Cotant, Council members Leroy S. Quick, Steven M. England, Marvin C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 5:00 p.m. by Mayor Cotant. PLEDGE ALLEGIANCE TO THE FLAG PURPOSE OF SPECIAL MEETING is to 1) Swear in Chief of Police Richard Webb, 2) Hear an appeal from Ray Nestor regarding approval of a conditional use permit to build twin homes at 645,655, 665 and 675 Alpine in Kasiska Subdivision and, 3) Approval of computer print -out claims. APPOINTMENT OF CHUBBUCK POLICE CHIEF RICHARD WEBB - Richard Webb was sworn in as the Chubbuck Chief of Police by City Clerk Ron Conlin. Chief of Police Richard Webb thanked Mayor Cotant and Council for their confidence in him. APPEAL - REGARDING THE LAND USE AND DEVELOPMENT COMMISSION'S APPROVAL OF A CONDITIONAL USE PERMIT TO BOB ELZNER, 625 ALPINE TO BUILD TWIN HOMES AT 645, 655, 665 AND 675 ALPINE IN KASISKA SUBDIVISION - The Council received an appeal from Ray Nestor, 605 Alpine regarding the approval of the conditional use permit approved by the Land Use and Development Commission. Ray Nestor, 605 Alpine stated the problem he has with the approval the of the twin homes is the clustering of them. Mr. Nestor said the Restrictive Covenants fully restricts twin homes in Kasiska Subdivision. Mr. Nestor said the City has an ordinance restricting twin homes and he would like to see the ordinance enforced. Mr. Nestor stated the twin homes will turn into rentals and devalue the existing homes. Mr. Nestor presented a petition with 42 signatures of homeowners wanting to prevent the construction of twin homes built in a cluster on Alpine Drive. Bob Elzner, 625 Alpine presented Mayor Cotant and Council pictures of the twin homes he plans to build. Mr. Elzner said the twin home will not be trashy, etc, Mr. Elzner said if he cannot build twin homes, he will build duplexes. Mr. Elzner presented an appraisal that show the twin homes value at $102,000. for each side, for a total of $204,000. for the twin home. 103 COUNCIL MEETING MINUTES - (cont.) Mr. Elzner gave an explanation of why a change in the look of the twin homes, from the Land Use and Development Commission Meeting to now. Dale Arnold, 5019 Rebecca spoke in favor of the twin homes, Mr. Arnold said the twin homes will not devalue the property owners homes. Mr. Arnold presented appraisals showing what he thinks will be no affect to adjacent property owners. Brett Jensen, 669 Redman stated Bob Elzner is a good builder, but Mr. Jensen is concerned about twin homes being built in the subdivision. Mr. Jensen said he is concerned about the twin homes becoming rentals and devaluating the property in the subdivision. Ray Nestor expressed concern the sewer system will not be capable of handling the additional residents with clustered twin homes. PWD Smart stated the sewer system will handle the additional clustered twin homes. Bob Elzner stated, at this time, he plans on building three twin homes in the subdivision. The Land Use and Development Commission required Mr. Elzner bring the home plan design through the Design Review Committee for their review and approval. Gary Bishop, 4435 Deer Ave asked how many homes can be on the four lots, Mr. Bishop was told Mr. Elzner can build eight homes on the four lots. Councilman Kearns moved to approve the conditional use permit issued to Bob Elzner, 625 Alpine to allow the clustering of twin homes on two of the four lots approved by the Land Use and Development Commission, also requiring the exterior of the two twin homes be approved by Design Review Committee, Councilman Gunter seconded. All council members voted in favor of motion. CLAIMS - Computer print -out claims presented to Mayor Cotant and Council. Councilman Gunter moved to approve computer print -out claims as presented, �` Councilman Kearns seconded. All council members voted in favor of motion. 105 COUNCIL MEETING MINUTES - (cont.)
