HomeMy WebLinkAbout06 01 1971 CMMinutes of the meeting of the council and zoning commission held at the municipal building June l, 1971 at 7:O0 Mayor informed council and zoning commission that serious consideration of the 0r~inances proposed by the Bannock Development Council has been undertaken. Zoning commission members felt enough time sho~ald be taken to be sure and get what is wanted and have it complete at time of adoption. Comparison of the two ordinances discussed. Mayor, Council and Zoning commission agreed to meet Thursday evening June 3, at 7:00 P.%~. to go over ordinances aud complete aLL details and changes that are wanted. A special meeting for the purpose of a public hearing on zoning was held by the Council and Mayor of the City of Chubbuck at the Chubbuck Elementary School on June l, 1971. Meeting called to order by Mayor Cotant at 8:10 P.M. Present: Mayor Cotant, Councilman Leslie, Romriell, and Taylor. Zoning co~m~ision members present: Jim Branson, Dwain Kinghern, Jack Menard, kodney Parrish, and Bob Wilson. Mayor told audience the plan of zoning was control mostly for the future not to take anything from anyone at the present. Ed Stuart questioned if he could keep livestock and was told he could. Ralph Nelson stated they plan to build a home on corner of Adams and Yellow, tone and were told they certainly could build their home in this conmercial ares~ Darrell Burrows questioned if livestock could be kept on his property on Adams Drive and was told yes. Ernest Stuart, Whitaker Rd. Questioned if certain animals could be eliminated in certain areas such as pigs. Several residents along h~itaker Rd. complained of the smell of pigs and requested they not be allowed. ¥~s. Ed Stuart asked how many feet backwas zoned commercial on YeLlowstone Hiway and the answer was given 300 ft. L. V. Hageman and Louis Hogge proposed the housing area from Alton St. on both sides west to the Carousel Mobile Park on the North side of Chubbuck Rd. stay zoned Residential. Also stated they felt they would have more control if it were ~oned residential. Mm. Hogge asked if there are any restrictions for home loans in a 6o~mercial area. Council- man Leslie explained it depended on the area but that he felt in Mr. Hogge's and Mr. Hageman's property there would be no restrictions.~ Council and Commission stated they felt they could zone this area residential 3-L. Councilman Leslie felt the realtors for that area that is for sale are pushing for multiple dwellings anyway. Ralph E. Lac~. Letter from county assessor read in full by Mayor Cotsnt, which explain- ed the relationship of zoning to the assessment of property, in which he stated zoning should not change the value of any property. ~. Marshall told of how nature can control the law of zoning by heavy traffic, etc. Max parrish asked where zoning is proposed for trailer parks or mobile home estste parks. The answer was Mingo Lane, Briscoe Rd. and Luck~ Ave. are designated as such. Any co~nercial general will allow trailer courts also. If a person owns land and it is not adverse to neighbors could the owner request what he:~ like his ground zoned, asked Mr. Parrish~ and is there any reason Mr. Bistline cannot have his 11 acres zoned R-2-T? If lots facing Chubbuck Rd. were sold for residential use, is there any reason Mr. Bistline's ground cannot be zoned R-2T? If a buffer zone was left along Chubbuck Rd. could the remaining ground be zoned R-2T? Discussion followed as to mobile homes versus convention homes in definition. Mayor answered he felt the people in the area were against trailers and this has got to be considered. Mayor proposed a meeting be held with residents in that area, Mr. Bistline in favor of this and the council will set up a meeting and notify Mr. Bistline. Marshall Bros. requested by letter that an area approximately 250 feet each way along the south west corner of Chubbuck Rd. and Hawthorne Rd. be zoned co~m~ercial local and that they plan to keep area compatable with the neighborhood. Mayor told Mr. Marshall they would like to keep control of that area. Discussion of changing the ordinance might allow the necessary control they feel is needed. James Chastain asked what decision was nmde on his property on Hawthorne Rd.. He was told it is tentatively agreed for his property plus Selders and Earl Eltis's property to be zoned R-3L.
