the first reading.
After discussion, Council decided to table the ordinance until
the October 22, 1996 Council Meeting.
BANNOCK PLANNING ORGANIZATION ACCESS MANAGEMENT PLAN - PWD Smart
presented guidelines for policies on controlled access
arterial and collectors.
Councilman Wood suggested, Council meet in a Study Session,
to review and discuss the management plan,
After discussion, Council decided to call a Special Study
Session to discuss the Access Management Plan, Tuesday,
October 15, 1996 at 5:00 p.m.
ORDINANCE - Amending Section 10.06.040 of the Chubbuck Municipal
Code to clarify the unlawful use of accessible parking special
placards and amending Section 10.06.070 making it unlawful to
display altered special licenses plates, placards~ or their
registration cards and decals.
Mayor Cotant read ordinance in full for the first reading.
After discussion, Council decided to table ordinance until the
October 22, 1996 Council Meeting.
BID RECAP - BULLOCK ROAD WATERLINE AND STREET RECONSTRUCTION -
PWD Smart presented the two bids received:
Bannock Paving Co.
$64,384.00
Hunziker Construction
$62,206.00
PWD Smart explained, City purchased the waterline materials
prior to the bid, the $62,206. bid is for reconstruction of
street and installation only.
Councilman Gunter moved to accept the low bid from Hunziker
Construction of $62,206.00 for installation of waterline and
reconstruction of Bullock Road, also direct Mayor Cotant to
enter into a contract with Hunziker Construction.
Councilman England seconded. All council members voted in
favor of motion.
LOCAL IMPROVEMENT DISTRICT NO. 2 - On July 3, 1996 Council
authorized Stewart Engineering to prepare cost estimates and
assessment rolls for LID No. 2.

Streets included in presentation are Ward, Valenty, Burley,
Burnside, KingsWay, Evans, Linden, Poleline, and Quinn Road.
Eric Stewart presented a map and breakdown of individual and
total costs.
Discussion about individual costs.
Councilman Wood expressed concern about retirees being able to
pay the assessment.
Councilman Quick suggested inviting residents and business
owners affected by the assessments, to a Council Meeting for
their input.
After discussion, Councilman England moved to 1) Direct
Attorney Holmes to send Rick Hillman and Attorney costs of
their portion of the proposed LID~ also setting a date for a
meeting to get Rick Hillman's suggestions. 2) Invite residents
in Valenty/Ward Area to a Council Meeting to present the
costs of the proposed LID. Councilman Gunter seconded. Ail
council members voted in favor of motion.
CLAIMS - Computer print-out claims presented to Mayor Cotant and
Council.
Councilman England moved to approve computer print-out claims
as presented. Councilman Gunter seconded. All council members
voted in favor of motion.
At, 9:05 p.m., Councilman England moved, Councilman Wood seconded,
with full council approval to adjourn meeting.
