October 28, 1997
Minutes of regular meeting held at city municipal buildine',
October 28, 1997. -
]?resent: Mayor John O. Cotant, Councilmembers Leto}. S. Quick,
Steven M. England, W. Dean Wood, Marvin A. Gunter~ Attorney
Thomas J. Holmes, Public Works Directar Steven M. Smart and
City Clerk Ron C. Conlin.
Meeting was called to ~_d~. at 7:~0 p.m. by Mayor John O. Cotant.
PLEDGE ALLEGIANCE TO THE FLAG
APPROVAL OF MINUTES: Mayor Cotant asked for corrections or
additions to Regular Meeting Minutes of October 14, 1997 and
Special Meeting Minutes of October 21, 1997.
Councilman Wood moved to approve Regular Meeting Minutes of
October 14, 19~.~ as read. Councilman Gunter seconded. All
c,Duncil members -~ +~

Councilman Gunter moved to approve Special Meetin~ Minutes of
October 21, 1997 as read. Councilman England seconded. Ail
council members voted in favor of motion.
CITY BOUNDARY DISCUSSION WITH DAVID FULLEB, 4870 BUFFALO ROAD
David Fuller stated ~e moved in 4870 Buffalo Road thinking he
was in the County. Mr. Fuller said he installed a well and
septfic tank, Hr. Fuller said he would prefer to be in the
County because of the higher property taxes city residents
pay. Mr. Fuller stated he if confused, because he received
conflieting stories of rather he is in County or not.
Attorney Holmes stated City Staff can research the City
Ordinance annexing the 4870 Buffalo Road property in the City.
ORDINANCE - Annexing certain lands to be included within 'the
boundaries and jurisdictional limits of the City of Chubbuck.
Tract At Alenskis 11573 N. Whitaker Road
Tract B: Ellis School 11.888 N. Whitaker Road.
Tract C: Hi!ine Acres Subdivision - Lots 1, 2 & 3 of
Hiline Acres Subdivision.
Mayor Cotant read ordinance by title only for the second
reading.
Council tabled ordinance until the November 11, 1997 Council
Meeting.

MORI BYINGTON, BANNOCK PLANNING ORGANIZATION ACCESS MANAGEMENT
PLAN - Mori Byington was present to discuss the City of Chubbuok's
Access Management Guidelines adopted December 10, 1996.
Councilman Quick suggested Staff prepare a simplified form
addressing Access Management Guidelines for referral at
meetings.
ORDINANCE #475 ExPressing an intent to sell, convey or exchange
certain described real property owned by the City, authorizing
a sale for cash or terms of said parcel by Public Auction to
the highest bidders for amonnts equaling or exceeding the
appraisals; reservin~ to city the right to reject any or all.
bids on any parcel, prohibiting such sale from occurring until
sixty days have eP~pired from the date of passage of this
ordinance and a public hearing has been held during that
period; providin~ that proceeds from sales shall be used to
discharge City indebtedness or for public improvements,
providing that if the property is not sold at public auction,
the same may be exchanged for other property without further
notice or auction.
Lot ]4, excepting the west 282.5 feet thereof, Block 1,
Diamond Court Subdivision to Bannock County, Idaho,
according to the official plat thereof on file with the
Bannock County Recorder.
Mayor Cotant read Ordinance #475 in full for the first and
final reading.
Councilman England moved to dispense with the rule of reading
Ordinance #~75 on three separate days. Councilman Wood
seconded. Roll Call Vote: Quick, yes; England~ yes; Gunter,
yes; Wood, yes.
Councilman Quick moved 'to adopt Ordinance #476 as read.
Councilman Gunter seconded. Roll Call Vote: Quick, yes;
England, yes; Gunter~ yes; Wood~ yes.
APPEAL OF REQUIREMENTS DESIGN REVIEW COMMITTEE PUT ON 2-T TRAILER
SALES ON PROPERTY AT 4612 & 4618 YELLOWSTONE AVE -
Claire Cheirrett, 2-T Trailer Sales agreed to the
conditions required by Design Review Committee on

1) A chain shall be put up across Yellowstone Ave curb cut.
The Yellowstone Ave. curb cut can be used for moving trailers,
otc in and out from sales site. There will be no customer
access on Yellowstone AYe unless customer parking paving
requirement is met.

2) Landscaping reqnirement of grass with automatic sprinkler
system to be installed on Yellowstone Ave. frontage.
3) Uniform parking of trailers, tractors and pick up beds.
Don Andre, 711 Victor owner of the proper'tM rented to 2-T
Trailer Sales was present appealing the chain requirement on
Yellowstone Ave and automating sprinkling ef landscaping.
Mr. Andre suggested, putting a chain across the access might
be a safetM hazard causing vehicles to pnll in hitting the
chain, then backing out onto Yellowstone Ave,
Discussion bou~ paving customer parking up front behind the
sidewalk,
After considerable discussion, Don Andre agreed to follow the
Design Review Committee requirements and pave customer parking
area and complete landscaping requirement.
Council agreed to set deadline of June 1, 1998 for customer
parking paving and landscaping requirements.
GENERAL DISCUSSION -
1. Councilman ~uiek suggested the City sweep gravel from
Independence St.
Special Meeting to Canvas City Election~ November 5, 1997
at 5:00 p.m.
CLAIMS Computer print-out claims presented to Mayor Cotant and
Council.
Councilman Quick moved to approve computer print-out claims as
presented. Councilman Wood seconded. Ail councilmembers voted
in favor of motion.
At 9:17 p.m., Councilman Gunter moved Councilman Wood seconded,
wit[h full council approval to adjourn meeting.
